Mickey, Jr., Fisheries Biologist Ori9ftl signed by DATE: June 10, 1996 Joe Mickey SUBJECT: Review of an application by the North Carolina Department of Transportation to grade, drain, base, and pave SR 1514 along Storey Branch, Days Creek, and Laurel Creek, Watauga County. vG 'Q?C?/G The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists conducted a site visit on June 8, 1996. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to relocate a spring ditchline from Sta. 58+75 to 62+50, and replacement of pipes carrying live streams at Sta. 98+00 and Sta. 103+00. The NCDOT is also requesting a temporary encroachment in the trout stream buffer zone at several locations. The streams mentioned above are not NCWRC Designated Public Mountain Trout Waters, however, they carry the NC Division of Environmental Management classification of WS-IV-Tr. Storey Branch and Days Creek contain excellent wild brook trout populations (NCWRC data, 11/3/94). Laurel Branch contains wild brown and brook trout and numerous nontrout species (NCWRC data, 11/3/94). Goshen Creek, mentioned in the permit application, does not appear to be impacted by the project, however it does contain a good wild brook trout population. During the site visit it was discovered that work on this project was in progress from approximately Sta. 132+00 to 156+00. There had been some disturbance of the trout stream buffer zone along Days Branch. We are concerned about this activity occurring before NCDOT received a 401 and 404 permit. Disturbance of the trout stream buffer zone along high quality brook trout waters has the potential to increase water temperatures and increase off-site sedimentation. Because of the possible impacts this project could have to receiving brook trout waters, we would have recommended that disturbance of the trout stream buffer zone be not be allowed in this area. Also, based on observations during the site visit, it is also our opinion that the sediment controls in place were inadequate to control off-site sedimentation from reaching Days Creek.. Based on the site visit and review of submitted plans, the NCWRC will not object to the issuance of a permit provided the following conditions are implemented: Page 2 I . Because of the high potential for off-site sedimentation from this project, construction is prohibited during the brook trout spawning season of October 15 to April 15 in order to protect the egg and from stages from sedimentation. 2. The relocation of the small spring ditchline will be permitted, however, there is to be no disturbance of the trout stream buffer zone on the opposite side of the road from Sta. 58+75 - 60+00 adjacent to Storey Branch. 3. The existing trout stream buffer zone from Sta. 124+00 - 132+00 must be left undisturbed. 4. Additional disturbance in the trout stream buffer zone from Sta. 132+00 - 156+00 is prohibited. 5. Replacement of pipes at Sta. 98+00 in an unnamed tributary to Days Creek and at Sta. 103+00 in Days Creek must be one foot below the normal stream bottom in order to allow for brook trout passage. Shade giving trees and shrubs (tag alders, Mt. laurel, rhododendron) must be planted along disturbed areas at the pipe inlet and outlet in order to provide stream shading. 6. Adequate erosion controls must installed and maintained throughout the life of the project. 7. Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent herbaceous vegetation in these same areas should be planted within 5 days of ground disturbing activities to provide long term erosion control. 8. The plans do not call for the replacement of bridge #63 over Storey Branch, however, if the bridge is to be replaced in the future, it must be replaced with a spanning structure and not a culvert. The NCDOT should be reminded that all necessary permits must be received before beginning work on a project. It is important that all parties concerned have time to review and comment on a project before commencement of work in order to lessen environmental impacts to receiving trout waters. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). As we indicated in our previous comments, the streams in the project area support wild brook trout, our only native salmonid. Therefore we are especially concerned with minimizing adverse impacts to these streams during construction. Mr. Martin Bolick recently contacted me and Mr. Joe Mickey about Items 3 and 4 on our previous memorandum. Ile indicated that these would be difficult permit conditions to follow, given how close the existing roadway is to these streams. Alter some discussion, we agreed to modify our comments as follows: • Delete Items 3 and 4 from the list of permit conditions. *0, • Add two additional permit conditions as follows: I ?`sc/?l°Fs SR 1514 Page 2 June 19, 1996 9) Existing trees and shrubs in the trout buffer zone should be preserved as much as possible to provide shade and bank stability. 10) Trees and shrubs within the trout buffer zone damaged or removed during construction should be replanted where possible with native species already at the project site such as tag alder, mountain laurel, or rhododendron. We will not object to the issuance of this permit, or to the temporary encroachment into the trout buffer zone, provided these conditions and the others outlined in our previous memorandum (with the exception of Items 3 and 4) are followed by the NCDOT. We especially appreciate the NCDOT's willingness to abide by Item 2 to protect Storey Branch and their prompt attention to halting work in the trout buffer zone until all permits are received. This project will require the relocation of a spring in the ditchline from Sta 58+75 to Sta 62+50. Also, this project will require replacing several pipes and the addition of pipes at Sta 98+00 and Sta 103+00 which carry streams. The streams are Storey Branch, Days Creek, Laurel Branch and Goshen Branch. These streams all have the DEM classification, WS-IV Tr. Due to the proposed work, we are requesting a 404 Nationwide Permit. I am sending a joint application form, typical roadway section, straight line sketch with the proposed erosion control, notes on pipe installation, general notes on erosion control, cross sections of proposed encroachments in trout water buffer zone, and a marked county map. By copy of this letter, I am requesting Ms. Stephanie Goudreau, Mt. Region Biologist Coordinator to comment directly to you concerning the 404 Nationwide Permit request. Since a request will be made for a temporary encroachment in the trout water buffer zone, I am also requesting Ms. Goudreau to comment directly to me concerning the encroachment. Install erosion control devices. In streams, where necessary, rock silt screens will be used and installed prior co pipe replacement or any work being done to -hannel. Remove material and existing pipe while limiting, as much as possible, material and sediment from entering a stream and/or escaping from project. 3. Prepare pipe foundation while again taking care to limit, as much as possible, material and sediment from entering a stream and/or escaping from project. Where possible, new grade will be below existing stream bed. If needed, bedding material will be clean stone. 4. Place the new pipe and compact backfill. 5. Install slope protection on outlet and inlet ends of pipe. Also complete installation of erosion control measures and perform maintenance as needed on existing measures. 6. Establish permanent vegetation as soon as possible. 7. Remove rock silt screens as soon as possible after vAaP+_ation is established. Prior to removal of rock sil- screens any accumulated silt must be removed. GENERAL NOTES ON EROSION CONTROL Silt Basin Type B's will be crinstructed to the dimension of six feet by three feet by thr(-e feet unless otherwise noted on the plans. Where slope protection treatment is required, Section 868 and Section 1042 of the 1990 Standard Specifications for Roads and Structures will be followed. Any material obtained from the project must be clean before being placed. Generally, the order of installation of the erosion control measures will be as follows: Temporary Silt Basins shall be installed before clearing and grubbing begins. Silt Fences and Temporary Silt Ditches shall be installed after clearing and before grading. Temporary Stone Ditch Checks shall be installed as soon as ditchline is established. Pipe Outlet and Inlet Protection will be done as soon as the pipe is installed. Seeding and other permanent erosion control measures are to be implemented as soon as practical.
