Therefore, no Section 404 Permit is required. However, if your project changes then further action may be required prior to starting construction. PLEASE NOTE: -This Department of Army determination does not relieve the permittee of the responsibility to obtain any other Federal, state, or local approvals/permits. The permittee may need to contact appropriate state and local agencies before beginning construction. I am wondering if, given the recent WOTUS definition developments, there is a need for you to review/issue the PCN?, or if another type of correspondence is needed/warranted. The associate in our office assigned to this project is out of pocket for a period and I wanted to touch base as early in the process as possible.
