RE: BADIN BUSINESS PARK LLC (BBP) — NOTIFICATION OF UPSET PERMIT# NCO004308
To Whom it May Concern;
This submittal Is to satisfy the five (5) day written notification requirement in our NPDES Permit
(Part II Section E.6.) associated with Part 11. C. 5. Upsets. On 2018 April 4th, while initiating a
Mixing Zone Analysis Study, BBP discovered that the diffuser pipe in Badin Lake associated with
Outfall 012 had been damaged and was no longer functioning. In assessing the damage, BBP
determined the pipe may have been severed from a boat anchor or similar; the damage was
beyond the reasonable control of BBP. It Is unknown when the pipe was damaged and as such
it is unclear if any discharges In excess of permit criteria occurred.
On that same day, BBP shutdown the pump such that Outfall 012 cannot discharge at this time,
and BBP has initiated efforts to replace the diffuser pipe and restart the Outfail 012 system.
Sampling will continue at Outfall 011, overflow associated with the diffuser, in compliance with
the permit.
Randall Kiser of my staff verbally reported on April 4th the information to the Mooresville
Regional Office of the Department, specifically Mr. Andrew Pitner. .
