Dear Mr. Atkins:
You have our approval, in accordance with the attached conditions, to place fill material in 0.05 acres of
wetlands or waters for the purpose of improving SR 1600, as you described in your application dated 2 May
1997. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3127. This Certification allows you to use Nationwide Permit Number 3 when it is.
issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Jolly:
The North Carolina Department of Transportation, District I Maintenance plans
to grade this road primarily along the existing alignment in the 1997 - 1998
Fiscal Year. We will be replacing/extending existing pipes which involve live
streams at Station 10+65, 71+15, 92+30, 95+40, and 98+30. We will also be
extending or replacing various other pipe culverts throughout the project which
do not involve live streams. We will be tying to existing bridges at Station
25+50, 58+50 and 63+10. We will be encroaching upon the 25' trout stream
buffer as follows: 1) Rt of Station 13+00 to 17+00+-. We will install gabion
baskets filled with Class B Stone in this area where any work exceeds the
existing slopes to avoid relocating the stream. We will also shift away from the
stream as much as possible; however, this will be limited since we must tie to
existing pavement in this area and a house is located left of the project. 2) Rt of
Station 22+50 to 25+47+- where we will be tying to an existing bridge. We will
install gabion baskets in this area to lessen the impact to the stream. 3) Lt of
Station 25+47 to Station 32+30. We will be tying to the other end of this existing
bridge and therefore cannot shift away from the stream. We will install gabion
baskets in this area where necessary to lessen the impact to the stream and to
avoid a channel change. Also, we narrow the shoulder as necessary to avoid

working in the stream. 4) Lt of Station 63+00 to Station 65+00. We will be tying
to an existing bridge at this location. We will install gabion baskets as
necessary. This work is to improve the typical section and the safety of the road.
We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency.
I am sending a straight line sketch with the proposed erosion control, stream,
and cross sections of the affected areas. In addition, I am sending a typical
section of the road, general notes on erosion control and a marked map.
By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region
Coordinator of the North Carolina Wildlife Resources Commission to comment
directly to you concerning the 404 Nationwide Permit request.
A request will be made on this project for a Temporary Encroachment in the
Trout Water Buffer Zone of tributaries to an unnamed DEHNR Trout Stream
and I am asking Ms. Goudreau to comment directly to me concerning the Trout
Water Buffer Zone Encroachment.
Also, by copy of this letter, I am requesting authorization to proceed under
Section 401 of the Clean Water Act from the Division of Environmental
Management.
We would plan to begin construction in fall of `97. If further information is
required, please let me know. Your early review and consideration of this
request will be greatly appreciated.

Attached for your further handling are the marked county maps, pole data sheets,
and plan sheets for the proposed improvements.
The right of way is staked 50' wide, 25' on each side of the centerline. The right of
way ties to existing 50' right of way at Sta. 10+00. There is a 100' x 100' sight
distance at the intersection of SR 1600 and NC 89.
Your efforts in obtaining this right of way should be charged to W.O. 6.742510.
This project is to be constructed during the 1997-1998 program.
Your further handling and notifying of this office will be greatly appreciated.

Silt Basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless otherwise noted
on the plans.
Generally, the order of installation of the erosion control
measures will be as follows:
Temporary silt basins shall be installed before
clearing and grubbing begins.
Silt fences and temporary silt ditches shall be
installed after clearing and before grading.
Temporary stone ditch checks shall be installed as
soon as ditchline is established.
Pipe outlet and inlet protection will be done as
soon as the pipe is installed.
Seeding and other permanent erosion control
measures are to be implemented as soon as practical.
