PROJECT DESCRIPTION
The project site is located at 4909 Fish Factory Road off of Hwy 133 adjacent to the Atlantic Intracoastal Waterway, in
Southport, Brunswick County, North Carolina. The property is located between Southport and the Oak Island Bridge on the
mainland. The property has approximately 1,472 linear ft. of shoreline.
The newly purchased portion of the marina property is a combination of parcels 2360001806, 236EB03842 and
208614438875, which encompasses 537,317 sq. ft. of land. This includes a full -service marina facility consisting of 157
permitted wet slips, bulkhead, marina office and upland spoil basin. The 4.6 acre Marina and 8.5 acre spoil pond were sold to
Safe Harbor (SMH SHV, LLC ) on September 30, 2019. The facility also includes a pump out station and fuel dock. The
existing facility consists of: A, B C and D-Docks with floating docks and finger piers within the upland basin (the end of A -Dock
also includes an existing approximately 490 linear ft. fueling dock). The property is bordered by residential housing to the
west, Duke Energy to the east, the AIWW to the south and private undeveloped land to the north. The elevation of the tract
ranges from aft. to 9 ft. above Mean High Water (MHW). There are wetlands on site, but there are no coastal wetlands within
the marina basin project area.
Former owners of the project area utilized the site as a fish processing plant and upland areas were previously part of a
remediation program until 1995. State Permit No. 31-99 was originally issued to South Harbour Village, LLC on April 8, 1999
for excavation of an upland basin (to -6 ft. at NLW), construction of a marina with shoreline stabilization, associated upland
development (including residential development) and a designated spoil site. This permit was modified on April 1, 2002 for
additional of finger piers and boatslips waterward of the existing fuel dock along with a maintenance dredging clause, The
permit was further renewed on January 3, 2003, March 14, 2005 under a Maintenance 5. Additional minor modifications were
issued on November 23, 2004 and June 28, 2006 for additional slips and again on May 19, 2009 for additional excavation to
be dredged at the end of A and D docks to a depth of — 6 ft. at NWL (NAVD88), this also included a docking facility
reconfiguration. In 2010 South Harbour Marina received a Pumpout Grant Award from the NC Marine Sewage Pumpout
Station Grant Program for installation of a pumpout onsite. A minor modification was issued on March 6, 2012 to change the
excavation methodology from bucket to barge to hydraulic dredging, this modification also included the redevelopment on the
permitted disposal area. On February 13, 2013 another minor modification was issued for installation of two silt barriers
underneath A -Dock and D -Dock and to add 4 slips on C-Dock. At this time the marina was permitted for a total of 157
formalized boatslips, although it is currently operating with 153 boatslips. An additional modification issued on April 23, 2014
authorized construction of a 25 linear ft. rip rap groin at the western end of the marina. Further authorization to raise the dike
walls and increase capacity at the designated spoil site was issued on December 12, 2014. The latest renewal was issued on
December 6, 2018 and State Permit No. 31-99 is due to expire on December 31, 2023. According to the permit file
maintenance events have occurred in 2006 and 2012. It is the intent of the current applicant to submit this new major
permit application for parcels 2360001806 (Spoil Site), 236EB03842 (Vacant Upland), 208614438875 (Marina) only, this
includes the marina basin and upland spoil site.
The waters of the AIWW in this location are classified as "SAIHQW" by the North Carolina Division of Water Resources. The
area is NOT designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is closed to the
harvest of shellfish.

The applicant is requesting a new major permit for the marina and spoil site only in order to increase the permitted dredging
depths from — 6 ft. at NLW to — 8 ft. at NLW (NAVD 88) and to expand the existing dredge footprint for future hydraulic
dredging maintenance events. According to the applicant the additional dredging depth will to reduce the frequency of
dredging events within the existing basin, which measures approximately 450 ft. long by 510 ft. wide. The proposal would
expand the existing dredge footprint to an area measuring approximately 475 ft. long by 510 ft. wide in order to connect to
deeper waters (see Sheet 3 of 4). The applicant estimates a total of 25,500 cubic yards of material would need to be removed
(based on current water depths). The application indicates that the current average existing depth is — 5 ft. at NLW (NAVD88)
and has provided a hydrographic survey for reference (see Sheet 3 of 4). The applicant states that the marina is not
proposing a dredging event at this time and all dredging will be done outside the moratorium as permitted.
The previously permitted spoil site (Parcel: 2360001806) is a triangular shaped upland spoil pond measuring approximately
550 ft. wide. This spoil site has historically been utilized for disposal of material from South Harbour Village maintenance
excavation projects. No wetlands are proposed to be impacted.
10. ANTICIPATED IMPACTS:
The project would result in an additional 2 ft. of excavation depth within the expanded dredge footprint for a total of 242,250
sq. ft. of open water impacts within Estuarine Water and Public Trust Areas. The spoil disposal on high ground would impact
up to 126,828 sq. ft. within the existing spoil site and basin.

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following application was submitted for a development permit in an Area of Environmental
Concern as designated under the CAN A: On June 30, 2020, Ralph Graham proposed to construct a vinyl
bulkhead with associated wetland fall at 2606 E. Yacht Dr., adjacent to the AIWW, in Oak Island,
Brunswick County; On July 2, 2020, Dean Stroupe proposed to install one (1) boatlift to an existing pier
at 720 Waterway Dr., adjacent to the AIWW, in Sunset Beach, Brunswick County; and on June 24,
2020, Safe Harbor (SMH SHT , LLC) proposed to increase spoil site far current permitted dredge events
and maintenance dredging in the future at South Harbor Village Marina, 4909 Fish Factory RiL,
adjacent to the AIWW, in Southport, Brunswick County. A copy of the application can be examined or

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Safe HarborlSouth
Harbour Village Marina, Inc., for State approval for a major modification at property located at 4909 Fish Factory Road,
adjacent to the Atlantic Intracoastal Waterway, within the Town of Southport, in Brunswick County. It was received complete
on June 24, 2020 and appears to be adequate for processing at this time. The projected deadline for making a decision is
September 7, 2020. An additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 24, 2020 you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be
held within five working days from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed
you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You
should post this notice at a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at
a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or

South Harbour Village Marina has a recently changed ownership. The previous owners have a
current maintenance dredge permit that allows hydraulic dredging to a depth of -6.0' elevation in
NAVD88 datum.
The new owners, SMH SHV, LLC (Safe Harbor), would like to apply for a maintenance dredge
permit to perform hydraulic dredging to an elevation of -8.0' NAVD88. This elevation would allow
better use of the marina and would reduce the frequency of maintenance dredging. The bottom
of marina dredge will slope to existing grades and the existing bulkhead at a slope of 1:5 to reduce
potential scour. The maintenance dredge footprint will increase by 20,384 square feet more than
previously approved for South Harbour Village Marina. The purpose of increasing the dredge
footprint is to reach the naturally occurring -8.0' bottom elevation. The dredge spoil will be
deposited in an onsite spoil pond that is permitted for this purpose. There are currently 153 boat
slips see dock layout.
The marina is not requesting to perform dredge operations during the hydraulic dredge
moratorium.
We reserve the right to modify our conclusions and recommendations if new information becomes
available.
