Dunn, Coastal Coordinator Habitat Conservation Division DATE: July 20, 2020 SUBJECT: CAMA Dredge/Fill Permit Application for Richard Fertig, Dare County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located within the Wind Over Waves subdivision at 26212 Otter Way along the Pamlico Sound in Salvo, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A- 100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq). The applicant proposes to construct a single-family residence with pool, parking area, wooden bridge, two piers, and shoreline protection that consists of riprap, a retaining wall, and wooded wetland fill. To access the upland area of the lot, a 12' by 70' vehicular bridge and approximately 1,325 fe of wetland fill is proposed. Shoreline stabilization of the 2,508' of shoreline is proposed to be done with 1,235' of riprap with an 8' base against the coastal wetland interface and an 85' breakwater 30' waterward the shore in one area. Within Midgett Cove, a 6' by 50' pier with a 6' by 50' L-head dock and two slips will be constructed. The water depth within the slips is approximately -3' NWL. A 6' by 305' walkway will also traverse the coastal wetlands on the west side of the peninsula and extend 100' into the sound and terminate with a 20' by 20' covered platform. The Pamlico Sound in this location is classified SA HQW by the Environmental Management Commission and is open to shellfish harvesting. The NCWRC has reviewed the permit application and has several concerns regarding the project development. Staff are familiar with the wetlands in the area and how they have a dominant presence within the Wind Over Waves subdivision. We are concerned the proposed development may have impacts to wetland and nearshore habitats not presented within the application. Therefore, we request the following be addressed: Mailing Address: Habitat Conservation • 1721 Mail Service Center • Raleigh, NC 27699-1721 Telephone: (919) 707-0220 • Fax: (919) 707-0028 • The height of the riprap revetment against the coastal wetland shoreline should be no greater than 6" above the wetland substrate to allow hydrologic connectivity to the wetlands_ Adherence to this design would likely reduce the base width of the riprap, further minimizing the area of shallow water habitat fill. Base width of the riprap and breakwater should be appropriate to obtain necessary slope and should not unnecessarily fill important habitat areas. • The application does not indicate how water or wastewater will be handled on the property. information detailing water and sewer connectivity or septic field location should be provided_ Details should include infrastructure location and any impacts to wetlands. • Wetland lines in this area adjacent the Pamlico Sound are dynamic and may demonstrate coastal or Section 404 characteristics seasonally. Careful consideration should be given regarding wetland types and project design to adequately address stormwater treatment and overall wetland fill.
