Dear Mr. Anderson:
You have our approval, in accordance with the attached conditions, to culvert 0.09 acres of waters for the
purpose of paving SR 1364 at Franklin, as you described in your application dated September 25, 1997.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3108 This Certification allows you to use Nationwide Permit Number 26 when it is
issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This
Certification replaces the one issued on July 21,1997.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The North Carolina Department of Transportation is proposing to widen and pave
SR 1364, Needmore Road, in Macon County. This is a REVISED submittal which is
necessary due to some realignment and overall changes in the scope of our initial
proposal. This project has 11 sites indicated where springs or branches cross the road. In
order to construct this project in accordance with our current secondary road standards it
will be necessary to replace these pipe culverts which carry stream flow of Bird Branch
(DEM Class C) and other unnamed tributaries to the Little Tennessee River (DEM Class
C). There are also several wet roadway ditches along this road which will be impacted by
our proposed project. The approximate total surface area of these ditches is 0.09 Acre.
These ditches will most likely be re-created in the area where the new roadway ditchline
is proposed due to the presence of groundwater seepage. We are requesting authorization
to proceed under Section 404 of the Clean Water Act.
I am sending a location map, straight-line diagram, plan-profile sheets, erosion
control plans and details, and a U.S.G.S. map indicating project area and location of
proposed pipe culverts and trout stream buffer zone encroachments along the road. All
pipe culverts are to be installed slightly below the existing streambed elevations where
bedrock is not encountered to minimize impacts to wildlife habitat and allow the existing
stream gradients to remain as unchanged as is physically possible.

The best management practices will be used to minimize and control erosion and
sedimentation on this project. The construction foreman. will review all erosion control
measures daily to ensure erosion and sedimentation are being effectively controlled. If
the planned devices are not functioning as intended, they will immediately be replaced
with better devices. The rock silt screens and other erosion control devices will be in
place prior to pipe culvert construction and will remain in place until the project is
stabilized.
By copy of this letter I am asking Mr. Mark Davis, North Carolina Wildlife
Resources Commission (NCWRC) Western Mountain Region Coordinator, to comment
directly to you concerning this 404 Nationwide Permit request.
Also, by copy of this letter, I am requesting authorization to proceed under
Section 401 of the Clean Water Act from the Division of Environmental Management
(DEM).
We would like to begin construction as soon as possible. If further information is

greatly appreciated.

TEMPORARY SILT FENCES
A temporary silt fence is commonly used at lie toe of a fill section to prevent off-
site sedimentation. It is made of pernieable filter fabric buried at the bottom,
stretched and supported by steel posts. The silt fence reduces the water flow while
retaining the sediment. They may also be used to divert water flow to protected
outlets. Silt fences need to be checked after each significant rainfall to ensure there
effectiveness. They must be maintained on a regular basis. Silt fences shall not be
installed across streams, ditches, or waterways.
AREAS OF USE:
• At toe of fill sections where sediment runoff can be stored and contained
inside the project limits.
DESIGN CRITERIA:

SILT BASIN TYPE-B:
A silt basin type-B is a temporary basin built to collect sediment flowing through a
drainage way. The silt basin is built at the base of the ditch with its length being at
least 2 times the width of the basin. The type-B silt basin is getieeally built in
conjunction with temporary rock silt checks and other devices that control or slow
down water flow. This device must be monitored closely and cleaned out on a
regular basis until grass is established along the ditch line and sedimentation is no
longer a problem.
AREAS OF USE:
• In conjunction with temporary rock silt checks and other devices used in
drainage ditches.
DESIGN CRITERIA:
• Width - variable
• Length - 2 times width
• Depth - 2 ft. minimum storage - 1800 cubic feet/acre (equals L x W x D)

TEMPORARY ROCK SILT CuECK TYPE-B S

A temporary rock silt check type-B (also called check dam) is a small dam with a
weir used to reduce gullying in drainage ditches that are to be filled or
permanently stabilized at a later date. These type-B rock silt checks help reduce
the flow velocity and are generally made of class-B stone. They are used in ditches
during construction where the grade meets and/or exceeds 3%.

ROCK SILT SCREENS
(,.-;
A rock silt screen is a low-level dam structure to be used in streams below culvert
sites. Rock silt screens shall be used to trap sediment transported,by running water
and shall be placed in the stream below the construction site within the right-of-
way or easement boundary. The rock silt screen utilizes class B stone lined with #5
or #57 stone to produce a ripple-effect in the stream to settle the larger sediment
particles transported in the stream from the construction site. The trapped sediment
shall be cleaned out before the device is removed from the stream.
AREAS OF USE:
• In live streams below construction sites where construction occurs in or
adjacent to the stream.
• In live streams below a culvert construction site.
• Where it can be cleaned before it is removed from stream.
DESIGN CRITERIA:
Structural stone - class B stone
Sediment control stone - # 5 or # 57 stone
Darn height - 1.5 ft. nuninurm and 3 ft. rrnaxinrum ( shall not be higher than
1 ft. above normal flow of stream)

PIPE OUTLET ENERGY DISSIPArom 00
A pipe outlet energy dissipator shall be used at pipe outlets to slow the water
velocities when it exits the pipe and flows out ditched or natural waterways. It is
an apron of stone of a sufficient thickness to protect the outlet area from scouring
out and causing off-site sedimentation damage. Pipe outlet energy dissipators
should be built according to the guideline chart shown on page VIII-3 of this
manual.
AREAS OF USE:
• Outlets of pipes and culverts to prevent scouring.
DESIGN CRITERIA:
• In accordance with chart on page VIII-3.
• Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS :
• Filter fabric shall meet requirements of section 1056 of Standard
Specifications for Roads and Structures, January 1, 1990, for type 11 filter
fabric.

You have our approval, in accordance with the attached conditions, to culvert four 40 feet lengths of
waters for the purpose of paving SR 1364 at Franklin, as you described in your application dated 3 July 1997.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3108. This Certification allows you to use Nationwide Permit Number 26 when it is
issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Johnson:
The North Carolina Department of "Transportation is proposing to widen and pave
SR 1364, Needmore Road, in Macon County. In order to construct this project in
accordance with our current secondary road standards it will be necessary to replace
several pipe culverts which carry streamflow of Bird Branch (DEM Class C) and other
unnamed tributaries to the Little Tennessee River (DEM Class Q. We are requesting
authorization to proceed under Section 404 of the Clean Water Act.
I am sending a location map, straight-line diagram, plan-profile sheets, erosion
control plans and details, and a U.S.G.S. map indicating project area and location of
proposed pipe culverts and trout stream buffer zone encroachments along the road. All
pipe culverts are to be installed slightly below the existing streambed elevations where
bedrock is not encountered to minimize impacts to wildlife habitat and allow the existing
stream gradients to remain as unchanged as is physically possible.
The best management practices will be used to minimize and control erosion and
sedimentation on this project. The construction foreman will review all erosion control
measures daily to ensure erosion and sedimentation are being effectively controlled. If
the planned devices are not functioning as intended, they will immediately be replaced
with better devices. The rock silt screens and other erosion control devices will be in

place prior to pipe culvert construction and will remain in place until tile-project is
stabilized.
By copy of this letter I am asking Mr. Mark Davis, North Carolina Wildlile

directly to you concerning this 404 Nationwide Permit request.
Also, by copy of this letter, I am requesting authorization to proceed under

(DEM).

TEMPORARY SILT FENCES
A temporary silt fence is commonly used at the toe of a fill section to prevent off-
site sedimentation. It is made of permeable filter fabric buried at the bottom,
stretched and supported by steel posts. The silt fence reduces the water flow while
retaining the sediment. They may also be used to divert water flow to protected
outlets. Silt fences need to be checked after each significant rainfall to ensure there
effectiveness. They must be maintained on a regular basis. Silt fences shall not be
installed across streams, ditches, or waterways.

SILT BASIN TYPE-BS
A silt basin type-B is a temporary basin built to collect sediment flowing through a
drainage way. The silt basin is built at the base of die ditch with its length being at
least 2 times the width of the basin. The type-B silt basin is genefally built in
conjunction with temporary rock silt checks and other devices that control or slow
down water flow. This device must be monitored closely and cleaned out on a
regular basis until grass is established along the ditch. line and sedimentation is no
longer a problem.
AREAS OF USE:
• In conjunction with temporary rock silt checks and other devices used in
drainage ditches.
DESIGN CRITERIA:
Width - variable
Length - 2 times width
Depth - 2 ft. minimum storage - 1800 cubic feet/acre (equals L x W x D)

TEMPORARY ROCK SILT CHECK TYPE-BI
A temporary rock silt check type-B (also called check dam) is a small dam with a
weir used to reduce gullying in drainage ditches that are to be filled or
permanently stabilized at a later date. These type-B rock silt checks help reduce
the flow velocity and are generally made of class-B stone. They are used in ditches
during construction where the grade meets and/or exceeds 3%.
AREAS OF USE:
In channels, roadside ditch outlets, temporary silt ditches, and temporary
diversions.
In conjunction with type-B silt basins.
DESIGN CRrIERIA:
Center of rock silt check shall be at least 1
(top of channel sides)
The spacing (ft.) _ (3 / % of ditch grade) X
foot lower than the outer edges

ROCK SILT SCREENS
J
A rock silt screen is a low-level dam structure to be used in streams below culvert
sites. Rock silt screens shall be used to trap sediment transported.by running water
and shall be placed in the stream below the construction site within the right-of-
way or easement boundary. The rock silt screen utilizes class B stone lined with #5
or #57 stone to produce a ripple-effect in the stream to settle the larger sediment
particles transported in the stream from the construction site. The trapped sediment
shall be cleaned out before the device is removed from the stream.
AREAS OF USE:
• In live streams below construction sites where construction occurs in or
adjacent to the stream.
• In live streams below a culvert construction site.
• Where it can be cleaned before it is removed from stream.
DESIGN CRITERIA:
• Structural stone - class B stone
• Sediment control stone - # 5 or # 57 stone
• Dam height - 1.5 ft. minimum and 3 ft. maximum ( shall not be higher than
1 ft. above normal flow of stream)

A pipe outlet energy dissipator shall be used at pipe outlets to slow the water
velocities when it exits the pipe and flows out ditched or natural waterways. It is
an apron of stone of a sufficient thickness to protect the outlet area from scouring
out and causing off-site sedimentation damage. Pipe outlet energy dissipators
should be built according to the guideline chart shown on page VIII-3 of this
manual.
AREAS OF USE:
• Outlets of pipes and culverts to prevent scouring.
DESIGN CRITERIA:
• In accordance with chart on page VIII-3.
Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS :
Filter fabric shall meet requirements of section 1056 of Standard
Specifications for Roads and Structures, January 1, 1990, for type 11 filter
fabric.
