A site visit has been made with staff from NCDOT Div. 3, USACE, and DWQ. Several issues were identified that need resolution in order for us to make an informed permit decision. These issues are: • Please address the location of the temporary impacts identified on Page 5, impacts summary item 2h. These are minimal impacts but information on the location(s) should prevent future questions about unauthorized fill. • Please provide justification for the requested fill along the private driveway on the north side of the project. This is between sites 4 and 6. • Please explain the need for wetland excavation at sites 1, 2, and 4. The narrative does not provide details about removal of the old roadbed. Is this excavation necessary to match adjacent elevations? Also, the impacts table on Page 5 of the PCN mentions fill only, not excavation at site 2. • The impacts table on page 5 indicates roadway fill and excavation for site 1. Please provide a detail of the location of the excavation, if it exists. It could not be found on the drawings. • Ms. Kim Garvey of the USACE has e-mailed several comments and questions regarding this project to Ms. Veronica Barnes. February I, 2010 Page 2 Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
