After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3107. This Certification allows you to use Nationwide Permit Number 23 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. TIP No. U-3860 (formerly W-3800), State Project No 8.2472601, Federal Aid Project No. STP-1943(2). Please find attached the Categorical Exclusion Action Classification Form for the referenced project. Note that since the Categorical Exclusion Action Classification Form was prepared the TIP No. has changed from W-3800 to U-3860. The North Carolina Department of Transportation (NCDOT) proposes to widen Trollinger Road from the existing two-lane roadway to a three-lane curb and gutter facility. The typical cross- section consists of two 3.6-meter (12-foot) outside travel lanes (one in each direction), and one 3.6-meter (12-foot) center turn lane. No wetlands will be impacted by the proposed construction. One jurisdictional surface water, an unnamed tributary to the Haw River, is crossed by the project. The existing 24 inch reinforced concrete pipe will be extended approximately 58 feet. The project is being processed by the Federal Highway Administration as a "Categorical Exclusion" (CE) in accordance with 23 CFR 771.115(b). Therefore, we do not anticipate requesting all individual permit but propose to proceed under a Nationwide Permit in accordance Xh% with 33 CFR 330 Appendix A (B-23) issued 13 December 1996, by the Corps of s?. ` Engineers. The provisions of Section 330.4 aild Appendix A (C) of these regulations will f,' `sbL" llowed in the construction of the project. We anticipate that 401 General Water Quality Certification No. 2734 (Categorical Exclusion) will apply to this project, and are providing one copy of the CE document to the North Carolina Department of Environment and Natm,il Resources. Construction of new bus storage and maintenance facilities in areas used predominantly for industrial or transportation purposes where such construction is not inconsistent with existing zoning and located on or near a street with adequate capacity to handle anticipated bus and support vehicle traffic. 9. Rehabilitation or reconstruction of existing rail and bus buildings and ancillary facilities where only minor amounts of additional land are required and there is not a substantial increase in the number of users. 10. Acquisition of land for hardship or protective purposes, advance land acquisition loans under section 3(b) of the UMT Act. Hardship and protective buying will be permitted only for a particular parcel or a limited number of parcels. These types of land acquisition qualify for a CE onl} where the acquisition will not limit the evaluation of alternatives, including shifts in alignment for planned construction projects, which ma} be required in the NEPA process. No project development on such land may proceed until the NEPA process has been completed. D. Special Proiect Information Environmental Commitments 1. Best Management Practices will be adhered to during construction to minimize potential negative environmental impacts. 2. Special attention will be given to proper installation and maintenance of all erosion and sedimentation control devices. 3. NCDOT will stipulate borrow material be taken from upland sources in the construction contract awarded for this project. 4. NCDOT will ensure that the sediment and erosion control measures are not placed in wetlands unless it is absolutely necessary to place silt fences on wetland boundaries to contain siltation.
