Paving over the ewsting gravel surfaces provides a safer surface needed for the public using the e)asting facility and also stabilizes the drive and small boat parking area behind the marina building which has helped prevent further erosion of the site, rutting, creep, subsidence caused during heavy rains and river/lake flooding. 2. Comments: Variance is requested without mitigation or new BMPs. E)asting commercial development of the marina predates the riparian buffer rules. Surfaces in Zone 1 and Zone 2 where asphalt pavement is placed was hard packed imperious gravel surface prior to asphalt pavement being placed on top of the existing surfaces. Drives and parking areas in question were hard packed impervious gravel surfaces and were used for same purpose prior to enactment of buffer rules. Buffer protection is provided by existing pervious grass and gravel surfaces placed between impervious surfaces and the lake wall. This grass and gravel buffer will be maintained as a pervious surface for infiltration and act to diffuse stormwater runoff. G. Stormwater 1. Provide a description of how diffuse flow will be maintained through the protected riparian buffers (e.g., re- planting vegetation or enhancement of existing vegetation, gutter splash pads, level spreader to control of runoff from impervious surfaces, etc.).* Conditions are existing — new BMP's are not proposed. Grass surfaces exist in Zone 1 area of buffer that diffuse flow prior to stormwater runoff leaving the site. These grass areas will be maintained as pervious, noncompacted areas. 2. Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environrrental Ivbnagerrent Conrrission to grant a variance when there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection. 1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit from the property shall not be considered adequate justification for a variance. The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible.* The property has not changed its use since the owner purchased the property prior to the buffer rules. The condition of the buffer zones has remained the same on the property area in question since the owner has purchased the property and operated it as a commercial marina. The area in question has always been used as a drive and parking area between the marina boat docks and marina building. 2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc).* A big issue for Long Island Marina has been the lake flooding with silt and mud being deposited during the flooding events on the gravel drives and access areas adjacent to the marina building and lake. The drive and access area between the marina and lake have been gravel/grass since the property was purchased until hard packed gravel areas were paved a few years ago. Two customers have slipped and fallen from the mud deposited from flooding events before the last pavement improvements. For concerns for public safety and stabilization the drive and parking area was paved. This is a much better surface for use of the marina, safety concerns and also stabilization. The drive, parking and walking areas adjacent to the marina building can now be cleaned up quicker after flooding events and less sediment runoff is occurring as a result of erosion from rain events. 3. Explain whether the hardship was caused bythe applicant knowingly or unknowingly violating the applicable Buffer Rule.* Long Island Marina placed asphalt pavement not knowing they violated the buffer rules. The owner has always tried to do things to standards and specifications and to do things to benefit the environment. In this particular area the stormwater has always runoff the site during hard rains, not into the ground because it was so hard packed. By installing the pavement, the applicant didn't feel it was changing anything or hurting anything by doing this but making much needed improvement for stabilization and safety. 4. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different form that of neighboring property. * Long Island Marina is operated and used today as it was when it was purchased prior to the buffer rules being established. It was not designed or built in accordance with requirements of the buffer rules - zone 1 and zone 2 of the buffer were already disturbed and developed for marina use. 5. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread.* The hardship is unique to the marina property versus other adjacent properties. The marina and use of the area in question predates the enactment of the buffer rules. There has been on going use of the property area since enactment of the buffer rules. The marina provides a needed service for the lake community and improvements are needed to keep up standards of operation. In the case for paving the existing gravel the reason for making the improvement was for stabilization and safety. In comparison to a neighboring property, the wildlife access boat ramp and parking area '/4 mile upstream from Long Island Marina does not have protected buffer zones. The paved parking lot, loading areas and ramps are graded for the most part to shed or direct much of the stormwater runoff right into the lake without any diffusion of runoff. This boat access was constructed right around the same time or after the buffer rules were enacted. Long Island Marina has much less impervious surfaces in the area behind the marina building and provides a grassed area between the pavement and lake to diffuse runoff. I.
