The site contains wooded land and fields. The fields are used as pastureland. A utility easement crosses the
southeastern portion of the site. Residential and agricultural properties are located in the vicinity of the site.

The purpose of the proposed project is to construct Phase II of a single family residential subdivision (Cadence).
3e. Describe the overall project in detail, including the type of equipment to be used:
The proposed development consists of constructing Phase II of Cadence subdivision. Phase II contains 64 proposed
single-family residential lots, associated access roads and landscaped areas. In order to provide access to 63 of the lots,
it is necessary to constuct a stream and wetland crossing. To facilitate the construction of the access road and
development of the site, clearing and grading the site is necessary. Graders, haulers, excavators and other heavy
equipment will be used during grading and construction of the site.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant has designed the proposed residential sub-division to avoid other impacts to streams and wetlands, specifically
associated with lot/pad fill. The applicant has further demonstrated avoidance and minimization of stream impacts by
proposing to construct culvert head/end walls. The applicant has designed the stream crossing in a relatively straight portion
of the stream. Shifting the crossing up-gradient would impact more stream due to stream meanders and the confluence of two
streams. Shifting the crossing down-gradient would impact more wetlands. The remaining 2,189 linear feet of stream and
2.62 acres of wetland are being avoided.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence will be used. A temporary coffer dam will be installed upgradient of the
proposed culvert. During construction, water will be pumped around the construction footprint. Appropriate stream bank
protection will be provided in the channel during construction and all excess excavated material will be immediately removed
from the stream bank crossing area. The rip rap is being keyed in to further minimize the impacts to the stream. Upon
completion of the culvert installation, the temporary sand bag coffer dam will be removed and flow will be diverted through the
culvert. Following construction, disturbed banks will be restored to similar pre-construction conditions, matted and seeded/live
staked.

We consulted the USFWS Website to determine if federally protected endangered or threatened species inhabit Guilford
County, NC. The bald eagle, Cape Fear shiner, Roanoke logperch, Schweinitz's sunflower and small whorled pogonia are
listed as federally protected species. Based on our observations, the proposed development will not disturb the bald
eagle. The site is not located within the current ranges for the Cape Fear shiner and Roanoke logperch based on a
review of the USFWS Environmental Conservation Online System. Suitable habitat for Schweinitz's sunflower and small
whorled pogonia is not located on the site. Therefore, it is our opinion that the proposed project will have no effect on
federally protected species or their habitat.

Based on our knowledge of the site, the site is not located in or near an area designated as essential fish habitat. Best

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in-
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant’s responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in-lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

Upon receipt of payment, DMS will take responsibility for providing the compensatory mitigation. The
