Great information, I thought that was the case. I can't remember if I copied you on the permit for this, so I attached it.
Luckily, I'm not in the field today, but I will be tomorrow and Thursday. Looks like we'll have scattered storms, but it's hard
to know what it will do hour by hour haha. I hope you're doing well — I know you're swamped even more so with Anthony
gone. I hope y'all are able to get some help quickly!

Sorry for the late reply on this one (and you may have already issued it), but using the NW 18 makes sense to me/won't
be any problem for me. Like you/Corps, normally we/DWR normally wouldn't allow any wetland/stream impacts
associated with stormwater BMPs, but for this project, since the feature (or at least the portion in question) was
exempted from the buffers as likely being "man-made", and they didn't extend it down to where the wetland flares out
into the floodplain of the receiving feature, I don't see it as an issue on our end. Thanks again for the info, and hope
you're staying cool, even if you're in the field, because today's supposed to be the hottest yet...

Hi Tristan,
I'm glad you were able to hear back from SHPO. One other issue (not really) is that for NWP29 (Residential
Developments), the Wilmington District does not allow this permit to authorize discharges of fill material in intermittent
streams or wetlands for the purpose of stormwater management facilities. With the impacts being less than 0.1 acres, we
would be able to verify a NWP18 (Minor Discharges). I've copied Chris Pullinger just so that he's aware and to see if that
affects anything on his end. I will be sending an email to the USFWS, according to our programmatic consultation
procedures, for the Northern long-eared bat because the project is within the range of white nose syndrome; however, we
do not have to hear back from them to verify the permit for this project. I'm working on the permit documents now to be
able to turn it around as soon as possible.

Resources and/or Historic Properties. They have different timelines than what we have, but you could call SHPO to see if

I apologize if you have tried to call 252-341-8150 as I have been on the phone all morning. The PCN should be to you
this afternoon. We are allowed timing for permits but we have two years from the time of the award to get all
approvals and the project built to comply and get tax credits on the development. I appreciate any and all that you can
do to help us. We may have some lee way on time but not a lot until we are then hit with penalties for not closing and
then the tax credits are then effected.
I will call our engineer again and ask to get to you early afternoon instead of the end of the day if possible. I thank you

I've tried calling the number listed in your signature to discuss your questions. The Corps does not have fees associated
with our Nationwide Permits and do not have an expedited process in place like the State. I've worked on several FEMA-
funded projects and they typically allow timeframes for permitting. I understand this is a different agency with different
deadlines. I will do my best, but I cannot promise that you'll have a permit verification by July 1st since I don't have the
PCN yet to complete my review. You may forward my emails to the POC for the agency you're receiving funding from or
give them my contact information to confirm that you may need more time.

I can issue a PJD with a NWP verification, but once the PCN is submitted I have 30 days to determine whether or not it's
complete, so you could expect (if no issues) to have a permit within —60 days from receipt of a complete PCN.

The revised JD map that Stuart sent me is accurate, it's a matter of getting the JD paperwork together. Permits take
priority over JDs, but if you let me know your deadlines, I'll do my best to get to it as soon as I can. You keep mentioning
the permitting for this site, but I have yet to see anything submitted (a Pre -construction Notification) ... am I missing
something?

Hi Tristan,
I have been in contact with your consultant, so we're working towards getting a JD map to put with the JD paperwork that
I'll be putting together. I have several permits that I'm working on that take priority over JDs, but I'll do my best to issue the
JD within a timely manner of receiving the revised JD map. I'm not aware of the plans for this site as I've only seen a JD
request, so once you have this map if there are impacts to waters, including wetlands, then yes it would take a permit. I
would suggest contacting your consultant to discuss these matters in more detail because they would be able to help you
fill out a Preconstruction Notification, if necessary.

or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has

tributaries exhibited OHWM and flow into Meeting House Branch, which flows into the Tar River, a TNW.

E. Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the particular site
identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the Food Security
Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA programs, you should request
a certified wetland determination from the local office of the Natural Resources Conservation Service, prior to starting work.

that the permit be modified accordingly. You must complete Section II of this form and return the form to the district

forfeit your right to appeal the permit in the future. Upon receipt of your letter, the district engineer will evaluate your
objections and may: (a) modify the permit to address all of your concerns, (b) modify the permit to address some of your
objections, or (c) not modify the permit having determined that the permit should be issued as previously written. After
evaluating your objections, the district engineer will send you a proffered permit for your reconsideration, as indicated in
Section B below.
