Dear Mr. Williams:
This responds to your letter of December 15, 2009, requesting that the U. S. Fish and
Wildlife Service (Service) sign the Mitigation Banking Instrument (MBI) for the subject
mitigation bank. The Service has reviewed the revised Mitigation Plan of August 2009
and determined that the subject bank would provide acceptable compensatory mitigation.
However, we recommend that you address the three issues raised by the North Carolina
Wildlife Resources Commission sent to you be e-mail on January 11, 2010, along with
their signed. approval sheet. I have signed and enclosed a copy of the approval sheet for
