It is issued to North Carolina Department of Transportation resulting in 6.93 acres of wetland impact in Graham County pursuant to revise application filed on the 29' day of September 1999 to widen NC 28 from Edwards Gap to SR 1231. The application provides adequate assurance that the discharge of fill material into the waters of Fontana Lake in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 30b4 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter sct forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. If you change your project, you must notify us and send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow-the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals. Either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. Should waste or borrow sites be located in wetlands or other waters, compensatory mitigation will be required since it is a direct impact from road construction activities; 5. Compensatory mitigation shall be done in accordance with the CORPS of Engineers requirements at least as those described in the September 16, 1999 public Notice. DWQ shall be copied on the final mitigation decision once the mitigation banking instrument for the Tulula Creek mitigation has been approved. Al • Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA Permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to widen and realign NC 28 in Graham County, from Edwards Gap to east of SR 1231 at Stecoah. The current roadway will be widened to a four-lane facility with a 30-foot median. There will be 8-foot useable shoulders along the project, 2 feet of which will be paved. This letter concentrates upon Section DD of TIP No. A-9. This section of A-9 has a length of 2.85 miles. This section of the "D" portion of A-9, section DD, has a let date of April 2000. Other sections of the project (A-9A, A-913 and A-9C) are scheduled for construction after the year 2000. NEPA Documentation The subject project has been divided into sections because the D section serves different transportation functions than the A, B and C sections do. Section D involves widening along existing NC 28 and would accommodate local traffic use with an improved roadway. In the future, this section of the roadway will serve heavier traffic volumes as part of the future US 19-74-129 relocation (Sections A, B and C). Sections A, B and C will occur on new location and provide a new, improved travel corridor through the Appalachian Mountains. The future US 19-74-129 relocation roadway will replace the current, heavily traveled roadway stretch along the Nantahala Gorge. The Draft Environmental Impact Statement (EIS) for the NC 28, future US 19-74- 129 relocation, was approved by the Federal Highway Administration (FHWA) on December 4, 1978. The Final EIS for the subject project was approved on February 4, 1984. A Reevaluation of the Final EIS was done on sections DB, DC and DD of TIP No. A-9 and was signed by the FHWA on October 31, 1995. These documents include studies that investigated impacts to natural systems and protected species, particularly the Reevaluation of the Final EIS for A-9 DB, DC and DD. Copies of each document have been provided to regulatory agencies involved in the permit review process. A Supplemental Draft EIS will be completed for the remaining sections of TIP No. A-9 (A-9A, A-913 and A-9Q. The NCDOT has reviewed the list of federally-protected species produced by the U. S. Fish and Wildlife Service for Graham County. Since completion of the Reevaluation of the Final EIS, no new species have been added for this county (as of January 15, 1999 listing). Previous Project Sections The NCDOT has completed construction of TIP No. A-9 DA (USACE Action Id 199304598). The section was completed in August 1997. The NCDOT mitigated for wetland impacts at the Tulula Creek Mitigation Bank in Graham County. The NCDOT is currently constructing TIP No. A-9 DB/ DC, from Graham County SR 1232 to Swain County SR 1121 at Almonds DA (USACE Action Id 199505335). This project has an anticipated completion date of December 2000. The NCDOT mitigated for wetland and stream impacts at the Tulula Creek Mitigation Bank in Graham County. Impacts to Waters of the United States Impacts to water of the United States cannot be avoided in order to construct the proposed project. The project lies in the Wolf Creek sub-drainage basin of the Little Tennessee River Basin. Road construction will result in 5.17 acres of fill in wetlands, 1.14 acres of excavation in wetlands, 0.62 acre of mechanized clearing in wetlands, 0.02 acre of drained wetlands, 3.77 acres of fill in surface water, and 1,397 feet of stream loss. Wetland delineations were conducted in October 1997 using the field delineation methods outlined in the 1987 U.S. Army Corps of Engineers Wetland Delineation Manual. The U. S. Army Corps of Engineers (Mr. Steve Lund) verified these wetland delineations in November 1997. Wetland evaluations for each wetland site were also conducted according to the Division of Environmental Management (DEM) Guidance for Rating the Values of Wetlands in North Carolina, Fourth Version. Table 1 summarizes impacts to wetland communities by site number, Cowardin classification, DEM rating, fill in wetlands, excavation in wetlands impacts, and impacts to wetlands from mechanized clearing (III). Cowardin classification refers to guidelines developed to classify wetlands and deepwater habitats as outlined in Classification of Wetlands and Deepwater Habitats of the United States by Cowardin et al. "PSS 1 B" denotes palustrine scrub/shrub that has deciduous vegetation and is saturated. "PEM1B" denotes emergent vegetation that is saturated. "PFO 1 B" denotes palustrine, deciduous vegetation that is saturated. The NCDOT has proposed stream relocations of Wolf Creek and a roadside drainage ditch in wetland communities. These proposed stream relocations have been designed using natural stream channel techniques, and mimicked the existing channel of Wolf Creek or an existing roadside drainage ditch through the wetlands. The NCDOT must relocate the roadside drainage ditch, from Station No. 26+20-L- to Station No. 27+50-L-), in order to avoid hydrologic trespass upon the adjacent properties. The NCDOT has also had to install drainage ditches at Site 10 (Sheet 56 of 69) to avoid hydrologic trespass. The NCDOT believes that the drain effect will be very small and has included 0.02 acre of drained wetlands on the summary sheet and in the application. Impacts to wetlands occur predominately to disturbed, herbaceous wetlands found in close proximity to Wolf Creek. Vegetation at these wetlands includes rush (Juncus effuses), sedge (Carex sp.), blackberry (Rubus sp.), fescue (Festuce sp.) with pockets of tag alder (Alnus serrulata), black willow (Salix nigra), elderberry (Sambcus canadensis), and Chinese privet (Ligustrum sinense) found in these wetlands. Some areas are maintained by mowing while others are irregularly maintained. Many of these wetlands are located under a power line corridor that parallels NC 28. 4 Stream impacts are associated with relocating stream channels, extending culverts and relocating pipes for driveway access. Strear- -locations have been designed using natural stream channel techniques. Table 2 sum... izes impacts to stre.-tns. The increase in stream channel results from relocating a "straight" stream channel with a meandering channel. Therefore, channel loss resulting from project construction will be 1,379 feet. Compensatory Mitigation The NCDOT proposes to provide compensatory mitigation by utilizing credits from the Tulula Creek Mitigation Bank in Graham County. A ledger of the credits used from the mitigation bank has been attached (Table 3). The NCDOT recognizes that additional mitigation credits at this site cannot be used until an acceptable mitigation banking instrument has been established for the site. Summary of Project Impacts In summary, the project will result in the fill of 6.91 acres of wetlands, in excavation of 1.14 acres of wetlands, in mechanized clearing of 0.62 acres of wetlands and in 0.02 acre of drain wetlands. The project will impacts 3.77 acres of surface water and 5,470 feet of stream. Of this amount, 4,073 feet of stream will be relocated using natural stream channel design techniques in the hydraulic planning. There will 1,397 feet of stream loss from project construction. The NCDOT requests that the USACE issue a Section 404 Individual Permit for the proposed road project. Application for 401 Water Quality Certification is also requested from the N. C. Division of Water Quality. The NCDOT also asks that the NCWRC provides comments and a concurrence letter to the USACE since the project lies in a trout county. Plans submitted with the application show the proposed widening of the exiting two-lane road to a four- lane facility with a 30-foot wide median and 8-foot useable shoulders. The proposed construction would impact a total of 6.93 acres of palustrine wetland at eleven sites ranging in size from 0.03 acres to 1.72 acres. Of this total, 0.22 acres are deciduous forest vegetated with black willow and red maple, 1.68 acres are scrub shrub vegetated with tag alder, willow, elderberry, swamp dogwood and privet, and 5.03 acres are persistent, emergent marsh vegetated with rushes, sedges and grasses. The non-forested wetlands generally exhibit some form of disturbance either by mowing, pasturing or utility maintenance. The project would also result in impacts to 5470 linear feet of stream channel from pipe and-culvert installation as well as channel relocations. Wolf Creek ranges in size from 2-3 feet wide and less than 6 inches deep in its headwaters (Site 1) to 6-8 feet wide and in excess of 1 foot deep at its lower end (Site 11). Wolf Creek has a medium to high gradient, perennial flow and a variable substrate of sand, gravel, rock and cobble. Wolf Creek and its tributaries are cold-water streams capable of supporting trout. Approximately 4073 linear feet of channel would be relocated utilizing natural channel design techniques. The remaining 1397 linear feet of channel would be lost as a result of culvert extensions, pipe installations and channel shortening. The applicant proposes to install baffles within the 12' x 14' culvert extension at Site 11 to facilitate fish movement. Approximately 3.11 acres of fluctuation zone below the high pool elevation of Fontana Lake would also be filled. This area is alternately open water and dry lake bed depending on lake levels. The applicant is currently proposing to mitigate for both stream and 2 wetland losses at their Tulula Creek Wetlands Mitigation Site near Topton, Graham County. Final approval for the use of this mitigation site is pending the preparation of an acceptable mitigation banking instrument by the applicant. A Final Environmental Impact Statement (FEIS) for the proposed work was approved by the Federal Highway Administration (FHWA) on February 4, 1984. A Reevaluation of the FEIS was done for Sections DB, DC, and DD of TIP No. A-9 and was signed by the FHWA on October 31, 1995. The immediate purpose of the proposed work is to improve roadway safety and accommodate local traffic volumes. In the future, this section of roadway is intended to serve heavier traffic volumes as part of a relocation of US 19-74-129 around the Nantahala Gorge. Plans showing representative portions of the proposed work are included with this public notice. A full set of permit plans may be viewed at or requested from the Asheville Regulatory Field Office, US Army Corps of Engineers, 151 Patton Avenue, Room 143, Asheville, North Carolina 28801-5006. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Department of Environment and Natural Resources (NCDENR) has determined the applicability of a Water Quality Certificate as required by PL 92-500. The Tennessee Valley Authority will review this public notice to determine the need for the applicant to obtain any required authorization under Section 26a of the Tennessee Valley Authority Act. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties' listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the 3 conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. While acquiring right of way for the project, the NCDOT discussed purchasing these mitigation areas with landowners. Most of the landowners refused to discuss the option. One landowner considered the option, but he demanded an excessive amount of money for the land. Since acquisition of these sites is not practical, on-site mitigation is not a option with this project. Part of the reason behind the NCDOT's purchase of the Tulula Mitigation Bank in Graham County was for this project. The NCDOT has drafted an umbrella banking instrument for compensatory mitigation sites and is also currently working on a banking instrument specifically for the Tulula site. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to widen and realign NC 28 in Graham County, from Edwards Gap to east of SR 1231 at Stecoah. The current roadway will be widened to a four-lane facility with a 30-foot median. There will be 8-foot useable shoulders along the project, 2 feet of which will be paved. This letter concentrates upon Section DD of TIP No. A-9. This section of A-9 has a length of 2.85 miles. This section of the "D" portion of A-9, section DD, has a let date of April 2000. Other sections of the project (A-9A, A-913 and A-9C) are scheduled for construction after the year 2000. NEPA Documcntation The subject project has been divided into sections because the D section serves different transportation functions than the A, B and C sections do. Section D involves widening along existing NC 28 and would accommodate local traffic use with an improved roadway. In the future, this section of the roadway will serve heavier traffic volumes as part of the future US 19-74-129 relocation (Sections A, B and Q. Sections A, B and C will occur on new location and provide a new, improved travel corridor through the Appalachian Mountains. The future US 19-74-129 relocation roadway will replace the current, heavily traveled roadway stretch along the Nantahala Gorge. The Draft Environmental Impact Statement (EIS) for the NC 28, future US 19-74- 129 relocation, was approved by the Federal Highway Administration (FHWA) on December 4, 1978. The Final EIS for the subject project was approved on February 4, 1984. A Reevaluation of the Final EIS was done on sections DB, DC and DD of TIP No. A-9 and was signed by the FHWA on October 31, 1995. These documents include studies that investigated impacts to natural systems and protected species, particularly the Reevaluation of the Final EIS for A-9 DB, DC and DD. Copies of each document have been provided to regulatory agencies involved in the permit review process. A Supplemental Draft EIS will be completed for the remaining sections of TIP No. A-9 (A-9A, A-913 and A-9Q. The NCDOT has reviewed the list of federally-protected species produced by the U. S. Fish and Wildlife Service for Graham County. Since completion of the Reevaluation of the Final EIS, no new species have been added for this county (as of January 15, 1999 listing). Previous Project Sections The NCDOT has completed construction of TIP No. A-9 DA (USACE Action Id 199304598). The section was completed in August 1997. The NCDOT mitigated for wetland impacts at the Tulula Creek Mitigation Bank in Graham County. The NCDOT is currently constructing TIP No. A-9 DB/ DC, from Graham County SR 1232 to Swain County SR 1121 at Almonds DA (USACE Action Id 199505335). This project has an anticipated completion date of December 2000. The NCDOT mitigated for wetland and stream impacts at the Tulula Creek Mitigation Bank in Graham County. Impacts to Waters of the United States Impacts to water of the United States cannot be avoided in order to construct the proposed project. The project lies in the Wolf Creek sub-drainage basin of the Little Tennessee River Basin. Road construction will result in 5.17 acres of fill in wetlands, 1.14 acres of excavation in wetlands, 0.62 acre of mechanized clearing in wetlands, 0.02 acre of drained wetlands, 3.77 acres of fill in surface water, and 1,397 feet of stream loss. Wetland delineations were conducted in October 1997 using the field delineation methods outlined in the 1987 U.S. Army Corps of Engineers Wetland Delineation Manual. The U. S. Army Corps of Engineers (Mr. Steve Lund) verified these wetland delineations in November 1997. Wetland evaluations for each wetland site were also conducted according to the Division of Environmental Management (DEM) Guidance for Rating the Values of Wetlands in North Carolina, Fourth Version. Table 1 summarizes impacts to wetland communities by site number, Cowardin classification, DEM rating, fill in wetlands, excavation in wetlands impacts, and impacts to wetlands from mechanized clearing (III). Cowardin classification refers to guidelines developed to classify wetlands and deepwater habitats as outlined in Classification of TVetlands and Deeptivater Habitats of the United States by Cowardin et al. "PSS 1 B" denotes palustrine scrub/shrub that has deciduous vegetation and is saturated. "PEM 1 B" denotes emergent vegetation that is saturated. "PFO1B" denotes palustrine, deciduous vegetation that is saturated. The NCDOT has proposed stream relocations of Wolf Creek and a roadside drainage ditch in wetland communities. These proposed stream relocations have been designed using natural stream channel techniques, and mimicked the existing channel of Wolf Creek or an existing roadside drainage ditch through the wetlands. The NCDOT must relocate the roadside drainage ditch, from Station No. 26+20-L- to Station No. 27+50-L-), in order to avoid hydrologic trespass upon the adjacent properties. The NCDOT has also had to install drainage ditches at Site 10 (Sheet 56 of 69) to avoid hydrologic trespass. The NCDOT believes that the drain effect will be very small and has included 0.02 acre of drained wetlands on the summary sheet and in the application. Impacts to wetlands occur predominately to disturbed, herbaceous wetlands found in close proximity to Wolf Creek. Vegetation at these wetlands includes rush (Juncus effuses), sedge (Carex sp.), blackberry (Rubus sp.), fescue (Festuce sp.) with pockets of tag alder (Alnus serrulata), black willow (Salix nigra), elderberry (Sanibcus canadensis), and Chinese privet (Ligustrum sinense) found in these wetlands. Some areas are maintained by mowing while others are irregularly maintained. Many of these wetlands are located under a power line corridor that parallels NC 28. 4 Stream impacts are associated with relocwi*ig stream channels, extending culverts and relocating pipes for driveway access. The increase in stream channel results from relocating a "straight" stream channel with a meandering channel. Therefore, channel loss resulting from project construction will be 1,379 feet. Compensatory Mitigation The NCDOT proposes to provide compensatory mitigation by utilizing credits from the Tulula Creek Mitigation Bank in Graham County. A ledger of the credits used from the mitigation bank has been attached (Table 3). The NCDOT recognizes that additional mitigation credits at this site cannot be used until an acceptable mitigation banking instrument has been established for the site. Summary of Project Impacts In summary, the project will result in the fill of 6.91 acres of wetlands, in excavation of 1.14 acres of wetlands, in mechanized clearing of 0.62 acres of wetlands and in 0.02 acre of drain wetlands. The project will impacts 3.77 acres of surface water and 5,470 feet of stream. Of this amount, 4,073 feet of stream will be relocated using natural stream channel design techniques in the hydraulic planning. There will 1,397 feet of stream loss from project construction. The NCDOT requests that the USACE issue a Section 404 Individual Permit for the proposed road project. Application for 401 Water Quality Certification is also requested from the N. C. Division of Water Quality. The NCDOT also asks that the NCWRC provides comments and a concurrence letter to the USACE since the project lies in a trout county.
