Box 25201 Raleigh, NC 27611-5201 Dear Mr. Vick: You have our approval to place fill material in 1.12 acres of wetlands or waters for the purpose of widening and realigning SR 1157, as you described in your application dated 26 March 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. High Quality soil and erosion control measures shall be utilized. Mitigation shall be done as described in the Corps of Engineers letter dated 29 April 1996. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. In that letter, you requested Department of the Army permit authorization for the placement of fill material into Bloomery Swamp, its adjacent wetlands, and a headwaters wetland, impacting a total of 1.12 acres of waters of the United States, including wetlands, to facilitate construction of the proposed improvements. On January 1, 1992, we renewed general permit No. 198200031, (copy enclosed), that authorizes the placement of fill material associated with the construction, repair, or replacement of bridges across navigable waters and waters of the United States in North Carolina, including cofferdams, abutments, foundation seals, piers, temporary construction and access fills, approach fills, detour fills, and box culvert installation, as part of work conducted by or in full compliance with the standards and specifications of the North Carolina Department of Transportation (NCDOT). Based on our review of your application, and information gathered on previous field inspections of the project site, we have determined that the proposed project, without compensatory mitigation, has greater than minimal adverse impacts to the environment. However, your staff has agreed to provide compensatory mitigation in the form of debits from the proposed Gurley Tract mitigation site, east of Goldsboro, in Greene County, North Carolina. Planning for this mitigation site is presently underway. Primed on ® Recycled Paper -2- Your proposed work impacting a total of 1.12 acres of waters of the United States, including wetlands, is authorized if you can comply with all permit conditions, including the following special condition: The 1.00 acre of wetland impact for the Bloomery Swamp crossing shall be compensated for by partial debit of the compensatory wetland mitigation project known as the Gurley tract, and described in the "MITIGATION PLAN, N.C. State Project No. 9.8044593, TIP U-3345. Action ID. 199502788. The North Carolina Department of Transportation proposes to improve Merck Road (SR 1157) from a two-lane road to a five-lane road to accommodate the increase in traffic brought about by the development of the Wilson Corporate Park. The facility, which will accommodate traffic to and from the corporate park and US 264/I-95 will also include improvements to US 264 and Wilson Christian Road (SR 1158) at their intersection with ivlerck Road. The proposed project is 3.4 kilometers (2.1 miles) long and 19.5 meters (64 feet) wide. The project will include a three-barrel, 3.66 meter by 3.05 meter (12 ft by 10 ft) reinforced concrete box culvert approximately 100 feet in length. The culvert will cross the main channel of Bloomery Swamp. A smaller three-barrel culvert, 2.44 meters by 1.52 meters (8 by 5 feet), will be installed in the contiguous Bloomery Swamp floodplain to maintain the 100 year flood elevation. These proposed activities, described in the attached drawings, will result in fill and excavation within jurisdictional waters of the United States. The NCDOT requests that these Blo ery wamp Crossings be permitted under the Corps of Engineers General Permit ,o. 31. Coordination efforts between the Dep me of Transportation and the Corps of Enulneers beean in April 1995 as part of the State Environmental Assessment/Finding of No Significant Impact (SEA/FONSI) process. The SEA/FONSI was approved in August 0 1995 and identified that approximately an acre of jurisdictional wetlands would be affected (no delineation was performed therefore, quantities are approximate). In November 1995 the wetlands were delineated. The impacts were: 1.25 acres of permanent fill, 0.30 acres of excavation, 0.62 acres of temporary impacts; total impact 2.17 acres of impact to jurisdictional wetlands. Since that time, measures have been taken to avoid and minimize the loss of wetlands to the greatest extent practicable. These efforts have resulted in the reduction of wetland impacts to 0.89 acres of permanent fill, 0.09 acres of excavation, and 0.02 acres of temporary impacts resulting in a total impact of 1.00 acres to jurisdictional wetlands. This reduction in impacts was accomplished by implementing the following measures: 1. PERMANENT FILL: The road grade was lowered by 6 feet with a concomitant reduction in fill slopes. This change resulted in a reduction in the area of permanent fill. 2. PERMANENT FILL: Fill slopes were reduced from a 4:1 slope to a 1.5:1 slope which also significantly reduced the area affected by permanent fill. 3. TEMPORARY IMPACTS: The temporary impacts were decreased by using silt curtains which will be placed at the toe of all fill slopes in the wetland. 4. EXCAVATION IMPACTS: The original design, which resulted in 2.17 acres of impact including 0.30 acres of excavation, required a diversion channel. The use of the diversion channel allowed the culvert barrels to be constructed simultaneously. The diversion channel has been eliminated, the construction will proceed in stages, and only 0.09 acres of wetland will be excavated. In addition, the Corps of Engineers requested that the Department of Transportation investigate the following three mitigation measures: 1. The possibility of planting wetland hardwood species similar to the surrounding habitat in the cut-over area of Bloomery Swamp located adjacent to the project site. The Department of Transportation concurs and will proceed with a revegetation plan. 2. Evaluate the use of a bridge over Bloomery Swamp and floodplain and include a presentation of costs. The estimated cost for the culvert system is $241,650. The minimum bridge length required to meet the hydraulics design criteria is 165 feet with an estimated cost of $660,000 and 0.77 acres of permanent wetland impact and 0.22 acres of temporary impact. A bridge 564 feet long is required to span the entire wetland with an estimated cost of $2.3 million with 0.5 acres of temporary impacts to wetlands. 3. The construction of a retention facility to improve the water quality of Bloomea Swamp. Approximately 2.5 acres of roadway pavement drain to Bloomery Swamp at the site. Due to the low roadway grade at the site it would only be possible to provide retention basins for 2.0 acres of this runoff without disturbing more wetland adjacent to the site. Two retention basins would be required to collect this runoff, one on the northwest side (approximately 0.5 acres) of Bloomery Swamp and one on the southeast side ( approximately 0.5 to 1.0 acres). The proposed storm drainage systems for the project drains into the wetlands adjacent to Bloomery Swamp on the north and south side and not directly into the main channel. This was done so that storm water runoff would be filtered out or settle in the wetlands and not be discharged directly into the main channel. In addition, we are hereby requesting a 401 Water Quality Certification from the Division of Environmental Management. We anticipate the 401 General Certification No. 2735 will apply to this project, and are providing seven copies of this application to the North Carolina Department of Environment, Health and Natural Resources, Department of Environmental Management, for their review. The subject project will also fill approximately 0.12 acres of a small jurisdictional wetland located above headwaters and approximately 1200 feet south of the Bloomery Swamp culverts. This action can be permitted under Nationwide Permit No. 26 and the Section 401 General Permit without need for NCDEM notification. The estimated cost for the culvert system is $241,650. The minimum bridge length required to meet the hydraulics design criteria is 165 feet with an estimated cost of $660,000 and 0.77 acres of permanent wetland impact and 0.22 acres of temporary impact. A bridge 564 feet long is required to span the entire wetland with an estimated cost of $2.3 million with 0.5 acres of temporary impacts to wetlands. 3. The construction of a retention facility to improve the water quality of Bloomery Swamp. Approximately 2.5 acres of roadway pavement drain to Bloomery Swamp at the site. Due to the low roadway grade at the site it would only be possible to provide retention basins for 2.0 acres of this runoff without disturbing more wetland adjacent to the site. Two retention basins would be required to collect this runoff, one on the northwest side (approximately 0.5 acres) of Bloomery Swamp and one on the southeast side ( approximately 0.5 to 1.0 acres). The proposed storm drainage systems for the project drains into the wetlands adjacent to Bloomery Swamp on the north and south side and not directly into the main channel. This was done so that storm water runoff would be filtered out or settle in the wetlands and not be discharged directly into the main channel. In addition, we are hereby requesting a 401 Water Quality Certification from the Division of Environmental Management. We anticipate the 401 General Certification No. 2735 will apply to this project, and are providing seven copies of this application to the North Carolina Department of Environment, Health and Natural Resources, Department of Environmental Management, for their review. The subject project will also fill approximately 0.12 acres of a small jurisdictional wetland located above headwaters and approximately 1200 feet south of the Bloomery Swamp culverts. This action can be permitted under Nationwide Permit No. 26 and the Section 401 General Permit without need for NCDEM notification.
