Box 25201 Raleigh, NC 27611-5201 Dear Mr. Vick: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.05 acres of wetlands or waters for the purpose of constructing a temporary causeway for replacing Bridge No. 54 on SR 2007, as you described in your application dated 18 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3114. This certification allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (T 15A:04B .0024). DOT shall follow guidance provided by DWQ in our 27 May 1997 letter for minimizing damage to aquatic resources until a final policy is developed in conjunction with DOT. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. TEMPORARY CAUSEWAY FOR REPLACEMENT OF BRIDGE NO. 54 OVER CULLASAJA RIVER ON SR 2007, MACON COUNTY. TIP B-2845. On 24 December 1996, the North Carolina Department of Transportation received the Nationwide Permit No. 23 (Action ID. 199702183) and the Nationwide Permit No. 6 (Action ID. 199702221) for the referenced project. It was subsequently determined that a temporary causeway will be required for removal and installation of bridge piers. Construction of the causeway will require a total of 0.02 acres of temporary fill in surface waters. No wetlands will be impacted. The fill material will consist of Class II rip rap and Class B rip rap from a quarry determined by the contractor and together will total approximately 955 y3. Prior to construction, reference elevations will be taken in both temporary fill areas before the causeway is built. Following construction, all temporary fill will be removed. The area will then be restored to its original contour and rough surface texture based on the reference elevations. The area is expected to recover naturally, since the topsoil and seed source will not be removed. No additional planting is proposed. The causeways will be in place for approximately 4 months during the late summer and fall. Construction of this causeway is detailed in the attached drawings. It is anticipated that the above mentioned activities will be authorized under Section 404 Nationwide Permit 33 (Temporary Construction Access and Dewatering). We are, therefore, requesting the issuance of a nationwide permit authorizing construction M-4 2 of the causeway. By copy of this letter, it is also requested that the General Water Quality Certification # 3114 be issued by the North Carolina Division of Water Quality. A copy of this application is also being provided to the N. C. Wildlife Resources Commission for their review. The construction of this project was authorized under Nationwide Permit No. (NWP) 23, Action ID. 199702183, NWP 6 199702221, and NWP 33 199707212, dated December 24, 1996, December 24, 1996, and August 21, 1997, respectively. While the activities covered under the NWP 6 have been completed and the ones covered by the NWP 33 are authorized until August 21, 1999, those covered by the NWP 23 have expired. This project is due to be let in October 1998. Therefore, NCDOT needs to reauthorize the NWP 23 permit. Enclosed you will find a copy of the original project permit. The design for the project has not changed so the wetland and stream impacts will remain the same as previously authorized. Dear Mr. Vick: Reference your application of December 9, 1996, for Department of the Army (DA) authorization to replace Bridge No. 54 on SR 1674 over the Cullasaja River in Franklin, Macon County, North Carolina (TIP No.'B-2845). Foundation test borings will be required in the river channel. The proposal has been reviewed by the North Carolina wildlife Resources Commission (WRC). For the purposes of the Corps of Engineers' Regulatory Program, Title 3, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for activities undertaken, assisted, authorized, regulated, funded or financed, in whole or in part, by another Federal agency or department where that agency or department has determined, pursuant to the CEQ Regulation for the Implementing the Procedural Provisions of the National Environmental Policy Act, that the activity, work or discharge is categorically excluded from environmental documentation because it is included within a category of actions which neither individually nor cumulatively have a significant effect on the human environment, and the Office of the Chief of Engineers has been furnished notice of the agency's or department's application for the categorical exclusion and concurs with that determination. Authorization was also provided for survey activities including core sampling, seismic exploratory operations and plugging of seismic shot holes and other exploratory-type bore holes. Your work is authorized by these nationwide permits provided it is accomplished in strict accordance with the enclosed conditions, those outlined in the attached December 16, 1996 WRC letter, and provided you receive a Section 401 water quality certification from the North Carolina Division of Water Quality. All the nationwide permits are scheduled to be modified, reissued or revoked prior to 21 January 1997. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing the changes when they occur. Furthermore, if you commence or are under contract to commence this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit.
