Box 25201 Raleigh, NC, 27611-5201 Dear Mr. Gilmore: You have our approval, in accordance with the attached conditions and those listed below, to Widen US 64 from NC 22 in Ramseur to SR 2469/SR 2628, as you described in your application dated 11 December 1998 (received 22 December 1998). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. Stream restoration shall be implemented onsite as described in your application, and at the Starmount Park, Starmount Forest Country Club, and Sussman's Park Stream Mitigation Sites. This shall include 1063 linear feet of onsite stream relocation and 2434 linear feet of stream mitigation at the offsite locations. Vegetation must be restored along the banks to provide shade for the streams. DOT is required to notify the DWQ Central and Winston-Salem Regional Offices when onsite stream relocation has been completed. This will be followed by a site inspection by DWQ staff. Any sections found to be insufficient for stream restoration will need to be mitigated offsite instead. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. TIP R-2217 A, B & C. Attached is the application packet for the subject project. NCDOT proposes to widen the existing two-lane section of US 64 to a five-lane undivided facility and a four- lane divided facility with a 46 foot grass median. The total project distance is 11.3 miles, running from NC 22 in Ramseur to the existing five lanes just west of Siler City. The five-lane curb and gutter facility will be built through the Town of Ramseur and at the eastern end of the project near Siler City. The four-lane divided facility will be constructed on all other sections. Improvements include the addition of paved shoulders where required for safety as well as some alterations of the vertical alignment to meet sight distance standards. This project will connect two previously widened and improved sections of US 64. The analysis of alternatives and the environmental impacts are discussed in a State Environmental Assessment and Finding Of No Significant Impact signed, July 17, 1991 and January 17, 1992, respectively. ENVIRONMENTAL IMPACTS Jurisdictional Wetlands. The project will impact 16 wetlands and 30 surface waters. Wetland delineations were conducted by NCDOT biologists using the criteria specified in the 1987 Corps of Engineers Wetland Delineation Manual. Since all the wetlands in the area of impact are small and somewhat degraded due to their location adjacent to the road, they were not field verified by the United States Army Corps of Engineers (USACE). Nor were they classified according to the North Carolina Natural Heritage Program Natural Community Classification (Schafale and Weakley, 1990). 2;''- ..? However, the Division of Water Quality (DWQ) rating system was applied to each wetland site. Each wetland was also classified according to the United States Fish and Wildlife Service wetland classification (Cowardin, 1979) system. Even though each section was designed under a separate contract and are separated in the attached Summary Sheets, they are grouped together in the following tables. Table 1 shows the wetland communities, quality analysis, and acres of impact for each while Table 2 itemizes the surface water impacts. TABLE 1. The forested sites (PFO 1) and most of the scrub shrub sites (PSS 1) supported basically the same vegetation but in different successional stages. Tree species included sweet gum (Liquidambar styraciflua), red maple (Ater rubrum), laural oak (Quercus phellos), and black willow (Salix nigra). The shrub species included all the tree species, ironwood (Carpinus caroliniana), Chinese privet (Ligustrum sinense), black cherry (Prunus serotina), green ash (Fraxinus pennsylvanica), and brookside alder (Alnus serulata). The herbaceous and vine layers contain seedling tree and shrub species, Japanese honeysuckle (Lonicera japonica), soft rush (Juncus effusus), sedges (Carex sp.), microstegium (Microstegium sp.), and poison ivy (Toxicodendron radicans). The herbaceous wetlands (PEM) were found mainly in pastures and farm pond fringes. Soft rush (Juncus effusus), sedges (Carex sp.), woolgrass (Scirpus cyperinus), and microstegium (Microstegium vimineum) are the dominant vegetation in these areas. The "Acres Impacted" column in Tables 1 reflects permanent fill and excavation in wetlands and are further itemized in the summary sheets. The total impacts for the project are 0.987 acre. Please note that the four sites which are being excavated, sites 5, 6, 8 and section C site 2, are considered impacted in their entirety. This eliminates any concerns about draining in the wetlands due to excavation. Method II clearing, which is clearing to the edge of the fill slopes, will be used throughout the project. Jurisdictional Surface Waters: Impacts to jurisdictional surface waters have been separated from jurisdictional wetlands. Table 2 lists the acres of impact and the linear feet of channel loss for each stream determined to be jurisdictional and requiring mitigation. These streams as well as those determined to be jurisdictional but not requiring mitigation are listed on the summary sheets with the permit drawings. The "Acres impacted" column includes permanent fill in surface water and excavation of surface water. The total acreage loss of surface waters is 0.10 acre. The total channel loss for the project is 2751 linear feet. However, 1063 linear feet will be created on site, resulting in a net loss of 1688 linear feet of stream channel. All on-site relocations will attempt to duplicate, and in some cases improve, the functions of'the existing streams. The details of these relocations are depicted in the attached drawings. The following species are listed as threatened or endangered in the respective counties: • Bald eagle (Haliaeetus leucocephalus). Threatened. Chatham. • Cape Fear shiner (Notropis mekistocholas). Endangered. Chatham and Randolph. • Red-cockaded woodpecker (Picoides borealis). Endangered. Chatham. • Harperella (Ptilimnium.nodosum). Endangered. Chatham. • Schweinitz's sunflower (Helianthus schweintzii). Endangered. Randolph. A Biological Conclusion of No Effect has been reached for all species. Cultural Resources. There is one historic site, the Thomas Marley House, that will be impacted by the proposed roadway and right-of-way. However, the impacts will not be an adverse effect, based on the findings of the State Historic Preservation Office (SHPO). There are no known archaeological sites within the proposed project area and SHPO recommended no archaeological investigations be conducted. R 5 Mitigation - Wetlands. There are no wetland sites where the impacts exceed 1/3 of an acre, exceed 200 linear feet, and the total impacts are less than 1 acre. Therefore, no wetland mitigation is proposed for this project. Mitigation - Surface Waters. The project will impact 1688 linear feet of mitigable surface waters. NCDOT proposes to offer stream mitigation from three existing sites in Guilford County, Starmount Park, Sussman's Park, and Starmount Forest Country Club. Resource agencies have reviewed all of these plans and already approved permits that utilized two of the sites, Starmount Park and Starmount Forest Country Club. There is a total of 2434 linear feet of streams available from the three sites that NCDOT will offer as the mitigation for this project. Tables 3-5 reflect a full accounting of each site. Table 3. Linear feet at start: R-2217 Linear feet Remaining: 1000 1000 0 By offering 2434 linear feet of stream mitigation for 1688 linear feet of impacts, NCDOT is able to satisfy the 401 Water Quality Certification requirements. However, 404 permits typically requires 2:1 stream mitigation and this proposal provides slightly less than 1.5:1 (1.44:1). NCDOT believes this is an appropriate amount of mitigation for the following reasons. • Since this is a widening project, NCDOT will be extending existing structures along the water bodies, not creating any new structures. • Many of the streams in the area are somewhat degraded due to being located adjacent to the existing road. It is mostly these degraded sections of streams that are being impacted. 6 Two streams, sites 9 and 18, were determined to be jurisdictional-non mitigable. However, NCDOT will relocate and reforest these sites utilizing the same techniques as described for the jurisdictional-mitigable streams above. This will add an additional 736 (145 feet from site 9 and 591 feet from site 18) linear feet of stream restoration. It is requested that these activities will be permitted under a Section 404 Iof?idual Permit. By copy of this letter, we are also requesting a 401 General Water Quality Certification from the NC Division of Water Quality. TIP R-2217 A, B & C. Attached is the applica tion packet for the subject project. NCDOT proposes to widen the existing two-lane section of US 64 to a five-lane undivided facility and a four- .lane, divided facility with a 46 foot grass median. The total project distance is 11.3 miles, mnninB from NC 22 in Ramseur to the existing five lanes just west of Siler City. The five-lane curb and Sutter facility will be built through file Town of Ramseur and at the eastern end of the project near Siler City. The four-lane divided facility will be constructed on all other sections.. Improvements include the addition of paved shoulders where required for safety as well as some alterations of the vertical alignment to meet sight distance standards. This project will connect two previously widened and improved sections of US 64. Tho analysis of alternatives and the environmental impacts aro discussed in a State Environmental Assessment and Finding Of No Significant Impact signed, July 17, 1991 and January 17, 1992, respectively. ENVIRONMENTAL IMPACTS Jurisdictional Wetlands, CIO project will impact 16 wetlands and 30 surface waters. Wetland delineations were conducted by NCDOT biologists using the criteria specified in the 987 Co s of En ineers Wetland Delineation Manual. Since all the wetlands in the area of impact are small and somewhat degraded due to their location adjacent to the road, they were not field verified by the United States Army Corps of Engineers (USACE). Nor were they classified according to the North Carolina Natural Heritage Program Natural Community Classification (Schafale and Weakley, 1990). Each wetland was also classified according to the Fish and Wildlife Service wetland classification (Cowardiu, 1979) system. The forested sites (PFO1) and most of the scrub shrub sites (PBS I) Supported basically the same g veetation but in different successional stages. Tree species included sweet gum (Liguidan:har st3'racfiua), red maple (Ater ruhrunl), laural ogle (puercus phellos), and black willow (Salix nigra), The shrub species include d all the tree species, ironwood (Carpinus caroliniarral Chinese privet (Ligusrrun: sinense), black cherry (Prunus serorina), green ash (Fraxinus penitsylvanfcz1), and brookside alder (Alnus s'erulata). The herbaceous and vine layers contain seedling tree and shrub species, Japanese honeysuckle (Lonicera japonlea), soft rush (Juncus effusus), sedges (Carex sp.), mierostegium (Alicroste?giu)n sp.), and poison ivy (Toxicodendron radlcalls), The herbaceous wetlands TEND Were found mainly in pastures and farm pond fringes. Soft rush (Juncus effusus), sedges (Carex s and microstegium (,llicrostegiunl vi,nit:Cali:) are the dominant veget ti nlin these areas. The "Acres Impacted" column in Tables I reflects permanent fill and excavation in wetlands and are further itemized in the summ project are 0,987 acre. Please note that the four sf?sswhich are beintglel cavated, sines 5, 6, 8 and section C site 2, are considered impacted in their entirety. This eliminates any concerns about draining in the wetlands due to excavation. Method It clearing, which is clearing to the edge of the fill slopes, will be used throughout the project. Jurisdictional Surface Wat : Impacts to jurisdictional surface waters have been separated from jurisdictional wetlands. Table 2 lists feet ofclzannel loss for each stream determined to be jurisdictional anal r quringlmear mitigation. These streams as well as those determined to be jurisdictional but not requiring mitigation are listed on the summary "Acres Lripacted" column includes permanefisheets with ll in urfacelwa water and exc vgtion of surfaco water. The total acreage loss of surface waters is 0.10 acre. The total channel loss for the project Is 2751 linear feet. However. 1063 linear feet Nv,ill be created on site, resulting in a net loss of 1688 linear feet of stream channel. All on-site relocations will attempt to duplicate, and in some cases improve, the functions of the existing streams. Therefore, no wetland mitigation is proposed for this project. Mitigation -Surface Waters The project will impact 1688 linear feet of mitigable surface waters. NCDOT proposes to offer stream mitigation from three existing sites in Guilford County, Stnrlnount Park, Sussman's Park, and Starmount Forest Country Club. Resource agencies have reviewed all of these plans and already approved permits that utilized two of the sites, Starmount Park and Starmount Forest Country Club. There is a total of 2434 linear feet of streams available from the three sites that NCDOT will offer as the mitigation for this project. Tables 3-5 reflect a frill accounting of each site. NCDOT is able to satisfy the 401 Water Quality Certification requirements. However, 404 permits typically requires 2:1 stream mitigation, and this proposal provides slightly less than I.5:1 (1.44:1). NCDOT believes this the following reasons. is an appropriate amount of mitigation for . • Since this is a Nvidening project. NCDOT will be extending existing structures along the water bodies, not creating any new structures. • Many of the streams in the area are somewhat dcgraded due to being located adjacent to the existing road. It is mostly these degraded sections of streams that are being impacted.
