After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3108 and 3103. This Certification allows you to use Nationwide Permit Numbers 26 and 14 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. Since wetland fills for this project exceed one acre, compensatory mitigation is required as described in 15A NCAC 211.0506(h)(6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 8.4 acres of wetland mitigation is required for the proposed 4.18 acres of impact. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for this deficit, and that the WRP has agreed to implement mitigation for this project. TIP I-306 DC, Attached for your information is the application. packet for the subject project. NCDOT proposes to improve the interchange and approaches of 1-85 and US 70 Bypass. This project is part of a larger project, I-306, that calls for improvements to I-85 from the Oranse-Durham county through the US 70 Bypass interchange. An analysis of alternatives and environmental impacts arc discussed in a Environmental Assessment (EA) and Finding Of No Significant Impact (FONSI) signed by the Federal Highway Admitlistration (FHWA) October 19, 1987 and September 6, 1991, respectively. Sections of 1306 have been constructed or arc currently under construction. One of those sections, I-306 BA, was permitted via a Nationwide Permit (NWP) 26 in February 1993. Such is the case with section I-306 DC. Existing I-85 and US 70 Bypass in the project area arc 4- lane divided highways. The proposed termini with US 70 Bypass and I-85 north of the project area will continue to tie-in to the existing 4-lane facilities. The terminus with I-85 south of the project will connect with proposed I.306 DB. While enough pavement will be constructed in anticipation of an 8-lane facility, the current desiLm maintains a tie-in with the existing 4-lane facility. Section 1-306 DC also meets the following criteria for independent utility: • The project connects logical termini. The project ties into the existing alignment of I- 85 and US 70 on each end of the project. • The project Is of sufficient length such that environmental matters have been addressed on a broad scope. An Environmental Assessment and Finding of No Significant Impact are completed. These documents addressed all environmental matters with respect to NEPA requirements. Copies are available upon request. • Tlic project has independent significance such that it is a usable and reasonable expenditure even if no other improvements arc rnade in the area. The interchange has become a substandard design that is currently functioning at over capacity resulting in congestion and dangerous driving conditions. Improving this intersection will alleviate much of the congestion and result in safer driving conditions. • 'no project does not restrict consideration of alternatives for other reasonable and foreseeable transportation improvements. Since this project is a widening of an existing facility, it does not restrict future road improvement projects from FROM RALEIGH REGULATORY 02.01.1999 1631 P.04 consideration of alternatives other than the existing facility. however, future widening of the existing facility has already been documented as the least environmentally damaging alternative in the EA and FONSI and is usually the preferred choice of the resource agencies. ENVIRONMENTAL IMPACTS Wetlands. This project will impact nine wetland sites. Wetland delineations were conducted using the criteria specified in the 19R7 Cores of En inccrs Wetland Delineation Manua[. The delineations were verified by Mr. Eric Alsmcycr of the United States Army Corps of Engineers (USACE) Raleigh Regulatory Field Office on April 19, 1996. The Division of Water Quality (DWQ) rating system was applied to caclt tivctland site. Each wetland was also classified according to the United States Fish alld Wildlife Service Wetland Classification System (Cowardin,1979) and the North Carolina Natural heritage Program Natural Community Classification (Schafale and NVeakley, 1990). Table 1 lists the wetland communities, DWQ rating, and acres of impact for the project. TAI3T,$ 1. Tree species included sweet gum (Liquidambar styraciua), red maple (Acer rubrurn), American elm (Ulrrlus ainerieana), tulip poplar (Lirindendron tulipifera), and black willow (Salix nigra). The shrub species included all the tree species, ironwood (Carpinus carolinlana), Chinese privet (Ligustrum sinense), (Prunus serotina), green ash (Fraxinus pennulvanica), and box elder (Acer negundo). The herbaceous and vine layers contain seedling tree and shrub species, Japanese honeysuckle (I.onicera japanica), soft rush (Juncus e ftsus), sedges (Carex sp.), and poison ivy (Toxicodondron radiants). Method Ii mechanized clearing, which clearing to the slope stake limit, will be used throughout the wetlands on the project. Surface Waters The project will impact five jurisdictional surface waters. Two of the sites, 2 and 2A, involve the relocation of existing channels, as detailed in the attached drawings. The existing streams are channelized, most likely due to the construction of the existing facility. NCDOT will expcets at a minimum. to replace all existing functions of the streams. At site 2A, on sheet 6 of 15 in the drawings, NCDOT has designed the new channel with a low flow channel that promotes overbank flooding during large storm events to enhance the adjacent wetland. Additionally, the North Carolina Wildlife Resource Commission Strewn Relocation Guidelines will be followed throughout construction. The largest single amount of stream channel loss is at site 7, 96.8 linear feet. Since all totals are less than 150 linear feet, no mitigation is proposed for the stream impacts. Threatened and Endan erect S ecies. There are three federally listed species for buuhain County, Bald eagle (Haliaeetus Ieucocepl:ulus), smooth concflower (Echtnacea laevtgata) and Miehaux's sumac (Rhl?s michuuxii). Surveys were performed for these species in the rune of 1995. No suitable habitat was found to exist within the p.rojcct limits, therefore the Biological Conclusion of NO EFFECT is still valid for the project. Cultural Resources. There are no historic or archaeological sites within the arcs ofpotcntial effect of this project. The State Historic Preservation Office (SHPO) has concurred that the project will have no effect upon National Register properties or National Register-eligible archaeological resources. MITIGATION OPTIONS The USACE has adopted, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. Mitigation of jurisdictional impacts has been defined by the CEQ to include avoiding impacts, minimizing impacts, and compensating for impacts. Since this project is essentially a widening of an cxlsting facility, impacts were limited to wetlands immediately adjacent to the existing road. Only one area, site 3 and 2A, had any opportunity for minimization of wetland impacts, as previously discussed in the section on Surface Waters. Other avoidance and minimization strategies are discussed in the EA and FONSI. ensation. NCDOT is proposing to pay $201,600.00 to the Wetlands Restoration Program (Wu) to provide 8.4 acres Of wetland restoration to compensate for the 4,18 acres of impact. The signed agreement with WRP will be forwarded upon receipt. As previously noted, no stream mitigation is proposed. ,ROM RALEIGH REGULATORY 02.01.1999 16,32 P.06 It is anticipated that these activities will be permitted under a Nationwide 14 Permit except for the impacts to wetlands 3 and 7: NCDOT requests these be permitted via a Nationwide 26 Permit. NCDOT is aware that all filling of wetlands authorized by the NNVP 26 must be completed by September 15, 2000. By copy of this letter, we are also requesting the appropriate 401 General Water Quality Ccrti fication from the NC Division of Water Quality. TIP I-306 DC. Attached for your information is the application packet for the subject project. NCDOT proposes to improve the interchange and approaches of I-85 and US 70 Bypass. This project is part of a larger project, I-306, that calls for improvements to 1-85 from the Orange-Durham County through the US 70 Bypass interchange. An analysis of alternatives and environmental impacts are discussed in a Environmental Assessment (EA) and Finding Of No Significant Impact (FONSI) signed by the Federal Highway Administration (FHWA) October 19, 1987 and September 6, 1991, respectively. Sections of I-306 have been constructed or are currently under construction. One of those sections, I-306 BA, was permitted via a Nationwide Permit (NWP) 26 in February 1993. None of the other sections required an environmental permit. Table 1 lists the Let dates and completion dates for each section. Table 1. Such is the case with section I-306 DC. Existing I-85 and US 70 Bypass in the project area are 4- lane divided highways. The proposed termini with US 70 Bypass and I-85 north of the project area will continue to tie-in to the existing 4-lane facilities. The terminus with I-85 south of the project will connect with proposed I-306 DB. While enough pavement will be constructed in anticipation of an 8-lane facility, the current design maintains a tie-in with the existing 4-lane facility. Section I-306 DC also meets the following criteria for independent utility: • The project connects logical termini. The project ties into the existing alignment of I- 85 and US 70 on each end of the project. • The project is of sufficient length such that environmental matters have been addressed on a broad scope. An Environmental Assessment and Finding of No Significant Impact are completed. These documents addressed all environmental matters with respect to NEPA requirements. Copies are available upon request. • The project has independent significance such that it is a usable and reasonable expenditure even if no other improvements are made in the area. The interchange has become a substandard design that is currently functioning at over capacity resulting in congestion and dangerous driving conditions. Improving this intersection will alleviate much of the congestion and result in safer driving conditions. • The project does not restrict consideration of alternatives for other reasonable and foreseeable transportation improvements. Since this project is a widening of an existing facility, it does not restrict future road improvement projects from i 3 consideration of alternatives other than the existing facility. However, future widening of the existing facility has already been documented as the least environmentally damaging alternative in the EA and FONSI and is usually the preferred choice of the resource agencies. ENVIRONMENTAL IMPACTS Wetlands. This project will impact nine wetland sites. Wetland delineations were conducted using the criteria specified in the 1987 Corps of Engineers Wetland Delineation Manual. The delineations were verified by Mr. Eric Alsmeyer of the United States Army Corps of Engineers (USAGE) Raleigh Regulatory Field Office on April 19, 1996. The Division of Water Quality (DWQ) rating system was applied to each wetland site. Each wetland was also classified according to the United States Fish and Wildlife Service Wetland Classification System (Cowardin, 1979) and the North Carolina Natural Heritage Program Natural Community Classification (Schafale and Weakley, 1990). The shrub species included all the tree species, ironwood (Carpinus caroliniana), Chinese privet (Ligustrum sinense), (Prunus serotina), green ash (Fraxinus pennsylvanica), and box elder (Ater negundo). The herbaceous and vine layers contain seedling tree and shrub species, Japanese honeysuckle (Lonicera japonica), soft rush (Juncus effusus), sedges (Carex sp.), and poison ivy (Toxicodendron radicans). 4 The "Acres Impacted" column in Table l reflect permanent fill and excavation in wetlands and are itemized in the summary sheets. Method II mechanized clearing, which clearing to the slope stake limit, will be used throughout the wetlands on the project. Surface Waters. The project will impact five jurisdictional surface waters. Two of the sites, 2 and 2A, involve the relocation of existing channels, as detailed in the attached drawings. The existing streams are channelized, most likely due to the construction of the existing facility. NCDOT will expects at a minimum to replace all existing functions of the streams. At site 2A, on sheet 6 of 15 in the drawings, NCDOT has designed the new channel with a low flow channel that promotes overbank flooding during large storm events to enhance the adjacent wetland. Additionally, the North Carolina Wildlife Resource Commission Stream Relocation Guidelines will be followed throughout construction. The largest single amount of stream channel loss is at site 7, 96.8 linear feet. Since all totals are less than 150 linear feet, no mitigation is proposed for the stream impacts. Threatened and Endangered Species. There are three federally listed species for Durham County, Bald eagle (Haliaeetus leucocephalus), smooth coneflower (Echinacea laevigata) and Michaux's sumac (Rhus michauxii). Surveys were performed for these species in the June of 1995. No suitable habitat was found to exist within the project limits, therefore the Biological Conclusion of NO EFFECT is still valid for the project. Cultural Resources. There are no historic or archaeological sites within the area of potential effect of this project. The State Historic Preservation Office (SHPO) has concurred that the project will have no effect upon National Register properties or National Register-eligible archaeological resources. MITIGATION OPTIONS The USACE has adopted, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. Mitigation of jurisdictional impacts has been defined by the CEQ to include avoiding impacts, minimizing impacts, and compensating for impacts. Since this project is essentially a widening of an existing facility, impacts were limited to wetlands immediately adjacent to the existing road. Only one area, site 3 and 2A, had any opportunity for minimization of wetland impacts, as previously discussed in the section on Surface Waters. Other avoidance and minimization strategies are discussed in the EA and FONSI. Compensation. NCDOT is proposing to pay $201,600.00 to the Wetlands Restoration Program (WRP) to provide 8.4 acres of wetland restoration to compensate for the 4.18 acres of impact. The signed agreement with WRP will be forwarded upon receipt. As previously noted, no stream mitigation is proposed. N N 5 It is anticipated that these activities will be permitted under a Nationwide 14 Permit except for the impacts to wetlands 3 and T NCDOT requests these be permitted via a Nationwide 26 Permit. NCDOT is aware that all filling ol'wetlands authorized by the NWP 26 must be completed by September 15, 2000.
