The use of NWP 3 requires compliance with all its general and regional conditions. Typically applicants, early in planning,
provide a delineation of aquatic resources within all project areas so the USACE is at least aware of the work to be done.
While this is my first notification of your project, I was able to access your application via the State's Laserfiche website.
Please describe how this project would comply with NWP 3 General Condition 2 (Aquatic Life Movements), and
therefore not require USACE notification.
Additionally, general condition 18 (Endangered Species) requires coordination with the USFWS prior to use of a permit
for any activity that 'May Affect' a listed species or critical habitat. The USFWS IPaC website identifies Cape Fear Shiner
(Endangered) as a species of concern in your project location. Please include documentation of your coordination with
the USFWS in your response.
