Box 25201, Raleigh, NC 27611-5202 PHONE: 919-733-2520 David McCoy SECRETARY April 25, 2000 PROJECT: COE ACTION ID: COUNTY: DESCRIPTION: SUBJECT Steve Lund 8.2720501 (B-3273) 199702450 and 199930923 Avery Replace Bridge No. 68 over North Toe River on Watauga Street in Newland Project Completion and Compliance Asheville Regulatory Field Office 151 Patton Avenue, Room 143 Asheville, NC 28801-5006 Dear Mr. Lund: On April 7, 1997 NC DOT was issued a Nationwide Permit No. 23 (199702450) for the replacement of Bridge #68 over the North Toe River on Watauga Street in Newland. The bridge and approaches have been constructed as shown in the original permitted plans and according to the original comments from the NC Wildlife Resources Commission comments dated March 5, 1997. Earlier last year it was determined that a waterline for the Town of Newland would need to be relocated adjacent to the downstream side of the bridge. A Nationwide Permit No. 12 (199930923) was issued on June 21, 1999 for the subaqeous waterline relocation. As we near completion of the B-3273 project we reviewed the conditions of the regulatory permits to ensure compliance and we found a problem relative to the NC Wildlife Resources Commission comments of June 5, 1999 for the Nationwide Permit No. 12. Condition number 2 states that riprap should be used only on the lower portions of the stream banks up to "18 inches above the ordinary flow water stage". The remainder of the slope should be stabilized using native plant materials. Because of the high energy and potential erosive velocities of the river at the bridge location riprap was used to stabilize the banks in the project area. This riprap was placed high up on the banks prior to the issuance of the Nationwide Permit No. 12 and according to the original approved plans. NC DOT believes that it would be inappropriate at this time to further disturb the banks to remove the riprap to meet the new conditions imposed by the Wildlife Resources Commission. NC DOT, therefore, requests that the project be allowed to remain as is. If additional information is needed, please feel free to contact me at 336-667-9111.
