Dear Mr. Aiken:
This narrative describes site conditions, transmits plans for proposed stream restoration and dam
construction, and requests a trout buffer variance for the subject project. The work is being done
in response to Notices of Violation (NOVs) from Macon County and the NC Division of Water
Resources issued in November 2019. Restoration will take place on unnamed tributaries (UTs)
to Big Norton Prong (Class WS-II; Tr; HQW). The site is located in the Little Tennessee River
basin.
Site Conditions
The project site is located on the western floodplain of Big Norton Prong where three UTs enter
the main stem creek on the east side of Norton Ridge Road. The westernmost UT was
previously impounded and the NOV relates to Mr. Meshad having started expanding the
impoundment prior to obtaining the necessary permits. Site grades within the immediate work
area are relatively flat but the pond site is surrounded by rolling terrain; elevations range from
about 3925 feet at the southern property boundary to about 3900 feet in the pond footprint.
Work was halted upon receipt of the NOV and soil stockpiles, silt fences and a flashboard riser
pond outlet structure remain in place. The northern and western boundaries of the disturbed area
are wooded.
The proposed project, detailed in the attached plans, involves the following:
• Construction of 426 LF of new, off-line stream channel on two UTs to Big Norton Prong;
• Construction of a 6-foot tall dam and creation of a 0.8-acre pond where a smaller pond
had existed prior to the NOV; and
• Planting native trees and shrubs in riparian buffer areas.
Proposed Erosion and Sedimentation Control Measures
The design attempts to minimize erosion and sedimentation through the following practices:

• A coffer dam flow diversion, pump -around and/or diversion swale will be used to divert
stream flow around work areas and through an existing flashboard riser outlet structure;
• The contractor will be required to mobilize all equipment and materials necessary for the
project before beginning any stream work;
• Silt fences will be installed on the stream sides of all temporary stockpiles; and
• The contractor will be required to stage his work such that disturbed areas along the
stream banks will be stabilized with seeding, mulch and erosion control matting prior to
the end of each work day.
Stream restoration and dam construction will take place concurrently and will begin soon after
permits are obtained. The project is expected to last for three months, with planting to take
place during the dormant season following grading. Details on the construction sequence and
erosion and sedimentation control practices are included in the attached plan sets.
