This letter is in response to the NC Division of Water Resources Notice of
Violation (NOV-2020-0247) issued on May 22, 2020. The NOV was issued due to the
unauthorized release of fill into wetlands as a result of the lack of the appropriate Erosion
and Sediment Control (E&SC) BMP's on the R-2582A in Northampton County.
NCDOT and the contractor (Thalle) regret this incident and initiated corrective
action immediately. We have met with the contractor and NCDOT personnel involved
with the project. Paul DiMeo, the Senior Project Manager with Thalle Construction,
submitted a letter (ID# 19-341-10 dated June 9,2020) to NCDWR that provides a detailed
explanation of the corrective actions taken and of efforts to ensure future compliance.
NCDOT agrees these corrective actions have taken place, and we have reiterated with
NCDOT personnel the importance of inspections and compliance with the permits on the
project.
Please know that we take these actions very seriously and every effort will be
made to ensure that such deficiencies do not occur again.
