Lincoln County terminated operations at this facility on October 4, 2012 and all incoming wastewaters were diverted to the Killian Creek WWTP (NPDES Permit NC0088722) by utilization of the site pump station already in place. Lincoln County has now completed the closure activities associated with the Middle Forney Creek WWTP with this site now utilized as a pump station and the existing site building utilized by our utility maintenance department. All equipment and facilities formerly utilized for wastewater treatment have been removed and structures demolished. Thank you for your assistance on this matter. I think this would first require approval from DWQ, then we would need to inactivate the monitoring/reporting requirements in BIMS. 2. Item 4- If Lincoln County/Forney Creek WWTP is permanently closed... "DENR does not have formal closure requirements"... There is no mention in summary of request for permit rescission, crushing outfall pipe, etc. Region would need to go out and verify final closure. BobS- fyi.. if any of this happens, it would likely fall into Expedited Unit as compliance feature. Parker (Environmental Engineer II) Mr. Wes Bell (Environmental Specialist) Mr. Tom Belnick (Supervisor NPDES Permitting) — Via Telephone Lincoln County Mr. Barry McKinnon, P.E. W.K. Dickson & Co. Inc. Mr. Bob Froneberger, P.E. The purpose of this meeting was to discuss regulatory issues associated with the future of the Middle Forney Creek WWTP. The meeting generally followed the attached proposed meeting agenda with the following discussion items noted: Froneberger provided a general overview of the ongoing evaluation being performed by WK Dickson to provide recommendations regarding the future operation, temporary closure or permanent closure the Middle Forney Creek WWTP. Lincoln County's initial estimates indicate a potential savings of approximately $400,000 per year could be realized by the transfer of wastewater to the recently opened Killian Creek WWTP with the infrastructure currently in place. The Middle Forney Creek WWTP is currently permitted for an average daily flow of 0.975 mgd and the Killian Creek WWTP is permitted for an average daily flow of 1.68 mgd with a Phase II permitted flow of 3.35 mgd. The two plants are currently treating a combined total flow of approximately 0.8 mgd. Flow projections completed within the recent engineering planning document for Killian Creek projected potential regional wastewater treatment demands of approximately 4.0 mgd by 2025.,The recent downturn in the area development has likely impacted this projection pushing back the 4.0 mgd wastewater demands. 2. DENR provided the following general comments related regulatory considerations potentially impacting the future operation of the Forney Creek WWTP: Forney Creek is currently listed in the NC 2010 Integrated Report Categories 4 and 5 impaired Waters as "Ecological/biological Integrity Fish Community' impaired. This is not necessarily directly related to the Middle Forney Creek WWTP and could be associated with non -point sources. DENR did not feel this would alter the next NPDES Permit renewal unless specifically identified to be attributed to the plant discharge. b. Recent TMDL modeling of Lake Wylie (Catawba River) has identified nutrient concerns resulting in the adoption of nutrient limits for area dischargers. Plants permitted for flows > 0.5 mgd and < 1.0 mgd are expected to have an effluent total phosphorus limit of 1.0 mg/I as the NPDES permits renew. Plants with flow > 1.0 mgd are expected to have an effluent total phosphorus limit of 1.0 mg/I and total nitrogen of 6.0 mg/I as the permit renews. The NPDES permits for the Middle Forney and Killian Creek WWTP's were renewed in 2010 and were not impacted by these new limits but the limits will likely be included on the 2015 permit renewal. The potential for reopening the present permits is not likely. C. Tonicity is not an issue with the Middle Forney Creek WWTP as it has a capacity less than 1 mgd, is 100% domestic wastewater and is not required to have a pretreatment program since there are no categorical dischargers in the system. 3. With regard to the temoorary closure of the Middle Forney Creek WWTP, DENR indicated that this should not be an issue as long as the permit renewal fee was paid. Holding a permit open with no flow is more of an issue for plants that have not been built. Monthly DMR's are not re uired as Ion as the flow is zero. The temporary conversion o e existing s u ge o ing tank into an equalization tank may present some permitting issues as the tank would still be considered to be part of the permitted treatment system. 4. Comments related to the permanent closure of the Middle Forney Creek WWTP ort were as follows: t i �" I r�� l a. DENR does not have formal closure requirements. This is typically more related to the health department should a public nuisance condition or safety concern be encountered. b. Addition or conversion of existing structures into an equalization system at the site with the plant closure will be permitted under the collection system regulations and will require an Authorization to Construct (ATC) Permit. 5. Comments regarding the Killian Creek WWTP were as follows: a. Increasing capacity from the 1.68 mgd to 3.35 mgd will require an ATC permit as there will be modifications to the plant. Since this is already on the NPDES Permit, the permit would not require reopening. b. A future increase from 3.35 mgd to 6.7 mgd will require the full State Environmental Policy Act (SEPA) permitting including alternative analysis, environmental related evaluations and signoffs by the various agencies. C. Speculative limits should be requested as the plant approaches 70% of design capacity. d. Removal of the Middle Forney Creek WWTP would definitely have benefits to the stream but it is unlikely the nutrient limits would be impacted. e. DENR generally favors and encourages regionalization so the closure of the Middle Forney Creek WWTP would likely be viewed favorably by DENR. f. Since the Killian Creek WWTP already has "secondary limits" for BOD5 and TSS (i.e. 30 mg/L monthly and 45 mg/L weekly), these limitations would not change with closure of the Middle Forney Creek WWTP. They could, however, change with the increased permitted capacity.
