The applicant, Daniel Communities, LLC, is requesting an After -the -fact modification to the US Army Corps of Engineers Section 404 permit and N.C. Division of Water Quality (DWQ) 401 Certification both dated May 12, 2020. The modification involves an after -the -fact permit submittal for 122 linear feet of stream and 0.02 acres of wetland impacts associated with golf holes 1 and 9. Attached is a revised Figure 5.01. Golf Impacts Additional impacts include: 1. Wetland Impact #26 0.006 ac. Hole 9 2. Wetland Impact #27 0.002 ac. Hole 1 3. Wetland Impact #28 0.012 ac. Hole 1 4. Stream Impact 22(a) 78 If Hole 1 5. Hole 9 32 Clayton Street Asheville, NC 28801 828-698-9800 Tel High Hampton July 13, 2020 Page 2 Please note that all five wetland and stream impacts were previously authorized for impacts associated with golf hole 1 and 9 in the January 21, 2020 DWR 401 Certification. In an attempt to reduce overall impacts to wetlands and streams, the applicant submitted a permit modification request to the Corps and DWR on April 2, 2020 indicating that wetland impacts 26, 27, 28 and stream impact 24 would be eliminated and stream impact 22 would be reduced from 388 If. to 2101f. on the revised site plan associate with golf Holes 1 and 9. However, during construction of fairways 1 an 9 impacts to these areas were unavoidable due to unexpected inconsistencies with actual topo vs flown survey contours. This revised request still provides additional avoidance of 941f from the previously authorized the January 21, 2020 401 approval. Mitigation The applicant has reviewed the rest of the project and determined that authorized impact #8 for a road crossing, 30 If, will now be bridged. The applicant has already paid for mitigation for impact #8. Receipt dated April 22, 2020. Therefore, the applicant proposes to mitigate for 921f. and 0.20 acres of wetlands. • Corps stream mitigation ratio of 2:1 requires 184 mitigation from DMS • Corps wetland mitigation ratio of 2:1 requires 0.04-acre mitigation from DMS The applicant will mitigate for these additional impacts through North Carolina Division of Mitigation Services (DMS). The DMS acceptance letter dated June 24, 2020 is attached for review. Daniel Communities, LLC respectfully requests that their permits be modified to reflect the information provided above. The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit1401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website. Based on the information supplied by you in your request to use the DMS, the impacts for which you are requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation required and assigned to DMS for this impact is determined by permitting agencies and may exceed the impact amounts shown below.
