Dear Mr. Bolick:
As you described in your application dated 18 February 1999 (received 20 April 1999)
and in accordance with the attached conditions (and those listed below), you have our
approval to place fill material in 0.02 acres of jurisdictional waters and relocate 200
feet of stream channel for the purpose of paving SR 1372A (Richlands Road), in
Caldwell County. After reviewing your application, it is our determination that your
proposed activities are covered by General Water Quality Certification Number 3108.
Certification 3108 corresponds to Nationwide Permit Number 26 issued by the Corps
of Engineers. Prior to initiating any work in jurisdictional areas you should obtain the
necessary permit(s) from the Corps of Engineers as well as any other federal, state or
local permits, including (but not necessarily limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. This approval will expire
when the accompanying 404 permit expires, unless otherwise specified in the General
Certification.
This approval is valid solely for the purpose and design described in your application
(unless modified below). Should your project change, you must notify the DWQ and
submit a new application. If the property is sold, the new owner must be given a copy
of this Certification and approval letter, and is thereby responsible for complying with
all the conditions. If total fills for this project (now or in the future) exceed one acre
to jurisdictional wetlands or 150 linear feet of streams (not including the 200 feet of
stream relocation presented in your application), compensatory mitigation may be
required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.

• Sediment and erosion control measures shall adhere to design standards for
sensitive watersheds (15A NCAC 4B .0024).
• Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the trout spawning season of October 15 through March 31
to protect the egg and fry stages of trout from off-site sedimentation during
construction.
• Mowing of existing vegetated buffers is strongly discouraged to facilitate
sheet flow (dispersed overland flow) for stormwater.
• Existing stream dimensions are to be maintained above and below locations
of culvert extensions. Use of rip-rap for bank stabilization is to be
minimized; instead, native vegetation is to be employed when practical.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this
letter. To ask for a hearing, send a written petition which conforms to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of

Proposal is for 200 feet of stream channel relocation. The
segment (proposed for relocation) currently functions as both the
roadside ditch and stream channel. Richland Road (due to
topography), apparently for the duration of its existence, was
constructed and has been maintained to the edge of a 200-feet
segment of the stream channel. DOT proposes to widen and pave
Richland Road. The widening project necessitates relocation of
the ditch/stream channel. Regional Office Staff recommend
issuance of certification of the project in accordance with your
memorandum of December 4, 1998 and "Standard Relocation
Guidelines".
One additional aspect of the project is an increase in length of
culvert of 24 feet at two locations (14 feet @ station 41+50 and
10 feet @ 53+50). The stream culvert segments to be lengthened
are seeps and should be included in the certification for the
project.

The N. C. Department of Transportation is proposing to grade, drain, base, and
pave SR 1372A, Richlands Road, in Caldwell County when the necessary permits are
obtained. This project will require replacing two (2) cross-line pipes which carry
unnamed tributaries to Tom's Branch and a proposed 200 feet channel change on
Tom's Branch. Also, this project will require an encroachment in the trout stream buffer
zone. Tom's Branch has the DEM classification, C Tr. Due to the proposed work, we
are requesting a 404 Nationwide Permit.
I am sending a joint application form, a straight line sketch with proposed erosion
control, roadway typical section, notes on pipe installation, general notes on erosion
control , cross sections of proposed encroachments in the trout water buffer zone,
channel change typical and a marked county map.
By copy of this letter, I am requesting Mr. Joe Mickey, Western Piedmont Region
Coordinator, to comment directly to you concerning the 404 Nationwide Permit request.
Since a request will be made for a temporary encroachment in the trout water buffer
zone, I am also requesting Mr. Mickey to comment directly to me concerning the
encroachment.
Also, by copy of this letter, I am requesting a 401 Certification from the Division of
Water Quality for this project.
We would like begin construction as soon as the necessary permits are obtained. If
additional information is required, please let me know. Your early review and
consideration will be greatly appreciated.

Silt Basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless otherwise noted
on the plans.
Generally, the order of installation of the erosion control
measures w•ill'be as follows:
Temporary silt- basins shall be installed before
clearing and grubbing begins.
Silt fences and temporary silt ditches shall be
installed after clearing and before grading.
Temporary stone ditch checks shall be installed as
soon as ditchline is established.
Pipe outlet and inlet protection will be done as
soon-as the pipe is'installed.
Seeding and other permanent erosion control
measures are to be implemented as soon as practical.

Typical for use at cross line pipes, culverts and where
disturbed area is near stream.
Maintain above and below stream conditions at
pre-construction widths and depths.
Native vegetation should be maintained or restored
along stream banks where practical.
PIPE INSTALLATION NOTES
1) Install erosion control devices. In streams, where necessary, rock
silt screens will be used.
2) Remove material and existing pipe while limiting, as much as
possible, material and sediment from entering the stream and/or
escaping from project.
3) Prepare pipe foundation while again taking care to limit, as much
as possible, material and sediment from entering the stream and/or
escaping from project. Where possible, new grade will be below
existing strewnbed. If needed, bedding material will be clean
stone.
4) Place the new pipe and compact backfill.
5) Install slope protection on outlet and inlet ends of pipe. Also
complete installation of erosion control measures and perfonn
maintenance as needed on existing measures.
6) Establish permanent vegetation as soon as possible.
