Existing conditions onsite consist of primarily wooded land. There is one (1) wetland feature on the property (W1) that runs along the eastern side of the property. Ramsey Street
bounds the property to the East and Bullard Circle bounds the property to the North. The general land use in the vicinity of the project is predominately forested land and residential
development.

The purpose of this project is to construct a commercial development and necessary infrastructure.

The overall project consists of the construction of a commercial development, including but not limited to a driveway access, parking, commercial structures, and a stormwater control
measure (SCM) device. Specifically, there are two (2) wetland impacts associated with driveway access and lot fill (parking) and one (1) SCM feature that impacts wetlands. Equipment
to be used will include excavators, bull dozers, and other typical equipment used for land clearing, grading, and excavating.

la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
S&EC completed a wetland delineation for the entire property in order to identify natural resources so that impacts could be avoided & minimized to
the mapmum extent practicable. Impact area A is a proposed driveway/access road and lot fill (parking) with proposed permanent wetland impacts.
These impacts are necessary to serve as 1) an access to Bullard Circle. Access from Ramsey Street (US HWY 401) is not allowed by NCDOT. NCDOT
2003 Policy on Street and Driveway Access, Chapter 7, Section B, states "the NCDOT may also prohibit or restrict access to a State Highway Stem
roadway if alternate access is available through other adjacent public facilities." 2) the lot fill activities for parking are necessary because the
Fayetteville Unified Development Ordinance (FUDO) 30-5-1.3.a.1 states that is it desirable for a building to face the street right-of-way without a
parking lot in between the building and the road. However, due to the specific needs of the business requiring patient drop-off, circular traffic is
required. Thus, a vegetative buffer following the requirements of 30-5.B.4.c.5 is required. Additionally, the FUDO requires parking and pedestrian
connectivity when possible. As a result, the parking lots are joined. And the FUDO 30-5-A.4.b requires minimum parking to be at 1 space per every
250 SF of building. Thus, with a proposed building of 6100 SF, the minimum number of parking spaces required would be 25. The current number of
planned parking spaces is 35. The parking lot and circular traffic pattern are designed to minimize impacts of the wetlands located on the property.
And finally, 30-3.E.5 details the mapmum impervious area for the project as 65 % and allowable setbacks of 25 feet for the front, 15 feet for the sides,
and 20 feet for the rear of the building. Less than 50 % of the site is proposed to be impervious. Retaining walls are proposed at both the access road
and the parking lot areas to minimize wetland impacts. Impact area B is proposed permanent wetland impacts for a Stormwater Control Measure (SCM)
pond. This impact is necessary for stormwater collection on the property to minimize flooding and treat stormwater. This impact has been minimized by
proposing a shared SCM and located out of the jurisdictional wetlands to the mapmum extent practicable to still server both lots. Impact area C is
proposed temporary wetland impacts for construction activities of retaining walls. All temporary impacts will be returned to pre -construction contours
and allowed to re -vegetate with an adjacent wetland seed source.

Typical Erosion & Sediment Control measures such as silt fencing, diversion ditched, temporary sediment control measures required by the Town of
Fayetteville will be utilized to avoid/minimize loss of sediment during construction activities.

Private mitigation banks were contacted, there were no private mitigation banks that had riparian wetland credits available within the 03030004 HUC.
Therefore the NCDMS was utilized. Permanent Wetland loss impact = 0.144 acres; 0.288 @ 2:1 mitigation ratio = 0.29 acres

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The Ramsey Street & Bullard Circle project is a small commercial development. Additionally, the project is located within
the City of Fayetteville jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect
downstream waters: 1) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm
Sewer Systems (MS4s) in addition to post -construction stormwater management requirements, and 2) the Water Supply, Watershed Protection
Program which limits development densities as well as requires protective riparian buffers. We anticipate that the DWR will advise us if any additional
information is needed.

Project: Ramsey Street and Bullard Circle County: Cumberland
The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.
