Dear Mr. Conner:
You have our approval, in accordance with the attached conditions and those listed below, to dredge material from 20,000
square feet of waters for the purpose of recovering sand deposited in waterfowl impoundments by Hurricane Dennis at Pea Island
National Wildlife Refuge to facilitate the relocation of Highway 12 according to an application tiled on September 4, 1999.
After reviewing your application and the revisions to the application, we have decided that this fill is covered by General Water
Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

NORTH CAROLINA DIVISION OF WATER QUALITY
PUBLIC NOTICE is hereby given that Nantahala Power and Light Company in Franklin
North Carolina, has applied to the North Carolina Division of Water Quality for a Water
Quality Certification pursuant to Section 401 of the Federal Clean Water Act and Water
Quality Commission rules in 15A NCAC 2B .0101, 15A NCAC 2B .0231 and 15A
NCAC 2H .0500. The activity for this Certification is sought to relicense the Queens
Creek hydroelectric project with the Federal Energy Regulatory Commission in Madison
County. DWQ intends to issue a 401 Certification with a requirement for a minimum
low flow release which would vary from 2.0 cfs in August to October and 4.0 cfs from
February to May.
The public is invited to comment on the above mentioned application to the Division of
Water Quality. Comments shall be in writing and shall be received by the Division no
later than September 27, 1999. Comments should be sent to the N.C. Division of Water
Quality, Non-Discharge Branch, 1621 Mail Service Center, Raleigh, NC 27699-1621,

National Wildlife Refuge waterfowl impoundments
Attached please find an application from the North Carolina Department of Transportation
requesting authorization for reconstructing several protective dunes adjacent to highway NC 12.
These dunes, which were destroyed as a result of Hurricane Dennis, are crucial to protecting the
highway. In some areas large amounts of sand were washed into the adjacent waterfowl
impoundments west of NC 12 within the Pea Island National Wildlife Refuge. It will be
necessary to remove this sand in order to have enough material to reconstruct the dunes. This
removal will also facilitate the management objectives of the US Fish and Wildlife Service by
reopening portions of the waterfowl impoundments.
The Division of Coastal Management will be authorizing this activity under the emergency
provisions of the Coastal Area Management Act. As we have previously discussed, I would like
to request that if possible the Division of Water Quality issue a Water Quality Certification as
soon as possible so that this critical activity may proceed. Please feel free to contact me at 733-
