The information provided herein is in response to your Request for More Information dated 1 September 2006. ESI has listed each of your three comments and followed each with our response. a. Please provide a large plat of the property showing all wetland impacts and lot layout. The 8.5 X 11 sized plats are very difficult to see everything that is being proposed. Attached with this letter are two copies of the wetland impacts on 24" X 36" paper per our conversation on September 11. b. Please revise the application and separate any waters vs. wetland impacts. The original PCN submittal listed no impacts to waters. Through several iterations of the site plan, impacts to waters were completely avoided in Phase 1 of the Villages at Turtle Creek. There are no impacts to waters in Phase 1 of the Villages at Turtle Creek. The impacts proposed for this project will affect wetlands only. c. Please provide a notarized copy of the draft deed notification and restrictions that, at a minimum, notify lot owners that there are wetlands on the property, which are protected by the NC Division of Water Quality and the USArmy Corps JACKSONVILLE • ST. AUGUSTINE • COCOA • JUPITER • DESTIN • SAVANNAH • ATLANTA • RALEIGH • CHARLOTTE • ASHEVILLE ENVIRONMENTAL SERVICES, INC. of Engineers. If you plan on preserving the remaining wetlands on the tract, please provide draft language that will accomplish preservation. The applicant is reviewing the Model Conservation Easement, Restrictive Covenant Guidance, and the Model Declaration of Restriction as found on the U.S. Army Corps of Engineers -Wilmington District website. The applicant is proposing to place conservation easements on the wetlands in Phase 1 that are not within lot boundaries and impact areas. Wetlands located within the proposed lots will be protected with deed restrictions. I trust that this information will be sufficient for the continued processing of the permit application.
