On behalf of Chemours I would like to request that our June 4, 2020 Nationwide Permit 38 for the Flow -through
Cells be withdrawn. We will submit another NWP 38 application when the new design has been completed
later this month or early August.

Chemours Flow Through Cells
Dear Ms. Compton:
On, June 3, 2020 you requested a 401 Water Quality Certification from the Division of Water
Resources (Division) for the subject site. On July 15, 2020, the Division received a request from
your consultant on your behalf to withdraw the application. This letter acknowledges your
request; your application is withdrawn.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
