Dear Mr. Vick:
You have our approval, in accordance with the attached conditions to fill in 0.23 acres of waters for the
purpose of road widening as you described in your application dated November 19, 1997. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification Number
3103. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of
Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CA`IA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

SR 1541 (Wendover Avenue) to north of SR 1560 (Sapp Road); Federal
Aid Project No. STPNHF-NHF-124-1(1); State Project No. 8.U492101;

The North Carolina Department of Transportation (DOT) proposes to relocate a
section of SR 1546 (Guilford College Road) from south of SR 1541 (Wendover Avenue)
to north of SR 1560 (Sapp Road). This new section of Guilford College Road will be a
five-lane curb and gutter facility. Wendover Road will also be widened to a six-lane curb
and gutter facility with a raised median. Construction plans also include a grade
separation and interchange at relocated Guilford College Road and Wendover Avenue.
Ramps will be utilized to connect the two roads. The length of the project is
approximately 1.2 miles. The project is scheduled to be let to construction in August
1998.
The relocation of Guilford College Road is a part of the future construction of the
Greensboro Western Urban Loop project. The relocation of Guilford College Road is
necessary to provide adequate area for the construction of the interchange at Wendover
Avenue and the Greensboro Western Urban Loop (TIP No. U-2524). Guilford College
Road is programmed for widening to five lanes both north and south of the project
(TIP No. U-2913). Therefore, the relocated section will be constructed to five lanes in
width. Wendover Avenue is six lanes with a raised median at the existing Guilford
College Road intersection. This cross section will be continued southward through the
project area.

Construction of an interchange at relocated Guilford College Road and Wendover
Avenue will eliminate the congested, signalized, at-grade intersection that now exists.
The interchange will also increase the traffic capacity of both Guilford College Road and
Wendover Avenue. The elimination of left turn lanes on Wendover Avenue and the
control of access in the vicinity of the interchange will improve safety in the area. Turns
onto Guilford College Road at the ramp termini will be controlled by traffic signals.
The proposed work cannot be completed without impacts to waters of the United
States. Project construction necessitates draining a pond and placing a pipe to convey an
unnamed tributary to Bull Run Creek. The fill in surface waters from pipe placement and
road construction totals 0.23 acre of impact. The remaining portion of the pond will be
used as a Type "A" silt basin. After construction, the DOT plans to reseed the location of
the Type "A" silt basin (see plan sheet).
A review of federally-protected species and water resources for the project area
has been completed. A biological conclusion of "No Effect" has been rendered in this
report for the bald eagle (Haliaeetus leucocephalus). A copy of this report has been
enclosed with this permit application.
The DOT is requesting that the proposed work be authorized by the Corps of
Engineers under a Section 404 Nationwide Permit 14. Enclosed with this cover letter is a
project site map, as well as a completed preconstruction notification form for a Section
404 Nationwide Permit 14 and 401 Water Quality Certification. Application for 401
Water Quality Certification by the Division of Water Quality is also made.

SUBJECT: Protected species and water resources review for the
relocation of Guilford College Road between Sapp Road
and Ruffin Road, Guilford Countv. TIP No. U-2524AA,
State project No. 6.49900 IT.

Protected Species
This U.S. Fish and Wildlife Service (FWS) lists one federally protected species, the
bald eagle (Haliaeenus leucocephalus), for Guilford County. This memorandum addresses
concerns associated with construction of the proposed project and its relationship to the
bald eagle, as well as water resource classifications for water bodies associated with this
project. A brief description of the bald eagle and a biological conclusion is included
below.

Date Listed: 3/11/67
Adult bald eagles can be identified by their large white head and short
white tail. The body plumage is dark-brown to chocolate-brown in color. In flight
bald eagles can be identified by their flat wing soar.
Eagle nests are found in close proximity to water (within a half mile) with a
clear flight path to the water, in the largest living tree in an area, and having an
open view of the surrounding land. Human disturbance can cause an eagle to

abandon otherwise suitable habitat. The breeding season for the bald eagle begins
in December or January. Fish are the major food source for bald eagles. Other
sources include coots, herons, and wounded ducks. Food may be live or carrion.
BIOLOGICAL CONCLUSION: NO EFFECT
This project crosses a small pond which drains to Bull Run Creek (DWQ Index
No. 17-5) by way of an unnamed tributary. Bald eagles require large, open areas of water
for foraging. The width of Bull Run Creek and the small size of the pond, less than 0.4 ha
(1.0 ac), would leave the eagle with a narrow field of vision over open water in which to
forage. Therefore, the water resources associated with this project are not large or open
enough to support bald eagles.
In addition, the North Carolina Natural Heritage Program database of rare species
and unique habitats contained no records of any protected species in the project area.
Thus, construction of the project will have NO EFFECT on the bald eagle.
Water Resources
-,`Water resources associated with this project are minimal. A small pond which
drains to Bull Run Creek (DWQ Index No. 17-5) by way of an unnamed tributary, will be
crossed by the project. Bull Run Creek has a best usage classification of C. Class C refers
to waters suitable for aquatic life propagation and survival, fishing, wildlife, secondary
recreation and agriculture. All unndmed tributaries carry the same best usage classification
as the named body of water to which they drain.
