Dear Mr. Moore:
You have our approval, in accordance with the attached conditions and those listed below, for the
purpose of widening SR 1185 from US 64-70 to NC 9, as you described in your application dated June 3,
1998. After reviewing your application, we have decided that this impact is covered by General Water Quality
Certification Number 3100. This Certification allows you to use General Permit Number 031 when it is issued
by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final an, d
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The Division of Water Quality has reviewed your submittal for a 404/401 permit
to pave and widen SR 1185 from NC 226 to north of SR 1573 in Rutherford County. On
March 20, 1998, Mr. Roger Edwards of DENR wrote to you requesting information on
the channel change proposed. This information is needed by DWQ in order for us to
decide whether this modification is practicable.
I can be reached at 733-1786 if you have any question. Until this information is
received, I will request (by copy of this letter) that the Corps of Engineers place this
project on hold. Also, the project will be placed on hold for our processing due to
incomplete information (15A NCAC 2H.0507(a)(4)).

Dear Mr. Moore:
I received your drawing for the channel change for Island
Creek Road. This proposed channel change is not congruent with the
guidelines for stream restoration and relocation. The channel
change should mirror the present stream conditions. The meanders
should be duplicated and the total length of stream change should
not be reduced. The frequency of pools and riffles should occur in
the channel change as they did in the original stream. Natural
vegetation is to be planted on the banks of the new stream channel
for stabilization and thermal pollution control. The channel
change should be completed and stabilized before the water is
introduced to the new channel.
Please submit drawings and/or narrative that demonstrates the
channel change will conform to the items addressed in the above

to extend/replace four (4) culverts in unnamed tributaries to Island Creek and a channel
change in conjunction with the upgrading'crf--Sp, 1185 Island Creek Road in Rutherford

proposed channel cha _fr nv?. vy station 17+20 to survey station 18+20 and from
survey station 18+65 to survey station 19+70 as shown on the attached sketch.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Moore:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in acres of wetlands or waters for the purpose of improving SR 1185, as you described in your
application dated 26 March 1997. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Number 3100. This certification allows you to use General Permit
Number 031 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. For the proposed channel change from 17 + 50 to 20 + 50, the width, grade and sinuocity must be the
same in the new channel as in the old channel. The channel slopes shall be stabilized with native woody
vegetation. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
