Dear Mr. Vick.
You have our approval, in accordance with the attached conditions, to place fill material in 0.16 acres of
wetlands or waters for the purpose of replacing a bridge with a bridge at NC 99, Bridge #70 over Smith Creek,
as you described in your application dated 24 June 1997. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

bridge which will have a 24' wide travelway and 8' wide offsets on each side.

ENVIRONMENTAL SETTING
The project site is at Bridge No. 70 over Smith Creek on NC 99 in Beaufort County.
Located at the site is a 75' long by 23. 61' wide bridge. The bridge has a 11.80' clearance between
the bottom of the bridge and the NWL. The existing approaches to the bridge are stabilized with
riprap. Adjacent to the northeast, southeast and northwest road shoulders are areas of coastal
wetlands which is dominated with Distichlis spicata, Juncus roemerianus, and 1 di m jamaicense.
The shoulders are vegetated with various upland grasses.
PROJECT PROPOSAL
The applicant is proposing to replace the existing bridge with a new bridge along the same
alignment.The new bridge will consist of a three span cored slab on a concrete substructure and
will have a lefigth o f. Approximately 82 feet. There will be a 24' wide travelway plus 8' wide
offsets on each side. Their avigation clearance will remain. The environmental impacts which will
be discussed later will be the result of the approach widening. No temporary detours, stream
relocation or work channels will be involved
ENVIRONMENTAL IMPACT
The following environmental impacts will occur if the project is conducted as proposed :
1) Approximately 261.36 square feet of coastal wetlands will be filled at the
northwest corner of the bridge due to approach widening.
2) Approximately 6,795 square feet of open water area will be filled due to approach
widening and riprap stabilization.
3) An upland area approximately 125' by 17' located at the northeast corner of the
bridge, between the approach and an area of coastal wetlands, will be graded to
the elevation of the adjacent wetland. The site will be monitored for two growing
seasons to see if natural vegetation has colonized the site. If sufficient vegetation
has not reclaimed the area after that time then the applicant will replant the area
with native marsh plants.

SUBJECT: CAMA MAJOR PERMIT APPLICATION FOR REPLACEMENT OF
BRIDGE NO. 70 OVER SMITH CREEK ON NC 99, BEAUFORT
COUNTY, TIP NO. B-2805.
The North Carolina Department of Transportation (NCDOT) proposes to replace
the referenced structure on existing location, along with associated approach
improvements. The new bridge, consisting of a three span cored slab on a concrete
substructure, will be approximately 25 meters (82 ft) in length with a 7.2 meter (24 ft)
wide travelway plus a 2.4 meter (8 ft) wide offset on each side and 1372 millimeter (54
inch) bicycle-safe rails. Traffic will be detoured onto existing roadways during
construction.
Whenever NCDOT replaces an existing bridge, it is the policy of the American
Association of State Highway and Transportation Officials that the roadway and
approaches be up-graded to conform with current design standards. The standards for this
type of new bridge require an increase in width of approximately 5 meters (16.4 ft).
NC 99 is also a bicycling highway that normally requires a 4.2 meter (14 ft) travelway. In
order to reduce wetland impacts, the NCDOT Bicycle and Pedestrian Unit agreed that the
narrower, 3.6 meter (12 ft) travelway would be sufficient for bicycle traffic. K
The project will require the fill of 0.156 acres of estuarine surface waters and
0.006 acres of wetlands. The dominant vegetation in the wetlands is smooth cordgrass
(Spartina alterniflora), saw grass (Cladium jamaicense), and black needlerush (Juncus
roemerianus). No temporary fill in wetlands, stream relocation, or channel change will be
involved. In order to mitigate for these impacts, NCDOT proposes to grade
approximately 0.05 acres of upland to the level of the adjacent salt marsh. This area is
located north of the bridge on the upstream side of Smith Creek between the edge of the
fill slope and the existing salt marsh. It is indicated as cross hatching on sheets three and
four of the permit drawings.
The area to be graded is small, approximately 125 feet x 17 feet. After grading is
complete, the NCDOT proposes to monitor this site for two growing seasons to determine
if natural vegetation has colonized the site. If sufficient vegetation has not reclaimed the
area at that time, then NCDOT will replant the area with native marsh plants.
The navigational clearance of the bridge will basically remain the same since no
recognized demand for navigation exists. Smith Creek is not susceptible for use as a
means to transport interstate or foreign commerce and there is no evidence that boats
greater than 6.4 meter (21 feet) long cross under Bridge No. 70. Therefore, the Federal
Highway Administration has determined that the project does not require a U. S. Coast
Guard Permit in accordance with 23 CFR 650.805(c)
Smith Creek flows east into Pungo Creek which is part of the Tar-Pamlico River
Basin. It is classed as SC NSW, indicating a supplemental classification of Nutrient
Sensitive Waters, which requires limitations on nutrient inputs. NCDOT's Best
Management Practices for the Protection of Surface Water, which implements stringent
erosion and sedimentation control, will be employed throughout construction. During
project planning, it was determined that no anadromous fish spawning areas occur within
175 meters (575 feet) of the project, so no construction moratorium is proposed.
The scope of work for this project was documented as a Categorical Exclusion
approved by the Federal Highway Administration (Federal Aid Project BRSTP-99(1),
State Project 8.1150801) on 10 April 1995. It was distributed to the resource agencies 30
August 1995. More copies of this document are available upon request. Application for a
Major CAMA Permit is hereby made. Permit drawings depicting the proposed work are
attached. A check in the amount of $Z 9.00 Warrant No. 98074 is enclosed to cover
. the CAMA processing fee. The adjacent property owners have been notified of this
permit request. Copies of the letters sent to the property owners and the certified mail
receipts are attached. The signed return receipts from these property owners will be
forwarded to you as soon as possible.
