Roden-Reynolds, Johnson, Wojoski and Hamstead, Enclosed is a request for Nationwide Permit #29 for the Cameron Commons site on 93.77 acres located at 11815 University City Boulevard in Charlotte, NC. The site is a proposed residential development and consists of six streams and nine wetlands. A preliminary jurisdictional determination request was previously submitted and approved by USACE (D. Shaeffer) on 1/23/2020. Please refer to the Jurisdictional Determination Information and Approvals/Authorizations sections for information on onsite surface waters. As shown on the attached exhibits, the proposed project will include permanent impacts to three streams for road crossing access. Total permanent impacts proposed include 298 linear feet of stream impact (Streams A, B and L) and 0.08 acres of wetland impacts (Wetland E). These access crossings were necessary due to City connectivity requirements as well as constraints from existing sewer line infrastructure and onsite stream buffers. Please refer to the Correspondence Documents section for additional information and communication regarding the requirements and encumbrances considered in determining the proposed roadway connections. 2 Impacts to site surface waters associated with the proposed development were limited through site selection location, design, and the location/orientation of the proposed lots and access routes. Headwalls are proposed at each crossing and, where possible, 2:1 slopes will be implemented to limit impacts to site surface waters. The applicant has demonstrated substantial avoidance and minimization efforts in which 75% of onsite wetlands and 95% of onsite streams will be avoided. To compensate for the anticipated permanent impacts to onsite wetlands, the applicant is proposing payment to the North Carolina Division of Mitigation Services In-Lieu Fee Program at a 2:1 ratio. Also enclosed is a copy of our Threatened/Endangered Species Evaluation for the site. No listed species were identified within the project area and we believe that there will be no effect on listed species, or their critical habitat as designated under Section 7 of the Endangered Species Act. Please note that this decision does not assure that participation in the DMS in- lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant’s responsibility to send copies of the permits to DMS. I’m working on a project called Cameron Commons Subdivision which was recently rezoned (Rezoning Petition #2018-160).  Attached is the Approved Rezoning Site Plan. A CDOT comment during the rezoning was to provide a Collector Street to the back corner of the project.  Attached is our current layout which I have placed a red line along the collector road layout.  Unfortunately, we are running into an issue fitting the road between the stream buffer and the existing 36” Sanitary Sewer.  Close to the main creek, the sewer is at reasonable depth, but as the sewer moves to the North away from the creek the sewer depth increases to 35’ which is deeper than Charlotte Water will allow within the Roadway R/W.  To avoid this deep sewer, would CDOT allow us to have (2) two tee intersection turns in the Collector Roadway?  See the attached Site Layout E. Isaiah/Solomon,   I hope the both of you are staying safe.   I want to follow up on Rezoning Petition #2018-016 (Cameron Commons Subdivision).  We are currently designing this project and have ran into a unique scenario.  See the attached pdf.    Deer Chase Lane extension (in the red box) is crossing a 36” sanitary sewer which is 40’ deep.  We are also crossing the 36” sewer on Turtle Point Road extension but this crossing is much more manageable at only 10’-15’ deep.    With Deer Chase Lane extension crossing the sewer line at such a large depth and at an odd angle, we are foreseeing Charlotte Water drawing issue to the road crossing.  Would CDOT allow us to not connect to Deer Chase Lane because the unique scenario with the sewer line?   Let me know if you have any questions.   Weston Boles, PE Program Manager WK Dickson & Co., Inc. 1213 W. Gaffney October 11, 2019 Lennar – Cameron Commons Threatened / Endangered / Protected Species Evaluation 2 GENERAL LANDSCAPE DESCRIPTION: The Cameron Commons site (93.77 acres) is located just north of US Hwy 49, and just west of the Mecklenburg/Cabarrus County line, in Mecklenburg County, North Carolina. It can be found on the Harrisburg, NC USGS Topographic Quadrangle Map; latitude is 35.3213 N, longitude is -80.6882 W. The site is residential and farmland with outbuildings, landscaping, pasture, fencerows, fields and woodlands, and is in varying stages of disturbance. The topography is gently to moderately sloped with the elevation ranging from 600 to 680 ft. (Figure 1). Figure 1: Lennar – Cameron Commons Threatened / Endangered / Protected Species Evaluation 3 METHODOLOGY: The US Fish and Wildlife Service website https://www.fws.gov/raleigh/species/cntylist/mecklenburg.html was referenced to determine the occurrence of Threatened, Endangered and Protected species for Mecklenburg County North Carolina, the results of which are listed below (Table 1). Maps and aerial photographs were assembled, and the site was investigated on October 8, 2019. Now most occurrences are limited to roadsides, woodland and field edges, and utility rights-of-way (ROW). • Smooth Coneflower (Echinacea laevigata), listed as Federally Endangered, is typically found in open woods, cedar barrens, roadsides, clear cuts, dry limestone bluffs and power line rights-of-way, requiring abundant sunlight and little competition from other plant species. • Michaux’s Sumac (Rhus michauxii), listed as Federally Endangered, requires habitat of sandy forests and woodland edges. This species requires periodic fire as a part of its ecology. A total of three animal species with federal protection are listed as potentially occurring in Mecklenburg County: • Bald Eagle (Haliaeetus leucocephalus), protected by the Bald and Golden Eagle Protection Act, typically inhabits forested areas near large bodies of open water such as lakes, marshes, seacoasts and rivers, where there are suitable fish populations and tall trees for nesting and roosting. • Carolina Heelsplitter (Lasmigona decorata), listed as Federally Endangered, is restricted to cool, clean, well-oxygenated water. Stable, silt- free stream beds are required for this species. Typically stable areas occur where the stream banks are well-vegetated with trees and shrubs. • Northern Long-eared Bat (Myotis septentrionalis), listed as Federally Threatened. During summer, northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non-reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Northern long-eared bats spend winter hibernating in caves and mines, called hibernacula. Lennar – Cameron Commons Threatened / Endangered / Protected Species Evaluation 5 RESULTS: The Cameron Commons site is residential and farmland with outbuildings, landscaping, pasture, fencerows, fields and woodlands. There is a single family residence near Hwy 49, with driveways and dirt roads attendant to outbuildings, sheds and barns. The uplands are generally covered with open expanses of pastureland and fields, with fencerows. There are strips of wooded stream buffers, and disturbed, successional tree cover on the drainage slopes. There are numerous dirt roads and trails lacing the site and it is disturbed throughout. Drainages and an unnamed tributary to Mallard Creek flow northward through the site. There is a sanitary sewer line aligned with the tributary in part. There is a roadside power line along the property boundary at Hwy 49. A large portion of the site is covered with open expanses of pasture and hay fields, dominated by turf grasses (Festuca spp.). Also present are Broomsedge (Andropogon virginianum), Johnson grass (Sorghum halepense), Wingstem (Verbesina sp.), Rabbit Tobacco (Gnapthalium obtusifolium), Tickseed (Coreopsis major), and Foxtail (Setaria sp.). The wooded slopes and stream buffers are comprised of mixed pines and hardwoods with an average diameter at breast height (DBH) of 8-10 inches, with some scattered larger trees present including White Oak (Quercus alba), Sweetgum (Liquidambar styraciflua), Virginia Pine , Shortleaf Pine, Loblolly Pine (Pinus taeda), American ash (Fraxinus americana), Southern Red Oak (Q. falcata), Black Oak (Q. velutina), Hickory (Carya spp.), and Tulip Poplar (Liriodendron tulipifera). Subcanopy species include Redbud (Cercis canadensis), Flowering Dogwood (Cornus florida), Sourwood (Oxydendrum arboreum), Ironwood (Carpinus caroliniana), and American Holly (Ilex opaca). The shrub layer is dominated by Chinese Privet (Ligustrum sinense), and other species present include Spicebush (Lindera benzoin), Blueberry (Vaccinium sp.), Paw Paw (Asimina triloba) and Autumn Olive (Elaeagnus umbellata),. Vines present are Catbrier (Smilax spp.), Japanese Honeysuckle (Lonicera japonica), Crossvine (Bignoinia capreolata), Trumpet Creeper (Campsis radicans), Muscadine (Vitis rotundifolia), and Poison Ivy (Toxicodendron radicans). The herb layer is sparse and includes Christmas Fern (Polystichum acrostichoides), Spotted Wintergreen (Chimaphila maculata), Grapefern (Botrychium sp.), River Oats (Chasmanthium latifolium), and Japanese Stiltgrass (Microstegium vimineum). Some transitional areas have small to medium sized saplings of Red Cedar (Juniperus virginiana), Virginia Pine (Pinus virginiana), Shortleaf Pine (P. echinata), Winged Elm (Ulmus alata), and Black Cherry (Prunus serotina). Invasive shrub species present include Russian Olive (Elaeagnus umbellata) and Lennar – Cameron Commons Threatened / Endangered / Protected Species Evaluation 6 Chinese Privet (Ligustrum sinense). The fencerows are dominated by Red Cedar (Juniperus virginiana), Winged Elm (Ulmus alata), Chinese Privet (Ligustrum sinense), Virginia Pine (P. virginiana), and Short-leaf Pine (Pinus echnata). The disturbed roadsides, sanitary sewer line right of way and power lines are dominated by planted Fescue (Festuca sp.) with mixed shrubs, vines and herbs that typically occur in this habitat, including Blackberry (Rubus sp.), Russian Olive, Chinese Privet, Smooth Sumac (Rhus glabra), Groundsel Tree (Baccharis halimifolia), Plume Grass (Erianthus contortus), Dog Fennel (Eupatorium capillifolium), Sericea Lespedeza , St. John’s Wort (Hypericum sp.), Queen Anne’s Lace (Daucus carota), Pokeweed (Phytolacca americana), Rabbit Tobacco (Gnapthalium obtusifolium), Ragweed (Ambrosia artemisiifolia), Goldenrod (Solidago sp.), Beggars Ticks (Desmodium sp.), and Thoroughwort (Eupatorium sp.). Threatened & Endangered/Protected Species Results • All potential habitats for Schweinitz’s Sunflower, Michaux’s Sumac and Smooth Coneflower along the roadside corridors, power lines, fields and woods edges were closely examined and none of these species were present. • No habitat exists on the site for Bald Eagles, and there were no sightings nor were any nesting sites observed. • Streams on site do not appear to have the habitat characteristics required to support populations of the Carolina Heelsplitter, and they have not been reported to occur in the watershed. No mussels were observed during the survey nor would any be expected on-site. • Comparing the site location to the USFWS Asheville office’s website (http://www.fws.gov/asheville/htmls/project_review/NLEB_in_WNC.html) it appears that the site meets the “exempt” criteria which requires no further action under section 7 of the Endangered Species Act for the northern long eared bat. Lennar – Cameron Commons Threatened / Endangered / Protected Species Evaluation 7 RECOMMENDATIONS: Based on the site investigation and the review of available data, WEPG did not identify any protected species occurring on the subject property. Webb & Associates (RSWA) conducted a limited cultural resources literature search for the Cameron Commons development tract in Mecklenburg County, North Carolina adjacent to the Cabarrus County line (Figure 1). The purpose of this study was to determine if certain types of cultural resources are located within or adjacent to the project area. A “cultural resource” is defined as a discrete area of human activity that is more than 50 years old. Cultural resources include, but are not limited to, historic structures, military earthworks, mines/mining features, historic cemeteries, historic landscape settings, and similar features. The current limited desktop study did not include researching recorded archeological sites, as that research requires physical visitation to the Office of State Archeology in Raleigh. METHODOLOGY Literature and Records Search: Archival sources and background data on the project area were gathered via desktop from the following state repositories: •The North Carolina Historic Preservation Office GIS Web Service (HPOWEB found at http://gis.ncdcr.gov/hpoweb/) •North Carolina Maps Project, found at http://www2.lib.unc.edu/dc/ncmaps/ In addition to the above repositories, the National Park Service’s National Register of Historic Places (NRHP) website was accessed to determine if NRHP-listed properties are located in the project vicinity. Historic aerial photographs were reviewed online at Historicaerials.com and at earthexplorer.usgs.gov/. The following map/aerial photography sources were examined to search for historic resources within and adjacent to the project area: Findings - Limited Cultural Resources Literature Search, Cameron Commons Development Tract Page 2 December 16, 2019 •1910 USDA Soil Map of Mecklenburg County •1930, 1936, 1944, 1949, 1953, 1957, 1962 and 1968 North Carolina County Road Survey Maps •1960, 1965, 1971, and 1 9 7 8 aeri al photographs of M ec k l e n b u rg C o u n t y •1993-2018 Google Earth aerial photography RESULTS National Register of Historic Places: A review of the HPOWEB and NPS databases indicates that there are no NRHP-listed properties located within 1.0 mile of the Cameron Commons development tract. The HPOWEB database, however, indicates that the determined-eligible Banks-Cochrane Farm (2010) is situated approximately 1,400 feet southwest of the study tract (Figure 1). Mecklenburg County Historic Structures: The HPOWEB database is the definitive resource for the locations of state-recognized historic resources in Mecklenburg County. According to this database, there are five historic resources located within 1.0 mile of the Cameron Commons development tract, including the previously mentioned Banks-Cochrane Farm. The closest of the other four resources to the study area is the Johnston-Houston House (MK 1271), located approximately 800 feet west of the project area (Figure 1). Resource MK 1271 was identified by survey in 1990, but no further assessment has been made of its status relative to NRHP eligibility. Historic Cemeteries: Historic maps and aerial photographs show no cemeteries within or adjacent to the study tract. The closest known cemetery is associated with Back Creek Church, more than 1.0 mile west of Cameron Commons development tract. American Revolution in Mecklenburg County: Six known Revolutionary battles or skirmishes took place in Mecklenburg County, but none are known to have occurred within 10.0 miles of the study tract. The location of a fight at Bradley’s Plantation on November 14, 1780 is unknown. No known military actions took place in neighboring Cabarras County (Lewis 2009). Civil War in Mecklenburg County: The main body of Union infantry reached Kershaw, South Carolina (52.0 miles south of the study tract) in February of 1865. The infantry then moved northeast toward Fayetteville and Goldsboro, North Carolina. While raiding, foraging and bivouacking could have taken place within Mecklenburg County, no known military actions occurred in or near the study tract (Davis et al. 1983; Edgar 1998). Structures or Features on Historic Maps and Aerial Photographs: A historic map from 1910 shows a road system passing north of State Route 49 (University City Boulevard) from the Cabarrus- Mecklenburg County line to Back Creek Church Road; the map shows a complicated intersection with roads to the north (forming an “X” pattern) located west of the project tract; the southeast leg of the “X” passed through the study tract (Figure 1). Structures were depicted near the intersection and at the terminal end of the northeast leg of the “X”; two of which were located near to the northwest project area boundaries (Figure 1). County highway maps show no structures, but the map produced in 1930 depicts only the south half of the “X” as a loop road north of State Route 49. Highway maps produced in 1944 indicate that the Findings - Limited Cultural Resources Literature Search, Cameron Commons Development Tract Page 3 December 16, 2019 east part of the loop road was no longer in use and the east return to State Route 49 was located 3,500 feet west of the study area (aka current Harris Houston Road). Aerial photographs taken in 1960-1978 show that the formerly-mapped road passing southeast- northwest through the south portion of the project area remained in use as a field road or jeep trail. Cultivated fields were located within the study area, similar to what is depicted in white on Figure 1, but there were no structures discernable within the project tract. The structure located near the northwest study tract boundary appears to be no longer present or absent by about 1978. A structure within the project area located north of State Route 49 is distinguishable on the 1965 aerial photographs and appears to have been in continual use since that time (Figure 1). Other structures on historic aerial photographs were located east, west, and south of the south boundary of the project tract (Figure 1). SUMMARY There are no NRHP-listed historic properties, recorded historic structures or mapped cemeteries located within the Cameron Commons development tract. A historic resource that was determined- eligible for the NRHP in 2010 (MK 2078, the Banks-Cochrane Farm) is located approximately 1,400 feet southwest of the study area. One structure that appeared on the 1910 map was recorded as the Johnson Houston House (MK 1271) in 1990, 800 feet west of the study area. Historic maps and aerial photographs indicate a road and two structures located along, near, and/or adjacent to, the northwest study area boundaries during at least the period of 1910 to 1978.
