Because neither the plant nor the facilities it will serve have been constructed yet, this inspection consisted of a simple file review. Our most recent information indicates that neither the plant nor the homes that will discharge to it have been built and there is currently no indication of when they will be built. Also, you have no plans to develop the property and build the plant. You have the property on the market and are simply maintaining the permit in active status for whoever does eventually purchase and develop the property. You are reminded that prior to building the plant you must acquire an Authorization to Construct (AtC) permit from the Division. Also, you must designate an Operator in Responsible Charge (ORC) and Backup ORC in accordance with NC Administrative Code 15A NCAC 08G, before any waste can be introduced into the new plant. Finally, you must also notify this office at least 72 hours in advance of any discharge from a new wastewater treatment plant to surface waters of the State, so that we can perform an onsite inspection if required. Federal [40 CFR 122] and state (15A NCAC 2H.0105 (e)) regulations require that an application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy this requirement, your renewal package should have been sent to the Division postmarked no later than September 2, 2011. As of this date, the Division has not received your renewal application. This is a violation of Part II. B. 10. of your permit, which states "Any permittee that has not requested renewal at least 180 days prior to expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33 USC 1251 et. seq.". To prevent an assessment of civil penalties you must submit a completed permit application (see enclosed forms) no later than November 29, 2011. Contact with the City of Winston-Salem Engineering Division indicates that municipal sewer lines are present 3,500 feet to the west in Rural Hall (along Grassy Creek) and 4,500 feet south in Winston-Salem (Stanleyville Drive and University Parkway intersection). It is not known if easements could be obtained from adjoining property owners, DOT or the railway. S.
