Dear Mr. Gilmore:
You have our approval, in accordance with the attached conditions, to place fill material in 0.15 acres of wetlands or
waters for the purpose of a road extension, as you described in your application dated March 5, 1999. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3103.
These Certifications allow you to use Nationwide Permit Numbers 12 and 14 when the Corps of Engineers issues them. In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

SUBJECT: NATIONWIDE PERMITS 14 AND 12 APPLICATION FOR THE COX
ROAD EXTENSION, GASTON COUNTY, TIP # U-2712.
Attached is the application packet for the subject project. The North Carolina
Department of Transportation (NCDOT) proposes to improve and extend a 2 mile (3.2
kilometer) section of SR 2200 (Cox Road) from Duke Street to the Armstrong Park Road/
Gardner Park Road intersection in Gastonia, Gaston County. The new roadway will
consist of a three-lane curb and gutter section from New Hope Road to Armstrong Park
Road. A five-lane curb and gutter facility is proposed from Duke Street to New Hope
Road. Parts of both the three-lane and five-lane facility will include a portion of existing,
two-lane Hoffman Road. The project was documented in an Environmental Assessment
(EA) dated 6/22/95 and a Finding of No Significant Impact (FONSI) dated 3/19/96. The
State Project No. is 8.2811601 and the Federal Project No. is MA-STP-2446(3).
ENVIRONMENTAL IMPACTS
Jurisdictional Wetlands. Wetland delineations were conducted by NCDOT
biologists using the criteria specified in the 1987 Corps of Engineers Wetland Delineation
Manual. There are two jurisdictional wetlands that will be impacted by this project. Both
wetlands are isolated depressions in fields with herbaceous vegetation as the dominant
species. While both wetlands will be impacted in their entirety by this project, the total
impact is only 0.15 acre. No mitigation is proposed for these impacts.

Jurisdictional Surface Waters. The attached summary sheet (page 3 of 3) indicates
the location of every hydraulic structure for each crossing on this project. However, only
four of these crossings were determined to be jurisdictional surface waters requiring
mitigation, sites 5, 6, 8 and 12. Site 5 is Catawba Creek and is the only site below
headwaters. None of the impacts will exceed 150 linear feet. No mitigation is proposed
for these impacts.
Threatened and Endangered Species. As of January 15, 1999, Schweinitz's
sunflower (Helianthus schweinitzii) and the bog turtle (Clemmys muhlenbergii) are the
only federally-protected species listed for Gaston County. A survey was performed for
Schweinitz's sunflower on June 15, 1998. No individuals of the species were found
during the survey. Even though the bog turtle is listed as Threatened due to Similarity of
Appearance (T[S/A]) and no survey is required, a cursory survey was performed for this
species at the same time with similar results.
Cultural Resources. There are no historic or archaeological sites within the area
of potential effect for this project. The State Historic Preservation Office (SHPO) has
concurred that the project will have no effect upon National Register properties or
National Register-eligible archaeological resources.
Utility Crossing. An existing pipeline that crosses Catawba Creek will have to be
relocated as a result of this project. Specifically, a 26 inch and a 14 inch line, both
concrete coated, will be buried approximately six feet below the creek bottom. This will
be accomplished by diverting the creek through a pipe, the size of which will be
determined by the contractor, to one side of the channel and burying approximately half
the pipeline. After the area is stabilized, the water will be diverted to the other side of the
creek utilizing and the remainder of the pipeline buried. Attached is a drawing of the
pipeline relocation (Figure 1).
It is requested that these activities will be permitted via Section 404 Nationwide
Permits 14 and 12. By copy of this letter, we are also requesting the appropriate 401
General Water Quality Certifications from the NC Division of Water Quality. If you

Gardner Park Road intersection in Gastonia, Gaston County. The new roadway will
consist of a three-lane curb and gutter section from New Hope Road to Armstrong Park
Road. A five-lane curb and gutter facility is proposed from Duke Street to New Hope
Road. Parts of both the three-lane and five-lane facility will include a portion of existing,
two-lane Hoffman Road. The project was documented in an Environmental Assessment
(EA) dated 6/22/95 and a Finding of No Significant Impact (FONSI) dated 3/19/96. The
State Project No. is 8.2811601 and the Federal Project No. is MA-STP-2446(3).
ENVIRONMENTAL IMPACTS
Jurisdictional Wetlands. Wetland delineations were conducted by NCDOT
biologists using the criteria specified in the 19871987 Cotes of Engineers Wetland Delineation Engineers Wetland Delineation
Manual. There are two jurisdictional wetlands that will be impacted by this project. Both
wetlands are isolated depressions in fields with herbaceous vegetation as the dominant
species. While both wetlands will be impacted in their entirety by this project, the total
impact is only 0.15 acre. No mitigation is proposed for these impacts.

Jurisdictional Surface Waters. The attached summary sheet (page 3 of 3) indicates
the location of every hydraulic structure for each crossing on this project. However, only
four of these crossings were determined to be jurisdictional surface waters requiring
mitigation, sites 5, 6, 8 and 12. Site 5 is Catawba Creek and is the only site below
headwaters. None of the impacts will exceed 150 linear feet. No mitigation is proposed
for these impacts.
Threatened and Endangered Species. As of January 15, 1999, Schweinitz's
sunflower (Helianthus schweinitzii) and the bog turtle (Clemmys muhlenhergii) are the
only federally-protected species listed for Gaston County. A survey was performed for
Schweinitz's sunflower on June 15, 1998. No individuals of the species were found
during the survey. Even though the bog turtle is listed as Threatened due to Similarity of
Appearance (T[S/A]) and no survey is required, a cursory survey was performed for this
species at the same time with similar results.
Cultural Resources. There are no historic or archaeological sites within the area
of potential effect for this project. The State Historic Preservation Office (SHPO) has
concurred that the project will have no effect upon National Register properties or
National Register-eligible archaeological resources.
Utility Crossing; An existing pipeline that crosses Catawba Creek will have to be
relocated as a result of this project. Specifically, a 26 inch and a 14 inch line, both
concrete coated, will be buried approximately six feet below the creek bottom. This will
be accomplished by diverting the creek through a pipe, the size of which will be
determined by the contractor, to one side of the channel and burying approximately half
the pipeline. After the area is stabilized, the water will be diverted to the other side of the
creek utilizing and the remainder of the pipeline buried. Attached is a drawing of the
pipeline relocation (Figure 1).
It is requested that these activities will be permitted via Section 404 Nationwide
Permits 14 and 12. By copy of this letter, we are also requesting the appropriate 401
General Water Quality Certifications from the NC Division of Water Quality. If you
