Location description: The project area is located on the west side of Yanceyville Street, approximately 0.4 mile north of its
intersection with East Cone Boulevard, at 3305 Yanceyville Street, in Greensboro, Guilford County, North Carolina.
Description of projects area and activity: This verification authorizes the permanent discharge of fill material into 20 linear feet
of stream channel (not considered a loss of waters of the US), and the temporary discharge of fill material into 0.112 acre of
riparian non-riverine wetlands (0.107 acre require a permanent conversion from forested to herbaceous wetlands) and 15
linear feet of stream channel, necessary for the installation of a sewer line to service the Yanceyville Apartments multi-family
residential development.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the enclosed
Conditions, your application signed and dated 5/15/2020, and updated information provided via email on 7/9/2020, the enclosed
plans “Overall Perennial Stream/Wetland Impact Map Yanceyville Apartments”, “Perennial Stream/Wetland Impact Map
Yanceyville Apartments”, “Details Yanceyville Apartments”, and Sheet Nos. C-2.0, C-3.0, C-4.0, and C-4.1. Any violation of the
attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order,
a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended
or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit’s expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior
to beginning work you must contact the N.C. Division of Coastal Management.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal, State
or local approvals/permits.

SPECIAL CONDITIONS
1. In order to compensate for impacts associated with this permit, mitigation shall be provided in
accordance with the provisions outlined on the most recent version of the attached Compensatory
Mitigation Responsibility Transfer Form. The requirements of this form, including any special
conditions listed on this form, are hereby incorporated as special conditions of this permit
authorization.
2. Following installation of the authorized wetland impacts, these areas must be restored according
to the “Restoration Notes” on the attached plan sheet labeled “Overall Perennial Stream/Wetland
Impact Map Yanceyville Apartments.”
3. Please note that future impacts and/or phases of the Yanceyville Apartments development and
related activities associated with Corps Action ID: SAW-2018-01070 may be considered part of a
single and complete project, cumulative with impacts permitted during earlier phases with respect
to compensatory mitigation and Nationwide Permit thresholds.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when

1. In addition to the wetland and stream impacts proposed for the sewer line, it appears that a fill slope and rip rap
pad extends slightly into wetlands related to stormwater facility fill slopes and outlet: I have moved the rip rap
and the fill slope outside of the wetlands.
a. These impacts are not reported in the PCN provided, nor are that indicated on the plans provided
(Sheets C-2.0, C-4.0, and C-4.1); These are no longer impacts to the existing wetlands
b. It appears that additional design actions could be implemented (per NWP General Condition 23(a) and
(b)) to avoid and/or minimize these additional wetland impacts, such as steepening fill slopes, add
additional retaining walls, etc; The slope at this location has has been steepened to 2.5:1 to not impact
the wetlands
c. If it is not practicable (based on costs, logistics, technology) to avoid these additional wetland impacts,
provide justification for Corps evaluation. Note that NWP 12 cannot authorize these additional impacts
as they are not related to utility line activities. Further, NWP 29 cannot be used for these additional
impacts due to NWP 29 Regional Condition 4.1.1. Rather, NWP 18 would have to be requested if these
additional impacts can be justified; These are no longer impacts to the existing wetlands
2. Please clarify whether or not the permanent wetland impacts due to the utility line are only due to permanent
conversion from a forested wetland to an herbaceous wetland, or whether permanent above -grade fill is
proposed in these wetlands for the sewer line. See plan sheets (attached).
3. Will the entirety of the proposed sewer corridor through wetlands (all 0.087 acre) be permanently maintained,
or only a portion of it? If the latter is true, please itemize the permanent conversion corridor out from the
construction corridor on the PCN. The entirety of the proposed sewer through the wetlands will be permanently
maintained.
4. Update the "Overall Perennial Stream/Wetland Impact Map" and "Perennial Stream/Wetland Impact Map" to
clearly show (i.e. shade) the proposed wetland impacts, and provide different shading/labeling for temporary
and permanent wetland impacts. I have shaded the wetland impacts and stream impacts on the overall stream
impact sheet and, added the shading of the wetland impacts to the 2nd impact sheet. The temporary wetland
impact is from the coffer dam of the pump around method. This was counted in the temporary stream impact
instead of the wetland impact in the calculation table. If this needs to be done differently, please let me know.
5. Provide a wetland restoration plan for the proposed sewer line wetland impacts, including returning the site to
preconstruction grade/contour, backfilling the top 6-12 inches of the trench with topsoil from the trench, and
seeding with a regionally appropriate native wetland/riparian seed mix. See plan sheets (attached).
