Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Resources (DWR or
the Division) conducted a compliance evaluation inspection (CEI) of the RH Johnson Construction
Wastewater Treatment Plant (WWTP) on November 18, 2015.
Because neither the plant nor the facilities it will serve have been constructed yet, this inspection
consisted of a simple file review. Our most recent information indicates that neither the plant nor the homes
that will discharge to it have been built and there is currently no indication of when they will be built. Also, you
have no plans to develop the property and build the plant. You have the property on the market and are
simply maintaining the permit in active status for whoever does eventually purchase and develop the property.
You are reminded that prior to building the plant you must acquire an Authorization to Construct (AtC)
permit from the Division. Also, you must designate an Operator in Responsible Charge (ORC) and Backup
ORC in accordance with NC Administrative Code 15A NCAC 08G, before any waste can be introduced into
the new plant. Finally, you must also notify this office at least 72 hours in advance of any discharge from a
new wastewater treatment plant to surface waters of the State, so that we can perform an onsite inspection
if required.

The subject permit's expiration date is February 29, 2012. Federal [40 CFR 122] and state (15A
NCAC 2H.0105 (e)) regulations require that an application for permit renewal be filed at least 180 days prior
to expiration of the current permit. To satisfy this requirement, your renewal package should have been
sent to the Division postmarked no later than September 2, 2011.
As of this date, the Division has not received your renewal application. This is a violation of Part II.
B. 10. of your permit, which states "Any permittee that has not requested renewal at least 180 days prior to
expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33
USC 1251 et. seq.". To prevent an assessment of civil penalties you must submit a completed
permit application (see enclosed forms) no later than November 29, 2011.
Use the enclosed checklist to complete your renewal package. The checklist identifies the items you
must submit with the permit renewal application. If all wastewater discharge from your facility has ceased

The following items are REQUIRED for all renewal packages:
o A cover letter requesting renewal of the permit and documenting any changes at the
facility since issuance of the last permit. Submit one signed original and two copies.
o The completed application form (copy attached), signed by the permittee or an
Authorized Representative. Submit one signed original and two copies.
o If .an Authorized Representative (such as a consulting engineer or environmental
consultant) prepares the renewal package, submit written documentation showing the
authority delegated to any such Authorized Representative (see Part II.B.11.b of the
existing NPDES permit).
o A narrative description of the sludge management plan for the facility. Describe how
sludge (or other solids) generated during wastewater treatment are handled and
disposed. If your facility has no such plan (or the permitted facility does not generate
any solids), explain this in writing. Submit one signed original and two copies.
The following item must be submitted by Industrial or Municipal facilities
discharging industrial process wastewater:
o Industrial facilities classified as Primary Industries (see Appendices A-D to Title 40 of
the Code of Federal Regulations, Part 122) must submit a Priority Pollutant Analysis
(PPA) in accordance with 40 CFR Part 122.21. If the PPA cannot be completed by the
time you complete your application package, submit the application package without

Mr. Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ or the
Division) conducted a compliance evaluation inspection (CEI) of the RH Johnson Construction Wastewater
Treatment Plant (WWTP) on January 19th, 2011. During this inspection Mr. Boone verified that neither the plant
itself nor the homes that will discharge to it have yet been built. A follow up phone call to you on January 21sf
2011, also verified these facts.
You told Mr. Boone during his phone conversation with you that the future plant has been turned over to
your step children and that you would have them contact Mr. Boone so new contact information could be attained.
Please ensure they do in fact contact Mr. Boone so we can update our records accordingly.
You are reminded that you must designate an Operator in Responsible Charge (ORC) for the future plant
before any waste can be introduced into the new plant. You must also notify this office at least 72 hours in
advance of any such new WWTP discharge to surface waters of the State.
Please also bear in mind that in accordance with NC General Statute 143-215.6A, the Director of the
Division of Water Quality may assess civil penalties not to exceed $25,000 per day, per violation, for violations
of the NCO079049 NPDES permit. If you have any questions regarding the permit or this letter, please call Mr.

4. Alternative Analysis Evaluation: Has the facility evaluated
all of the non -discharge options available. Please provide
regional perspective for each option evaluated. A very brief
(8 sentence) preliminary engineering proposal was submitted
with the initial permit application (4/1/90). A detailed
alternatives analysis conforming to current DEM guidance has
not been performed.
Contact with the City of Winston-Salem Engineering Division
indicates that municipal sewer lines are present 3,500 feet to
the west in Rural Hall (along Grassy Creek) and 4,500 feet
south in Winston-Salem (Stanleyville Drive and University
Parkway intersection). It is not known if easements could be
obtained from adjoining property owners, DOT or the railway.

PART IV - EVALUATION AND RECOMMENDATIONS
At this time the proposed development is expected to consist
of 75 units for retiree's and a golf driving range. Although the
site is currently undeveloped, the property has been filled (over
40 ft. at north end) and graded flat. At least 1,500 feet of Rough
Fork has been placed in a culvert under the site.
It should be noted that an Authorization to Construct was not
requested under the term of the previous permit. It is our
office's understanding that the permit for R.H. Johnson would be
considered a "New" facility per 15A NCAC 2H .0138(a).
