I apologize that it took me a couple of days to respond as I was out of the office Friday and most of
yesterday. Responses to your questions are below.
Dan River: I understand you met with Joyce on this topic yesterday and she is to provide you some updated information
by the end of the week to support your staffs activity. I would say that Dan River is needed by 9/1 as all work is
currently scheduled to be completed by 10/1.
Marshall: is needed to be effective in January, 2021 to support the work to keep water off the basin in the next phase of
closure. That initial work to divert those flows will be ongoing through the rest of 2020.
Belews creek: The stormwater permit mod is the only outstanding item preventing this work but this is less critical than
Asheville and Marshall for us at this point. We'd like to finalize this minor mod no later than early 4t" quarter. This one
is an easier mod administratively than the others as we understand it so I think we discussed that should be achievable.
You didn't ask about Asheville but just confirming that January, 2021 is a needed effective date to support the landfill
startup work that allows for final closure of the basins to support the required dates in the Mountain Energy Act.
Thanks and I apologize again that it took me a couple of days to respond. If technical questions come up on any of the

As requested earlier today. As indicated below, please reach out to Robert Wylie with specific questions on this
request for Marshall.
I didn't get the impression that a renewal was off the table but if you have another, simpler way to accommodate
this request we would be open to discussing. As noted this is an important action related to closure since it
directs 200 acres away from the ash basin and keeps that water out of contact with the ash.

Annette,
It was nice talking to you today. Attached is the application update for Marshall that was signed yesterday along with
the original submittal of the renewal request. Questions about yesterday's submittal can be directed to Robert Wylie.
At Marshall this action is intended to redirect some existing upland flow (mostly wooded/vegetated with light industrial
activity) away from the ash basin drainage to facilitate closure activities. The flow that will be redirected is currently
permitted under NPDES as part of the NPDES permit NC0004897 so it seems as if a minor modification could be an
option to issuance. With that action, the renewal could sit until the Department is ready to issue from our perspective.
I also spoke with Robert Wylie about Asheville. We have contracts in place with a third party to complete the renewal
application and submittal in October of this year. Given the amount of items needed to be completed, there does not
seem to be a clear path to expediting that to complete in the next two weeks. We can discuss that one when I give you
a call tomorrow but I wanted to give you a heads up on that. It seems that acting on the amendment request from
January of this year is preferable and then, as with Marshall, you could hold the renewal until the time the agency is
ready to issue the renewals.
I think the approach listed below is viable to work through these 4 sites and will plan on suggesting same to the
Department management next week if you don't object.
Dan River— Minor mod to redirect flows as planned.
Asheville — Act on renewal request submitted in January, 2020 to have amendment in place January 1, 2021. Duke will
submit renewal in timeframes required by the permit but the Department can choose hold renewal until Department is
ready to issue without concern from us.
Marshall - Minor mod to relocate NPDES permitted flows from current discharge point in permit NC0004897 to new
location under NCS000548. These are existing NPDES flows and existing activities: just redirection.
Belews Creek — Same concept as with Marshall above. Flows to be re -directed currently exist but are released at a
different point.
I will give you a quick call tomorrow as discussed so let me know if there are concerns with this approach.
