Description of projects area and activity: This verification authorizes the permanent discharge of fill material into 20 linear feet of stream channel (not considered a loss of waters of the US), and the temporary discharge of fill material into 0.112 acre of riparian non-riverine wetlands (0.107 acre require a permanent conversion from forested to herbaceous wetlands) and 15 linear feet of stream channel, necessary for the installation of a sewer line to service the Yanceyville Apartments multi-family residential development. C-2.0, C-3.0, C-4.0, and C-4.1. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit’s expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. In addition to the wetland and stream impacts proposed for the sewer line, it appears that a fill slope and rip rap pad extends slightly into wetlands related to stormwater facility fill slopes and outlet: I have moved the rip rap and the fill slope outside of the wetlands. a. These impacts are not reported in the PCN provided, nor are that indicated on the plans provided (Sheets C-2.0, C-4.0, and C-4.1); These are no longer impacts to the existing wetlands b. It appears that additional design actions could be implemented (per NWP General Condition 23(a) and (b)) to avoid and/or minimize these additional wetland impacts, such as steepening fill slopes, add additional retaining walls, etc; The slope at this location has has been steepened to 2.5:1 to not impact the wetlands c. If it is not practicable (based on costs, logistics, technology) to avoid these additional wetland impacts, provide justification for Corps evaluation. Note that NWP 12 cannot authorize these additional impacts as they are not related to utility line activities. Further, NWP 29 cannot be used for these additional impacts due to NWP 29 Regional Condition 4.1.1.
