We have received correspondence from Corps on the Concord Motor Speedway Project (DWR 20-0822) and
they have stated no permit is required. Please see Mr. Bryan Roden -Reynolds email bellow. Is there any
additional information you need from us regarding this project?

Based on the new Navigable Waters Protection Rule, an ephemeral channel is not considered
jurisdictional. Therefore, no Section 404 Permit is required. However, if your project changes then
further action may be required prior to starting construction.
PLEASE NOTE:
-This Department of Army determination does not relieve the permittee of the responsibility to obtain
any other Federal, state, or local approvals/permits. The permittee may need to contact appropriate
state and local agencies before beginning construction.

Good morning Bryan — hope you are well,
We submitted the PCN for this project, but you will find in your review that the impacts have been
limited to ephemeral features identified during our field reconnaissance. I am wondering if, given the
recent WOTUS definition developments, there is a need for you to review/issue the PCN?, or if another
type of correspondence is needed/warranted.
The associate in our office assigned to this project is out of pocket for a period and I wanted to touch
