This certification authorizes the NCDOT to place fill material in 6.825 acres of jurisdictional wetlands, excavate 0.917 acres of jurisdictional wetlands, drain (through ditching) 5.401 acres of jurisdictional wetlands, permanently clear 0.365 acres of jurisdictional wetlands, and temporarily clear 0.690 acres of jurisdictional wetlands. Moreover, this certification authorizes the placement of fill in 1470 linear feet of streams. The purpose of the project is to construct improvements to NC 87 from I-95 to NC 20. The project shall be constructed pursuant to the application filed on the 14"" day of April 1999, and addendum filed on the 17" day of February 2000. Mitigation for the aforementioned impacts will be provided as described in Conditions 6 and 7 of this certification. The application provides adequate assurance that the discharge of fill and other associated impacts to the waters of the Cape Fear Basin in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface'Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 5. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. 6. Compensatory mitigation shall be done for 5.280 acres of riverine, and 8.228 acres of non- riverine wetlands. Therefore, using a replacement ratio of 2:1, a total of 27.0 acres of wetland A 1 mitigation will be performed for this project. Mitigation for these impacts will be provided for at the Dowd Dairy Farm Mitigation Site as follows: 1) 10.6 acres of riverine wetlands, 2) 16.4 acres of non-riverine wetlands. Mitigation for impacts to the 1470 linear feet of streams will be provided for through 640 linear feet of on-site, and 1660 linear feet of off-site mitigation. We understand that you have chosen to perform mitigation for the off-site portion through an in lieu payment to the North Carolina Wetland Restoration Program (NCWRP), and that the WRP has agreed to implement mitigation for the project. In accordance with 15A NCAC 2R.0500, the contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). Until the Wetland Restoration Program receives and clears your check (made payable to DENR - Wetland Restoration Program), wetland or stream fill shall not occur. Final permit drawings for the project were not submitted with either the original permit application or the addendum. Therefore, the NCDOT will need to supply final design permit drawings to the NC Division of Water Quality for the referenced project no later than 4 months after the issuance of the 404 wetlands permit by the US Army Corps of Engineers. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to widen and improve NC 87 from its existing two-lane section to a four-lane divided section with a 46-foot wide grass median. The 28-mile long project begins east of I-95 in Cumberland County and ends at the NC 87 Elizabethtown Bypass in Bladen County. On April 14, 1999, NCDOT submitted a Clean Water Act (CWA) §404 permit application to the US Army Corps of Engineers (USACE) for an Individual Permit and the NC Division of Water Quality (NCDWQ) for a CWA §401 Water Quality Certification. The April 14, 1999 permit application was placed on Public Notice on June 3, 1999. In a letter dated August 13, 1999, NCDWQ placed the April 14, 1999 permit application on hold for the following three reasons. First, maps failed to show areas where fill was being placed into surface waters. Second, insufficient information was included in the permit application regarding stream relocations and the proposed methodology of such relocations. Finally, the application included miscalculations in the area of impacted wetlands. Per an August 11, 1999 phone conversation between Mr. John Hennessy, NCDWQ, and Mr. Tim Bassette of NCDOT, NCDWQ also requested that the permit application include wetland drainage impacts associated with the project's proposed ditches, ditch cleanouts, and stream relocations in wetlands. Project Breakdown and Construction Schedule For construction purposes, NCDOT divides the project into five sections: AA, AB, B, C, and D. The B section of R-2562 has been let to construction. The project impacted 0.30 ac of wetlands and was authorized under a Section 404 Nationwide Permit 26 (USACE Action ID 199704613, NCDWQ Project # 97101). The B section was scheduled to be completed in August of 1999. The NCDOT is preparing to construct the AA and AB sections of the project. These two sections are scheduled to be let for construction in April 2000. Table 1 a updates Table 1 of the April 14, 1999 Individual Permit application, and contains information concerning the construction schedule and the termini of each section. Table la. Consequently, the AA and AB sections of R-2562 will continue to provide 640 linear ft (195 m) at a 1:1 ratio of compensatory on-site stream mitigation. For the remaining 830 linear ft (253 m) of stream loss, NCDOT will continue to utilize the NC Wetland Restoration Program (NCWRP) in order to provide 1,660 linear ft (1,420 m) at a 2:1 ratio of compensatory off-site stream mitigation. Based upon a phone discussion between Mr. Bill Gilmore, NCDOT, and Mr. Hennessy, the NCDWQ will provide a CWA §401 Water Quality Certification as long as the project's drainage impacts are provided in a table and final revised permit drawings are submitted to the environmental agencies within a two to four month time frame. According to the NCDOT Hydraulics Unit, revised permit drawings will be provided to the environmental agencies within approximately two months. In order to assist NCDWQ's future enforcement efforts and meet one of its requests for this permit application, the revised permit drawings will include a two dimensional line for impacted streams rather than a one dimensional line. Ellipse Equation The ellipse equation represents a Natural Resource Conservation Service (NRSC) model designed to predict ditch spacings required for various agricultural applications. The equation serves to predict the average midpoint water table height (i.e., water table) between two drains of equal elevation. The equation can be used to predict ditch spacing and depth required to lower the elliptical water table below a specified depth, assuming a steady rainfall rate. Parameters in the ellipse equation include the following: S=(4K(M2 +2KM))'/Q where: S = distance between drains (ft) K = average lateral hydraulic conductivity (in/hr) M = midpoint water table height above drain (ft) Q = flux or drainage coefficient (in/hr) and M = D-C, if A<_21) where: A = depth of barrier below drain (ft) D = ditch depth (ft) C = depth to water table desired (ft) Soil types along each drain were estimated primarily on NRCS soil surveys and limited field verification. In instances where flooding, construction, or soil heterogeneity was present, one primary soil series was applied for average drainage calculations at each ditch. Roanoke, Deloss, Torhunta, and Johnston Series are the four soil types modeled under R-2562AA. Average lateral hydraulic conductivity (K) was estimated by calculating a weighted average of conductivity data generated by the NRCS-MUUF computer model for each soil series. Conductivity depths were assumed from soil layer descriptions provided in the Cumberland County soil survey (NRCS 1984). In order to represent the maximum depth of saturation required to establish and support CWA §404 jurisdictional wetlands, the depth to water table desired (C) was set to one foot below the soil surface. The drainage coefficient (Q) represents the capacity of the drainage structure to transport flows and was calculated from the hydraulic radius of the ditch, Manning roughness coefficients, and slope values considered typical for the NC Coastal Plain province. The midpoint water table height above the drain (M) was calculated by subtracting the desired one-foot drawdown from each ditch depth (D). A relatively impermeable layer was assumed to be present approximately 10 ft below the surface. The impermeable layer was calculated by subtracting the depth of each ditch from 10 feet. In order to determine the acreage of wetlands potentially impacted by increasing ditch/jurisdictional stream depth, constructing new ditches, or relocating new streams through jurisdictional wetlands, the ellipse equation was applied to Sites 2, 3, 5, 6, and 8 - 10 along the AA section of R-2562. Simulated pre-project drainage area was subtracted from post-project drainage area to calculate the acreage of wetlands drained. Relocated jurisdictional stream channels at Sites 6 and 8 -10 were modeled to drain areas extending into areas of the permit drawings not previously delineated as jurisdictional wetlands. In order to provide a worst case scenario, these areas were consequently assumed to contain jurisdictional wetlands, and their associated impacts included with the rest of the project's wetland impacts. Because the water table is elliptical at the midpoint between ditches, the ellipse equation assumes that a one-foot deep ditch cannot provide adequate drainage at any spacing. Therefore, the relocated jurisdictional stream at Sites 9 and 10 of R-2562AA will have no impact on the adjacent land area, as computed by the model under existing conditions. According to the ellipse equation, the project will drain 5.401 ac (2.186 ha) of wetlands. Depending primarily on ditch depth and average hydraulic conductivity, the estimated distance of drainage impact ranged from 43 ft (13 m) away from the ditch under existing conditions to 207 ft (63 m) away from the ditch under post-project conditions. Table 2a, which revises Table 2 submitted with the April 14, 1999 Individual Permit application and is located at the end of this revised permit application cover letter, depicts the drainage impacts computed by the model. Figures 1- 6, which are enclosed in this permit application revision, depict the modeled drainage area attributed to the project's construction activities. As mentioned in the section entitled "Resolved Application Issues," NCDOT will provide final permit drawings to all environmental agencies within the next two months. These revised permit drawings will accurately depict all of the project's wetland impacts, including drainage impacts, outlined in this permit application revision. According to Page 7 of the April 14, 1999 permit application, NCDOT will utilize Method II Mechanized Clearing for the entire project. Consequently, wetland vegetation will only be cleared, rather than cleared and grubbed, on the project. With one exception, all cleared wetland areas count toward temporary wetland impacts. The exception pertains to cleared wetland areas that intersect drained wetland areas. Under this scenario, all cleared wetland impact areas are considered permanently cleared wetland impacts, and are depicted as such in Table 2a under the column entitled "Permanently Cleared Wetland Impacts (ac)." Impacts to eaters of the United States Construction of the proposed NC 87 widening will permanently impact 13.964 ac (5.651 ha) and temporarily impact 0.690 ac (0.279 ha) of waters of the United States, as defined under 33 CFR §328.3(a). The project will permanently impact 0.456 ac (0.185 ha) of natural or pond surface waters, permanently impact 13.508 ac (5.466 ha) of wetlands, and temporarily impact 0.690 ac (0.279 ha) of wetlands. Of the 13.508 ac of permanent wetland impacts, 5.280 ac (2.137 ha) are considered riverine, with the remaining 8.228 ac (3.330 ha) considered non-riverine impacts. The project will fill 6.825 ac (2.762 ha), excavate 0.917 ac (0.371 ha), drain 5.401 ac (2.186 ha), permanently clear ac 0.365 ac (0.148 ha), and temporarily clear 0.690 ac (0.279 ha) of jurisdictional wetlands. Tables 2a and 3a (Table 3a is also located at the end of this revised permit application cover letter) summarize the project's permanent and temporary impacts to wetland communities on a site-by-site and basis. These tables include information pertinent to each wetland site, including station number, wetland type, riverine or non-riverine association, NCDWQ rating (4`h Version), Cowardin classification, and acreage impacts via fill, excavation, drainage, permanent clearing, and temporary clearing. The proposed project impacts several different wetland community types. Bottomland hardwood forest wetlands comprise 6.945 ac (2.811 ha) of permanent wetland impacts and 0.401 ac (0.162 ha) of temporary wetland impacts. The project will also permanently impact 3.551 ac (1.437 ha) and temporarily impact 0.055 ac (0.022 ha) of wet flat wetlands. Table 4a, which updates Table 4 in the April 14, 1999 permit application and is located at the end of this revised permit application, depicts the wetland communities permanently and temporarily impacted by R-2562AA/AB. Temporarily impacted wetlands reflect cleared wetland areas that do not intersect drained wetland areas. Compensatory Wetland Mitigation The NCDOT proposes to utilize Dowd Dairy Farm Wetlands Mitigation Site for compensatory wetland mitigation. The mitigation site is located in north central Bladen County, approximately 7 miles (11 km) north of Elizabethtown and 2 miles (3 km) east of White Oak. State Route (SR) 1324 (Dowd Dairy Farm Road) borders the site to the north, SR 1332 (Oak Grove Church Road) lies to the west, and dense forest is situated south and east of the site. The site, which sits along a Coastal Plain interstream divide between Ellis Creek to the west and Palmer Branch to the east, falls within the Cape Fear River subbasin 03-06-16 and Hydrologic Unit #03030005. The wetland and surface water impacts associated with R-2562AA/AB fall within the Cape Fear River subbasins 03-06-15 and 03-06-16 and Hydrologic Unit 403030004 and 903030005. Dowd Dairy Farm Mitigation Site consists of approximately 638 ac (258 ha) of prior- converted (PC) cropland and approximately 20 ae (8 ha) of cropland on non-hydric soils. Prior-converted cropland is a wetland that was manipulated and cropped prior to 23 December 1985 to the extent that it no longer exhibits important wetland functions. Prior-converted croplands do not fall under the regulatory jurisdiction of the CWA §404. Compensatory wetland mitigation credits for the Dowd Dairy Farm Mitigation Site are based on wetland functions generated by restoration and comparison of restored functions to impacted wetland resources. A base-line estimated mitigation plan for the site includes 13 ac (5 ha) of restored riverine (headwater) wetlands, 518 ac (210 ha) of restored non- riverine wetlands, 20 ac (8 ha) of restored wetland/upland ecotones, and 107 ac (43 ha) of restored wetland buffers that are adjacent to perimeter canals. The NCDOT's IVetland Mitigation Plan: Dowd Dairy Farm wetlands, Bladen County, North Carolina (May 1997) contains further information on this mitigation site. Site construction for Dowd Dairy Mitigation Site is divided into two parts, Phase I and Phase II. Phase I consisted of clearing/grubbing/ripping most of the site, filling lateral ditches, and adding ditch plugs. The NCDOT completed construction activities under Phase I in September 1998. Planting for the first phase was completed in March 1999. All monitoring wells were installed during Phase 1. The NCDOT is conducting on-going hydrologic monitoring at the mitigation site. Activities conducted under the second phase of construction will include filling the central channel and installing related ditch plugs. Phase II construction activities began during the summer of 1999, were halted for an extended period of time due to wetness from several hurricanes, and will be completed by July 2000. The final planting for Phase II will be completed by March 2001. In order to offset 13.508 ac of permanent wetland impacts associated with the project, the NCDOT proposes to debit 10.6 ac (4.3 ha) of restored riverine wetlands and 16.4 ac (6.6 ha) of restored non-riverine wetlands from Dowd Dairy Farm Mitigation Site. This project is one of three NCDOT projects that uses a portion of Dowd Dairy Farm Mitigation Site for compensatory wetland mitigation. The other two NCDOT projects utilizing the mitigation site are R-2238AA/AB/BA (NC 87 in Cumberland and Harnett Counties) and R-2204A (NC 11 in Duplin County). Tables 7a and 7b update Table 7 in the April 14, 1999 permit application. Table 7a summarizes the compensatory wetland mitigation proposal for R-2562AA/AB. Table 7b outlines the accumulative compensatory wetland mitigation taken from Dowd Dairy Farm Mitigation Site. Per NCDOT's internal draft memo entitled PDEA Debit Mapping/Ledger Procedures (Rev. 10/25/1999) that was discussed during the November 29, 1999 NCDOT/environmental agency meeting in Wilmington, NC, a Site Debit Map of Dowd Dairy Farm Mitigation Site will be generated at the mitigation site's as-built phase once more accurate information is available. _- _''oi__v_ T tI h- 7n. " Authorization Request In summary, construction of the proposed NC 87 widening will permanently impact 13.964 ac and temporarily impact 0.690 ac of waters of the United States. The project will permanently impact 0.456 ac of natural or pond surface waters, permanently impact 13.508 ac of wetlands, and temporarily impact 0.690 ac of wetlands. In order to offset jurisdictional wetland impacts, NCDOT proposes to use 10.6 ac of restored riverine wetlands and 16.4 ac of restored non-riverine wetlands from Dowd Dairy Farm Mitigation Site. The NCDOT also proposes to pay NCWRP $207,500 for compensatory off-site stream mitigation. Based upon the revised impacts to jurisdictional wetlands and proposed compensatory wetland mitigation, NCDOT requests authorization under a CWA §404 Individual Permit and a CWA §401 Water Quality Certification in order to construct the project. Enclosed are preliminary permit drawings that depict the project's drainage impacts. Final revised permit drawings will be provided to the environmental agencies within approximately two months. R- 2562 AA, AB, STATE PROJECT NO. 6.439001T. Project Historv: By letter dated April 4, 1991, the North Carolina Department of transportation (NCDOT) solicited comments from interested regulatory and resource agencies, regarding the evaluation of potential environmental impacts associated with this project. A State Environmental Assessment (EA) was completed and approved by the NCDOT on July 9, 1993. The Finding of No Significant Impact (FONSI) was approved by the NCDOT on March 28, 1995. These documents include studies that investigated impacts to natural systems and protected species for the project. Project Description: The following description of work is taken from data provided by the applicant and from observations made during on-site inspections by a representative of the Corps of Engineers. The North Carolina Department of Transportation (NCDOT) is proposing to widen NC 87 to a four- lane divided section with a 46-foot wide grass median between south of I-95, Cumberland County, to north of NC 20, Bladen County. The proposed project is 12.8 miles long and consists of two segments AA and AB, 5.96 miles long and 6.83 miles long, respectively. Section AA will widen the existing roadway between I-95 to north of Grady Marsh road (SR 2232), Cumberland County. Section AB will widen the existing roadway between north of Grady Marsh road (SR 2232), Cumberland County to north of NC 20 in Bladen County. The proposed project will widen existing NC 87, as described in the FONSI, by adding two lanes asymmetrically to the side with less wetland impacts, where practicable. NCDOT proposes to replace the existing bridge at Rockfish Creek in Cumberland County with a dual lane bridge. According to the EA, the purpose of the proposed project is to resolve existing traffic flow problems and provide an acceptable level of service for the design year, 2016. The EA presents the results of capacity analyses performed for NC 87 and at grade intersections. These analyses show that many sections of NC 87 will approach capacity or operate at an unacceptable level of -2- service, LOS E, in the design year for the No-Build scenario. The proposed project will provide an improved level of service, LOS B, or better for all locations on NC 87 for the design year. The project area is located in the Cape Fear River Basin. The Cape Fear River is the main tributary in the project area. The streams that will be crossed by the proposed project include Grays Creek, Long Branch, Willis Creek, Georgia Branch, Mines Creek, and two unnamed tributaries associated with Murphy Swamp. Construction of the proposed project will permanently impact 13.54 acres of wetlands and 1,457 feet of jurisdictional stream. The wetland impacts include 6.8 acres by filling, 0.92 acres by excavation, and 1.0 acres by mechanized land clearing. Wetland impacts by community type, as classified by Cowardin et al (1992), are as follows: Table 1. Wetland Impacts for R-2562 AA and AB. Wetland impacts within section AA of the proposed project will predominantly affect wet flats, bottomland hardwood forests, and a freshwater marsh. The vast majority of wetland impacts within section AB of the proposed project will affect bottomland hardwood forests. The proposed project will result in a loss of 1,457 of jurisdictional streams. The 1,457 feet of stream losses resulting from the proposed project include 1,066 feet in section AA and 391 in section A.B. In order to compensate for the unavoidable 13.54 acres of wetland impacts associated with this project, NCDOT proposes to use its Dowd Dairy Mitigation Site. This mitigation site is located in north central Bladen County, approximately 7 miles north of the Elizabethtown and 2 miles east of White Oak. State Road (SR) 1324 (Dowd Dairy Road) borders the site to the north, SR 1332 (Oak Grove Church Road) lies to the west, and dense forest is situated south and east of the site. The site is located in the Cape Fear River subbasin 03-06-16 and in Hydrologic Unit #03030005. The wetland and stream impacts associated with the proposed project are located in the Cape River subbasins 03-06-15 and 03-06-16 and Hydrologic Units #03030004 and #03030005. 0 -3- In order to compensate for the unavoidable 1,457 feet of stream impacts associated with this project, NCDOT proposes to provide 640 feet of on-site mitigation and 1,660 feet of off-site mitigation. The proposed project will relocate a total of 640 feet of stream channel to on-site locations at sites 2,3,8,10,12, and 15 in Section AA. These relocated stream segments will approximate existing stream conditions and thus provide 640 feet (1:1 ratio) of compensatory stream mitigation. For the remaining 830 of unavoidable stream impacts, NCDOT proposes to utilize the North Carolina Wetlands Restoration Program to provide 1,660 feet (2:1 ratio) of compensatory stream mitigation. Preliminary design plans, a copy of the corridor public hearing maps, and FONSI are available for review at the Wilmington Regulatory Field Office of the Wilmington District Corps of Engineers, 69 Darlington Avenue, Wilmington, North Carolina 28402. The State of North Carolina will review this public notice to decide the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has decided the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register is the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision, whether to issue a permit, will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts that the proposed activity may have on the public interest requires a careful weighing of all those factors that become relevant in each particular case. The benefits that may be expected to accrue from the proposal must be balanced against its foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore decided by the outcome of the general balancing process. That decision should reflect the national concern for both protection -4- and use of important resources. All factors that may be relevant to the proposal must be considered including the cumulative effects of it. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (according to Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDWQ for certification. Project History: By letter dated April 4, 1991, the North Carolina Department of transportation (NCDOT) solicited comments from interested regulatory and resource agencies, regarding the evaluation of potential environmental impacts associated with this project. A State Environmental Assessment (EA) was completed and approved by the NCDOT on July 9, 1993. The Finding of No Significant Impact (FONSI) was approved by the NCDOT on March 28, 1995. These documents include studies that investigated impacts to natural systems and protected species for the project. Project Description: The following description of work is taken from data provided by the applicant and from observations made during on-site inspections by a representative of the Corps of Engineers. The North Carolina Department of Transportation (NCDOT) is proposing to widen NC 87 to a four- lane divided section with a 46-foot wide grass median between south of I-95, Cumberland County, to north of NC 20, Bladen County. The proposed project is 12.8 miles long and consists of two segments AA and AB, 5.96 miles long and 6.83 miles long, respectively. Section AA will widen the existing roadway between I-95 to north of Grady Marsh road (SR 2232), Cumberland County. Section AB will widen the existing roadway between north of Grady Marsh road (SR 2232), Cumberland County to north of NC 20 in Bladen County. The proposed project will widen existing NC 87, as described in the FONSI, by adding two lanes asymmetrically to the side with less wetland impacts, where practicable. NCDOT proposes to replace the existing bridge at Rockfish Creek in Cumberland County with a dual lane bridge. According to the EA, the purpose of the proposed project is to resolve existing traffic flow problems and provide an acceptable level of service for the design year, 2016. The EA presents the results of capacity analyses performed for NC 87 and at grade intersections. These analyses show that many sections of NC 87 will approach capacity or operate at an unacceptable level of f -2- service, LOS E, in the design year for the No-Build scenario. The proposed project will provide an improved level of service, LOS B, or better for all locations on NC 87 for the design year. The project area is located in the Cape Fear River Basin. The Cape Fear River is the main tributary in the project area. The streams that will be crossed by the proposed project include Grays Creek, Long Branch, Willis Creek, Georgia Branch, Mines Creek, and two unnamed tributaries associated with Murphy Swamp. Construction of the proposed project will permanently impact 13.54 acres of wetlands and 1,457 feet of jurisdictional stream. The wetland impacts include 6.8 acres by filling, 0.92 acres by excavation, and 1.0 acres by mechanized land clearing. Wetland impacts by community type, as classified by Cowardin et al (1992), are as follows: Table 1. Wetland Impacts for R-2562 AA and AB. Wetland impacts within section AA of the proposed project will predominantly affect wet flats, bottomland hardwood forests, and a freshwater marsh. The vast majority of wetland impacts within section AB of the proposed project will affect bottomland hardwood forests. The proposed project will result in a loss of 1,457 of jurisdictional streams. The 1,457 feet of stream losses resulting from the proposed project include 1,066 feet in section AA and 391 in section AB. In order to compensate for the unavoidable 13.54 acres of wetland impacts associated with this project, NCDOT proposes to use its Dowd Dairy Mitigation Site. This mitigation site is located in north central Bladen County, approximately 7 miles north of the Elizabethtown and 2 miles east of White Oak. State Road (SR) 1324 (Dowd Dairy Road) borders the site to the north, SR 1332 (Oak Grove Church Road) lies to the west, and dense forest is situated south and east of the site. The site is located in the Cape Fear River subbasin 03-06-16 and in Hydrologic Unit #03030005. The wetland and stream impacts associated with the proposed project are located in the Cape River subbasins 03-06-15 and 03-06-16 and Hydrologic Units #03030004 and #03030005. j -3- In order to compensate for the unavoidable 1,457 feet of stream impacts associated with this project, NCDOT proposes to provide 640 feet of on-site mitigation and 1,660 feet of off-site mitigation. The proposed project will relocate a total of 640 feet of stream channel to on-site locations at sites 2,3,8,10,12, and 15 in Section AA. These relocated stream segments will approximate existing stream conditions and thus provide 640 feet (1:1 ratio) of compensatory stream mitigation. For the remaining 830 of unavoidable stream impacts, NCDOT proposes to utilize the North Carolina Wetlands Restoration Program to provide 1,660 feet (2:1 ratio) of compensatory stream mitigation. Preliminary design plans, a copy of the corridor public hearing maps, and FONSI are available for review at the Wilmington Regulatory Field Office of the Wilmington District Corps of Engineers, 69 Darlington Avenue, Wilmington, North Carolina 28402. The State of North Carolina will review this public notice to decide the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has decided the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register is the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision, whether to issue a permit, will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts that the proposed activity may have on the public interest requires a careful weighing of all those factors that become relevant in each particular case. The benefits that may be expected to accrue from the proposal must be balanced against its foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore decided by the outcome of the general balancing process. That decision should reflect the national concern for both protection -4- and use of important resources. All factors that may be relevant to the proposal must be considered including the cumulative effects of it. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (according to Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDWQ for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Water Quality (NCDWQ), Salisbury Street, Archdale Building, Raleigh, North Carolina. This certification authorizes the NCDOT to place fill material in 6.825 acres of jurisdictional wetlands, excavate 0.917 acres of jurisdictional wetlands, drain (through ditching) 5.401 acres of jurisdictional wetlands, permanently clear 0.365 acres of jurisdictional wetlands, and temporarily clear 0.690 acres of jurisdictional wetlands. Moreover, this certification authorizes the placement of fill in 1470 linear feet of streams. The purpose of the project is to construct improvements to NC 87 from I-95 to NC 20. The project shall be constructed pursuant to the application filed on the 14 day of April 1999, and addendum filed on the 17" day of February 2000. Mitigation for the aforementioned impacts will be provided as described in Conditions 6 and 7 of this certification. The application provides adequate assurance that the discharge of fill and other associated impacts to the waters of the Cape Fear Basin in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 5. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. 6. Compensatory mitigation shall be done for 5.280 acres of riverine, and 8.228 acres of non- riverine wetlands. Therefore, using a replacement ratio of 2:1, a total of 27.0 acres of wetland mitigation will be performed for this project. Mitigation for these impacts will be provided for at the Dowd Dairy Farm Mitigation Site as follows: 1) 10.6 acres of riverine wetlands, 2) 16.4 acres of non-riverine wetlands. Mitigation for impacts to the 1470 linear feet of streams will be provided for through 640 linear feet of on-site, and 1660 linear feet of off-site mitigation. We understand that you have chosen to perform mitigation for the off-site portion through an in lieu payment to the North Carolina Wetland Restoration Program (NCWRP), and that the WRP has agreed to implement mitigation for the project. In accordance with 15A NCAC 2R.0500, the contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). Until the Wetland Restoration Program receives and clears your check (made payable to DENR - Wetland Restoration Program), wetland or stream fill shall not occur. The payment to NCWRP shall be sent within two months of issuance of the 404 permit. 8. Final permit drawings for the project were not submitted with either the original permit application or the addendum. Therefore, the NCDOT will need to supply final design permit drawings to the NC Division of Water Quality for the referenced project no later than 4 months after the issuance of the 404 wetlands permit by the US Army Corps of Engineers. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final and binding.
