You have our approval, in accordance with the attached conditions, to place fill material in 0.039 acres
of wetlands or waters for the purpose of widening US 258 from US 70 to SR 1575, as you described in your
application dated 14 February 1997. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide
Permit Number 14 when it is issued by the Corps of Engineers. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The North Carolina Department of Transportation proposes to widen US 2-58 from LIS 70
to SR 1 575 (Poole Rd) from the existinu two-lane shoulder section to a five-lane roadway
with curb and outter that will measure 19.2 meters (64 feet) face to face of curbs. The
intersection with US 70 at the southern terminal of the project will he revised as a part of
this project. Additional turn-lanes are proposed at various intersections alone the project.
The project is approximately 5.5 kilometers (,.4 miles) long,.
The project wvill have three culvert extension which is expected to impact three
jurisdictional xtictlands (Figure 1) Xyit}1 till totalinu, 157 nl- (0.039 acres). :\dditionaliv.
approximately 70 meters (230 feet) of a Neese River tributary near the intersection with
US 70 will need to be relocated in order to direct it throu1-1ll all extended culvert under US
70. This will result in approximately 167 rn- (0.041 acres) ofsurface water fill Ill the old
channel (Fii'Llre 2).
It is anticipated that this construction activity qualifies for Federal authorization pursuant
to the pre har??e notification provisions set tOrth in Nationwide Permit 33 CFR
330.5(a) 1). Application is hereby made for the Department of Army permits as
required 6 such activities. In addition we are hereby requesting a 401 Water OLiality
Certification from the Division of Water Ohilt"'. Please find the enclosed pre-discharge
notification tOrnl and permit dra\\ings ter this project.

The North Carolina Department of Transportation proposes to widen US 258 from
US 70 to SR 1575 (Poole Rd) from the existing two-lane shoulder section to a five-lane
roadway with curb and gutter that will measure 19.2 meters (64 feet) face to face of curbs.
The intersection with US 70 at the southern terminal of the project will be revised as a part of
this project. Additional turn-lanes are proposed at various intersections along the project.
The project is approximately 5.5 kilometers (3.4 miles) long.
The project will impact surface waters at three sites with till totaling 0.08 acres,
(Figure 1). No wetlands will be impacted. All three sites are in heavily developed
commercial and residential land. There are no overhanging trees or bushes associated with
any of the stream channels and land adjacent to each bank is mowed grass.
More than half of the impact, 0.048 acres, will occur at a Neuse River tributary near
the intersection with US 70 at the beginning of the project. In order to minimize the impacts
to the Neuse River Tributary, NCDOT will remove a 92' long culvert which is currently
located under the existing ramp (RAMP A in Figure'a) used by traffic heading west on US 70
and accessing US 258. This 19,111 result 265.7 feet of the old channel being tilled and the
relocatioli/creation((,.o.f 337.9 tcet of a new channel, a net gain of 72.2 feet of open channel.
After further consuktation with Mr. David Cox on the Wildlife Resource Commission, the
NCDOT will adhere to the following commitments to further minimize the impacts from
relocating the stream:
• The new channel bottom x?ill be placed at a depth of 9.2 feet in order to provide the same
sand; silt substrate as the existing channel.
• Rip rap ??ill he limited to the banks ofthe new channel where the stream bends. No rip
rap \\iII be placed along.; the stream bottom.

• Vegetation will be planted along the bank and adjacent to the bank for the length of
the project. The vegetation will be allowed to establish itself before the water is
diverted into the new channel.
• Vegetation will consist of the following species:
To be placed in bank- Black Willow (Salix nipra)
Silky Dogwood (Cornus amomum)
Turf-type Tall Fescue
Pensacola Bahiagrass
To be placed adjacent to bank- Sweetgum (Liquidambar styraciflua)
Sycamore (Platanus occidentalis)
Black Cherry (Prunus serotina)
River Birch (Betula nigra)
Turf-type Tall Fescue
Pensacola Bahiagrass
Centipede grass
No construction moratorium is proposed for this project.
The scope of work for this project was documented in an Environmental
Assessment and Finding Of No Significant Impact approved by the Federal Highway
Administration on 30 October 1995 and 31 May 1996 respectively. Copies of these
documents are available upon request. It is anticipated that this construction activity
qualities for Federal authorization pursuant to the pre-construction notification provisions
set forth in Nationwide Permit 33 CFR 330.5(a)(14). Application is hereby made for the
Department of Army permits as required for such activities. In addition we are hereby
requesting a 401 Water Quality Certification from the Division of Water Quality. Please
find the enclosed Pre-Construction Notification Application and permit drawing for this
project. This application supplants the application dated 14 February 1997.

A similar channel will be constructed parallel to the existing channel and

have a similar typical section. Two existing 6'x6', 92 foot long RCBC will
be removed and replaced with an open channel configuration matching and
connected to the channel above.
