The project appears to directly impact the Brown's Summit Forest/Hardy's Millpond Natural Heritage Natural Area; natural areas are sites with special biodiversity significance. Immediately downstream, we also have records for the state threatened triangle floater (Alasmidonta undulata), notched rainbow (Villosa constricta), and the state significantly rare eastern creekshell (V. delumbis). Although I have not seen if there will be direct impacts to streams or wetlands, we are concerned that the project may increase sedimentation and erosion of the stream, and the removal of overstory could increase stream temperatures; therefore, impacting state -listed mussel species. Please see the following preliminary recommendations: • Our recommendation is to move the sewer line outside the natural heritage natural area, or maintain a minimum 100-foot undisturbed, native, forested buffer along perennial streams, and a minimum 50-foot buffer along intermittent streams and wetlands, whichever is greatest. • We also prefer all crossing of surface waters are either jack and bore or directionally drilled. • Disturbed stream banks and wetlands should be restored to original contours and re -vegetated with native plant materials. Lespedeza and fescue should not be used as they are invasive. Native, annual small grains appropriate for the season are preferred and recommended. • Minimize corridor maintenance and prohibit mowing between April 1 and October 1 to minimize impacts to nesting wildlife. • Pesticides, fertilizers, and other chemicals should not be used in wetland areas or near streams even if they are labeled as water/wetland friendly. • Strict sediment and erosion control measures should be used and installed prior to any land -disturbing activity. Silt fencing, fiber rolls and/or other products should have loose -weave netting that is made of natural fiber materials with movable joints between the vertical and horizontal twines. Silt fencing that has been reinforced with plastic or metal mesh should be avoided as it impedes the movement of terrestrial wildlife species. Depending upon the impacts to streams, Brena Jones, the aquatic diversity coordinator (cc'd), may have further recommendations regarding aquatic species. NC Wildlife Resources Commission comments are in Italic while WithersRavenel’s responses are in Bold. Additionally, we have attached exhibits that show the limits of the Natural Heritage Area in relationship to our project. 1. Our recommendation is to move the sewer line outside the natural heritage area, or maintain a minimum 100-foot undisturbed, naïve, forested buffer along perennial streams, and a minimum 50-foot buffer along intermittent streams and wetlands, whichever is greatest. The proposed project plans (see attached exhibits) show the sewer line being placed outside of the regulatory stream buffers wherever possible. The sewer line within the Natural Heritage Area Boundary is minimal. Due to topographic constraints and specific gradient for a gravity sewer to function properly. The sewer line has been aligned to incorporate the natural topography to keep the sewer as shallow as possible. Therefore, the sewer line can not be moved entirely outside the natural heritage area, as this would require the sewer line to be significantly deepened in order to overcome the topography of the site while maintaining the gradient needed for the gravity sewer to function. 2. We also prefer all crossings of surface waters are either jack and bore or directionally drilled. The two stream crossings and wetland crossing are being installed by jack and bore to avoid impacts to these features. 3. Disturbed stream banks and wetlands should be restored to original contours and re-vegetated with native plant materials. Lespedeza and fescue should not be used as they are invasive. Native, annual small grains appropriate for the season are preferred and recommended. The stream and wetland crossings will be installed by jack and bore. Any temporary stream and wetland crossings for construction access will be achieved by temporary bridges which will span the entire stream and wetlands to avoid disturbance to these features. Therefore, there is no anticipated impacts disturbance to stream banks or wetlands. Water/wetland friendly fertilizers will be used during construction as necessary to promote growth of ground cover to stabilize the easement after construction. Post construction notes will give instructions to avoid pesticides, fertilizers, and other chemicals in the wetland areas and near streams. 6. Strict sediment and erosion control measures should be used and installed prior to any land- disturbing activity. Silt fencing, fiber rolls and/or other products should have loose-weave netting that is made of natural fiber materials with movable joints between the vertical and horizontal twines. Silt fencing that has been reinforced with plastic or metal mesh should be avoided as it impedes the movement of terrestrial wildlife species. A robust erosion control plan has been developed for the site. The plans indicate that all devices shall be removed after construction. A copy of the plans is available upon request.
