On May 21, 1997 the North Carolina Department of Transportation submitted an application for a
Nationwide 33 Permit for construction of a temporary causeway providing access for construction
of the southbound lane bridge which was issued in July 1997. On September 2, 1997 the
contractor, Gilbert Southern, contacted the Corps of Engineers with a proposal for that would
decrease the time that the causeways will be needed in the river. The crane that uses the causeway
needs to be moved from one side of the causeway, across the 120 foot opening, to the other side
approximately every 3 weeks to a month. We expect that the crane will need to be moved a
maximum of 8 times. There are two ways to do the move.
1. Method 1, which takes 3 to 4 days, involves dismantling the crane, putting it in
trucks, driving it to the other side, and reconstructing the crane at the new site.
2. Method 2, which takes about 4 hours, involves walking the crane across the 120 foot
opening in the causeway. A minimal amount of clean rip-rap will be placed on the
bottom of the river to form a more or less flat platform for the crane. After the crane is
on the other side, the rip-rap will be removed. The operators of the dam have agreed to
close the dam to the allowed minimum flows for the time period. These minimum
flows are those prescribed by the resource agencies. River crossings would not be done
during the moratorium, March 1 to June 30. In addition, if any situations arise that
preclude the dam from providing minimum flows (such as a storm or increase
need-for-power, etc.) then Method 1 will be used.

Eric Alsmeyer requested that we contact the resource agencies and request their concurrence for
using Method 2. The following agencies were contacted by telephone during the week of
September 8, 1997:
1. North Carolina Division of Marine Fisheries (NCDMFMike Street agreed to use of
Method 2 as long as the rip-rap is clean.
Response: The NCDOT commits to using clean rip-rap.
2. National Marine Fisheries Service (NMFS): Ron Sechler requested that we evaluate
obtaining a second crane instead of moving the crane. If that is not feasible then he would like to
have the opportunity to have the first move (Demonstration Move) monitored by the resource
agencies. If the result of the monitoring is positive then the NMFS will approve the remaining
moves. In addition, he would like to have the Demonstration Move video taped.
Response: The NCDOT commits to the monitoring of the Demonstration Move activity and to
the video taping of the activity. In addition we commit to using clean rip-rap. The NCDOT
Resident Engineer discussed the option of Gilbert Southern providing a second crane to the
project. Gilbert Southern did not have a second crane available for use on this project. Rental
Cranes can not be used in the drilling operations. Rental Cranes also have a problem with setting
the structural steel due to the width. The outriggers, which provide stability are wider than the
top of the causeway. Therefore use of a second crane is not feasible.
3. NC Wildlife Resources Commission (WRC): David Cox, said he requested that we
provide the opportunity to have the first move (Demonstration Move) monitored by the resource
agencies. If the result of the monitoring is positive then the WRC will approve the remaining
moves. The rip-rap must be clean. He also requested that the NCDOT provide at least 48 hours
advance notice of the Demonstration Move.
Response: The NCDOT commits to using' clean rip-rap. The NCDOT commits to the
monitoring of the Demonstration Move activity and to the video taping of the activity.
4. US Fish and Wildlife Service( Service): Mike Wicker (messages were left on his voice
mail). Ron Sechler and Frank McBride indicated that they had talked to him about the activity
and that he agreed to the use of Method 2 if the rip-rap was clean and the Demonstration Move
monitored. On September 19, 1997 Mike left a voice mail message confirming the above
information. In addition, he requested that the undercarriage of the crane be inspected for
hydraulic fluid leaks prior to contact with the river.
Response: The NCDOT commits to using clean rip-rap, the monitoring of the Demonstration
Move activity, video taping of the activity, and inspecting the undercarriage of the equipment
prior to contact with the river.

5. NC Division of Water Oualily (DIWO): Cyndi Bell also requested that we provide the
opportunity to have the first move (Demonstration Move) monitored by the resource agencies. If
the result of the monitoring is positive then the DWQ will approve the remaining moves. The
rip-rap must be clean.
Response: The NCDOT commits to using clean rip-rap. The NCDOT commits to the monitoring
of the Demonstration Move activity and to the video taping of the activity.
The Corps of Engineers has requested that after the agencies have responded all the responses
should be summarized in a letter to the Corps of Engineers with copies sent to all participants.

On May 30, 1995 the North Carolina Department of Transportation distributed a Categorical Exclusion
document for the above referenced project proposing to proceed under a Nationwide Permit in accordance
with 33 CFR Appendix A (E3-23). In October 1995, the Corps of Engineers said project impacts were
more than minimal, and that the temporary impacts associated with the emplacement of temporary
causeways in the Roanoke River would require a Nationwide Permit No. 33. All other impacts associated
with the construction of the project would qualify for a NWP 23. A permit application was submitted on
April 26, 1996 and on October 17, 1996 a NW 33 permit was issued for the temporary causeways. Several
modifications were issued pursuant to the permit.
The causeway required for construction of the northbound lane of the I-95 bridges has been completed.
The work on the northbound lane bridge associated with that causeway will be complete by the end of
June 1997. At that time, the causeway will be removed and the material used in construction of the new
causeway providing access for construction of the southbound lane bridge.
In March 1997, the Corps of Engineers identified that the temporary causeway associated with the
construction of the northbound lane resulted in unacceptable impacts on the fishery resources in the
Roanoke River. The Corps of Engineers stated that the causeway associated with the construction of the
southbound I-95 lane would need to be redesigned and that the new design should allow a greater area of
openings for fish passage and be sized to pass a greater volume of water downstream. Sheet 2a of 11
provides data on the causeways and documents that the new southbound lane causeway will fulfill the
requested design parameters.
This document is an application for a Nationwide 33 Permit for the causeway associated with the
construction of the southbound I-95 lane. In compliance with a request from the Corps of Engineers, we
are applying for a new permit instead of a modification to the existing Nationwide 33. Constriction of the

proposed causeway is depicted in the attached drawiings (Sheets 1 to 11). In the application Site I depicts
the 0.31 acres of till in surface waters in the south channel, Site II depicts the 1.17 acres of fill in the north
channel. There will be no fill in wetlands.
The causeway construction will require a total of 1.48 acres of temporary fill in surface waters. Prior to
construction, reference elevations will be taken before the causeway is built. Following construction, all
causeway material will be removed. Causeway construction is scheduled to begin in July 1997 and be
completed in approximately 4 months. The completed causeway will be in place for approximately 16
months. We estimate that the causeway will be removed by February 1999. The temporary fill area will
subsequently be restored to its original contour and rough surface texture. The temporary impact area is
expected to recover naturally, since the topsoil and seed source will not be removed. The NCDOT does
not propose any additional planting in this area.
It is anticipated that the above mentioned activities will be authorized under Section 404 Nationwide
Permit 33 (Temporary Construction Access and Dewatering). We are, therefore, requesting the issuance
of a nationwide permit authorizing construction of the causeway. We anticipate the 401 General
Certification will apply to this project, and are providing a copy of this application to the North Carolina
Department of Environment, Health and Natural Resources, Division of Water Quality, for their review.
Comments were received from the North Carolina Division of Marine Fisheries on May 1, 1995. In
compliance with the State Striped Bass Management Plan, the North Carolina Department of
Transportation will implement a construction moratorium associated with the bridge replacements from
March 1 throY-gh June 30. In addition, the NCDOT's Best Management Practices for the Protection of
Surface Waters and Sediment Control will be strictly enforced during construction of the project.

On May 30, 1995 the North Carolina Department of Transportation distributed a Categorical Exclusion
document for the above referenced project proposing to proceed under a Nationwide Permit in accordance
with 33 CFR Appendix A (B-23). In October 1995, the Corps of Engineers said project impacts were
more than minimal, and that the temporary impacts associated with the emplacement of temporary
causeways in the Roanoke River would require a Nationwide Permit No. 33. All other impacts associated
with the construction of the project would qualify for a NWP 23. A permit application was submitted on
April 26, 1996 and on October 17, 1996 a NW 33 permit was issued for the temporary causeways. Several
modifications were issued pursuant to the permit.
The causeway required for construction of the northbound lane of the I-95 bridges has been completed.
The work on the northbound lane bridge associated with that causeway will be complete by the end of
June 1997. At that time, the causeway will be removed and the material used in construction of the new
causeway providing access for construction of the southbound lane bridge.
In March 1997, the Corps of Engineers identified that the temporary causeway associated with the
construction of the northbound lane resulted in unacceptable impacts on the fishery resources in the
Roanoke River. The Corps of Engineers stated that the causeway associated with the construction of the
southbound I-95 lane would need to be redesigned and that the new design should allow a greater area of
openings for fish passage and be sized to pass a greater volume of water downstream. Sheet 2a of 11
provides data on the causeways and documents that the new southbound lane causeway will fulfill the
requested design parameters.
This document is an application for a Nationwide 33 Permit for the causeway associated with the
construction of the southbound I-95 lane. In compliance with a request,from the Corps of Engineers, we
are applying for a new permit instead of a modification to the existing Nationwide 33. Construction of the

proposed causeway is depicted in the attached drawings (Sheets 1 to 11). In the application Site I depicts 1
the 0.31 acres of till in surface waters in the south channel, Site II depicts the 1.17 acres of fill in the north
channel. There will be no fill in wetlands.
The causeway construction will require a total of 1.48 acres of temporary fill in surface waters. Prior to
construction, reference elevations will be taken before the causeway is built. Following construction, all
causeway material will be removed. Causeway construction is scheduled to begin in July 1997 and be
completed in approximately 4 months. The completed causeway will be in place for approximately 16
months. We estimate that the causeway will be removed by February 1999. The temporary fill area will
subsequently be restored to its original contour and rough surface texture. The temporary impact area is
expected to recover naturally, since the topsoil and seed source will not be removed. The NCDOT does
not propose any additional planting in this area.
It is anticipated that the above mentioned activities will be authorized under Section 404 Nationwide
Permit 33 (Temporary Construction Access and Dewatering). We are, therefore, requesting the issuance
of a nationwide permit authorizing construction of the causeway. We anticipate the 401 General
Certification will apply to this project, and are providing a copy of this application to the North Carolina
Department of Environment, Health and Natural Resources, Division of Water Quality, for their review.
Comments were received from the North Carolina Division of Marine Fisheries on May 1, 1995. In
compliance with the State Striped Bass Management Plan, the North Carolina Department of
Transportation will implement a construction moratorium associated with the bridge replacements from
March 1 through June 30. In addition, the NCDOT's Best Management Practices for the Protection of
Surface Waters and Sediment Control will be strictly enforced during construction of the project.

application for a Nationwide 33 Permit for construction of a temporary causeway providing
access for construction of the southbound lane bridge. On June 6, 1997 comments from
the US Fish and Wildlife Service (Service) dated June 6, 1997 were transmitted to the
NCDOT by the Corps of Engineers. This letter transmits our responses and consists of two
drawings depicting cross sections of the Roanoke River and a memorandum providing
technical analysis of the subjects addressed by the Service.

Enclosed are the responses to the six items requested by Mr. Hefner.
1. Cross-sectional profile of the Roanoke River at the subject location with and without
the weir, showing the water level at 14,000, 20,000, and 24,000 cfs for both cross-
sections.
If Mr. Hefner means cross-section of the river, then see attached.
The elevations are different because divided flow is occurring at the bridges.
2. The velocity associated with one, two, and eight feet of vertical head on either side of
the weir at 20,000 cfs.

5. Clear and concise schematics with which any observer can determine whether the weir
is being constructed to specifications and in compliance with permit conditions.

6. A proposal for immediate remedial activities, including the instantaneous removal of
the weir should more than two feet of head form at the site.
This request is not a practical solution. The velocities generated by two feet of head
would make it dangerous to the machine operators to remove the causeway.
In addition to the six items Mr. Hefner asked be provided, it is felt that some of his
statements in the June 6, 1997 letter also be addressed.
1. We do not feel that the technique used to construct the northbound bridge causeway
was grossly inadequate. The causeway was designed to handle the maximum average
flow (8500 cfs) from the Roanoke Rapids dam. At that time we could not anticipate flows
occurring at 20,000 cfs and above for so long a period of time. Even if we had, we would
not have designed the causeway for maximum flows.
2. The use of barges to construct the proposed bridges is not practicable. The river
bottom at this location is extremely rocky and barges could not reach many of bents
during low flows. During high flows, velocities would not allow drilling from a barge
practicable.
3. Mr. Hefner states that the northbound weir was not constructed to design. The
northbound causeway was constructed according to design. The original design was
modified due to unexpected high discharges after construction started. The changes were
approved by the CORPS.
4. We feel the permit for the southbound causeway does contain sufficient dimensioning
to determine if the causeway is being built to design. The only way to verify this is
measure the causeway after construction.

4. Documentation that the hydrologic model was verified and/or calibrated for this site
based on the data collected this spring.
If Mr. Hefner means the hydraulic model, every attempt possible was made to calibrate the
WSPRO model to match the conditions that have occurred in the existing causeway.
However, the limitations of the modeling program do not make it practicable to match the
existing conditions because of the hydraulic jump that occurred. The proposed causeway
was also modeled using WSPRO and every effort was made to create the best possible
model.

On May 21, 1997 the North Carolina Department of Transportation submitted an application for a
Nationwide 33 Permit for construction of a temporary causeway providing access for construction
of the southbound lane bridge which was issued in July 1997. On September 2, 1997 the
contractor, Gilbert Southern, contacted the Corps of Engineers with a proposal for that would
decrease the time that the causeways will be needed in the river. The crane that uses the causeway
needs to be moved from one side of the causeway, across the 120 foot opening, to the other side
approximately every 3 weeks to a month. We expect that the crane will need to be moved a
maximum of 8 times. There are two ways to do the move.
1. Method 1, which takes 3 to 4 days, involves dismantling the crane, putting it in
trucks, driving it to the other side, and reconstructing the crane at the new site.
2. Method 2, which takes about 4 hours, involves walking the crane across the 120 foot
opening in the causeway. A minimal amount of clean rip-rap will be placed on the
bottom of the river to form a more or less flat platform for the crane. After the crane is
on the other side, the rip-rap will be removed. The operators of the dam have agreed to
close the dam to the allowed minimum flows for the time period. These minimum
flows are those prescribed by the resource agencies. River crossings would not be done
during the moratorium, March 1 to June 30. In addition, if any situations arise that
preclude the dam from providing minimum flows (such as a storm or increase
need-for-power, etc.) then Method 1 will be used.

Eric Alsmeyer requested that we contact the resource agencies and request their concurrence for
using Method 2. The following agencies were contacted by telephone during the week of
September 8, 1997:
1. North Carolina Division of Marine Fisheries (NCDMFMike Street agreed to use of
Method 2 as long as the rip-rap is clean.
Response: The NCDOT commits to using clean rip-rap.
2. National Marine Fisheries Service (NMFS): Ron Sechler requested that we evaluate
obtaining a second crane instead of moving the crane. If that is not feasible then he would like to
have the opportunity to have the first move (Demonstration Move) monitored by the resource
agencies. If the result of the monitoring is positive then the NMFS will approve the remaining
moves. In addition, he would like to have the Demonstration Move video taped.
Response: The NCDOT commits to the monitoring of the Demonstration Move activity and to
the video taping of the activity. In addition we commit to using clean rip-rap. The NCDOT
Resident Engineer discussed the option of Gilbert Southern providing a second crane to the
project. Gilbert Southern did not have a second crane available for use on this project. Rental
Cranes can not be used in the drilling operations. Rental Cranes also have a problem with setting
the structural steel due to the width. The outriggers, which provide stability are wider than the
top of the causeway. Therefore use of a second crane is not feasible.
3. NC Wildlife Resources Commission MC): David Cox, said he requested that we
provide the opportunity to have the first move (Demonstration Move) monitored by the resource
agencies. If the result of the monitoring is positive then the WRC will approve the remaining
moves. The rip-rap must be clean. He also requested that the NCDOT provide at least 48 hours
advance notice of the Demonstration Move.
Response: The NCDOT commits to using clean rip-rap. The NCDOT commits to the
monitoring of the Demonstration Move activity and to the video taping of the activity.
4. US Fish and Wildlife Service( Service): Mike Wicker (messages were left on his voice
mail). Ron Sechler and Frank McBride indicated that they had talked to him about the activity
and that he agreed to the use of Method 2 if the rip-rap was clean and the Demonstration Move
monitored. On September 19, 1997 Mike left a voice mail message confirming the above
information. In addition, he requested that the undercarriage of the crane be inspected for
hydraulic fluid leaks prior to contact with the river.
Response: The NCDOT commits to using clean rip-rap, the monitoring of the Demonstration
Move activity, video taping of the activity, and inspecting the undercarriage of the equipment
prior to contact with the river.

5. NC Division of Water Quality (DWQ): Cyndi Bell also requested that we provide the
opportunity to have the first move (Demonstration Move) monitored by the resource agencies. If
the result of the monitoring is positive then the DWQ will approve the remaining moves. The
rip-rap must be clean.
Response: The NCDOT commits to using clean rip-rap. The NCDOT commits to the monitoring
of the Demonstration Move activity and to the video taping of the activity.
The Corps of Engineers has requested that after the agencies have responded all the responses
should be summarized in a letter to the Corps of Engineers with copies sent to all participants.

The Corps of Engineers has requested that after the agencies have
responded I should put all the responses in a letter/telecon memo to Eric
Alsmeyer, send copies to all participants, and then Eric will approve the
activity.

You have our approval, in accordance with the attached conditions, to place temporary fill in 0.47 acres
of wetlands or waters for the purpose of rehabilitating a portion of I-85, as you described in your application
dated 29 January 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3114. This certification allows you to use Nationwide Permit Number
33 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

On May 30, 1995 the North Carolina Department of Transportation distributed a
Categorical Exclusion document for the above referenced project proposing to proceed
under a Nationwide Permit in accordance with 33 CFR Appendix A (B-23). On April'-16,
1996 we submitted applications for a Nationwide Permit No. 33 to the Corps of Engineers
and a Section 401 to the North. Carolina Division of Environmental Management for
construction of a temporary causeway. Both permits were issued. In November 1996 an
application for modification of the NW 33 permit was submitted and subsequently issued by
the Corps of Engineers.
We are now requesting an additional modification to the 33 p mit and the Section 401
Water Quality Certificate. We need to increase the height f the useway because more
water is being released from the Tar Dam, located upstrea` m the project, than was
anticipated when the elevation and design of the causeway were determined. This action
may increase the footprint of the causeway in the Roanoke River. The contractor will
attempt to raise the elevation of the causeway without increasing the footprint but this may
not be possible. Therefore, we are requesting this modification to allow additional
temporary fill in surface waters.
The additional causeway construction will result in an additional 0.47 acres of temporary fill
in Waters of the United States. The material will consist of approximately 6000 tons of
Class 11 riprap.

The restoration plan described in the original NW 33 application will remain in effect.
Following construction, all causeway material will be removed. The causeway will be in
place until June 15, 2000. The temporary fill area will subsequently be restored to its
original contour and rough surface texture. The temporary impact area is expected to
recover naturally, since the topsoil and seed source will not be removed. The NCDOT does
not propose any additional planting in this area. In addition, we will continue to implement
the construction moratorium associated with the bridge replacements from March 1 through
June 30.
It is anticipated that the above mentioned activities will be authorized under Section 404
Nationwide Permit 33 (Temporary Construction Access and Dewatering). We are,
therefore, requesting the issuance of this modification to the existing Nationwide Permit 33
to authorize the adjustment of causeway. By copy of this letter, it is also requested that the
appropriate General Water Quality Certification be issued by the North Carolina Division of
Water Quality.

Interstate 95, Federal Aid Project IR-95-3(55)172, State Project No. 8.1300501,

On May 30, 1995 the North Carolina Department of Transportation distributed a
Categorical Exclusion document for the above referenced project proposing to proceed under a
Nationwide Permit in accordance with 33 CFR Appendix A (B-23). In October 1995, the Corps
of Engineers said that the temporary impacts associated with the emplacement of a temporary
causeway in the Roanoke River would require a Nationwide Permit No. 33 and that all other
impacts associated with the construction of the project would qualify for a NWP 23.
On April 26, 1996 we submitted an application for a Nationwide Permit No. 33 to the
Corps of Engineers and a Section 401 to the North Carolina Division of Environmental
Management. The 401 Permit (copy enclosed) was issued on May 17, 1996. It has come to our
attention that the 30 day review period which commenced when the application was received by the
Corps of Engineers has now expired. We have not received any written correspondence on this
project. Therefore, under the notification requirements of the Corps of Engineers, the NCDOT is
assuming that the project is authorized under Section 404. We thus intend to proceed with the
project and initiate construction activities.

Dear Mr. Vick:
You have our approval to place fill material in 0.2 acres of wetlands or waters for the purpose of
replacing a bridge utilizing a temporary causeway at I-95 and Roanoke River, as you described in
your application dated 26 April 1996. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 2727. This certification allows you to use
Nationwide Permit Number 33 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE
FOR CORPS OF ENGINEERS NATIONWIDE PERMIT NUMBER 33 (TEMPO-
RARY CONSTRUCTION, ACCESS AND DEWATERING)
This General Certification is issued in conformity with the
requirements of Section 401, Public Laws..92-500 and 95-217 of the
United States and subject to the North Carolina Division of Envi-
ronmental Management Regulations.in 15A:NCAC 2H, Section-.0500
and 15A NCAC 2B .0109 and .0201 for the discharge of fill mate-
rial to waters and wetland areas as* described in 33 CFR 330
Appendix A (B) (33) of the Corps of Engineers regulations (i.e.,
Nationwide Permit No. 33).The category of activities shall
include any fill activity for temporary construction, access and
dewatering.
The State of North Carolina certifies that the specified
category of activity will not violate Sections 301, .302, 303, 306
and 307 of the Public.Laws.92-500 and 95-217 if conducted in
accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. Proposed fill or substantial modification of waters or
wetlands for this General Certification requires written
concurrence from the Division of Environmental Manage-
ment
2. "That established sediment and erosion control practices
are utilized to prevent violations of the appropriate'
turbidity water quality standard (50 NTUs in streams and
rivers not designated as trout waters by DEM; 25 NTUs in
all saltwater classes, and all lakes and reservoirs; and
10 NTUs in trout waters);
3. That additional site-specific conditions may be added to
projects proposed under this Certification in order to
ensure compliance with all applicable water quality and
effluent standards;
4. Concurrence from DEM that this Certification applies to
an individual project shall expire three years from the
date of the cover letter from DEM.
Non-compliance with or violation of the conditions herein set
forth by a specific fill project shall result in revocation of
this Certification for the project.
The Director of the North Carolina Division of Environmental
Management may require submission of a formal application for
individual certification for any project in this category of
activity, if it is determined that the project is likely to have
a significant adverse effect upon water quality or degrade the
waters so that existing uses of the wetland or downstream waters
are precluded.
Public hearings may be held for specific applications or
group of applications prior to a Certification'decisidn if deemed
in the public's best interest by ti-,e Director of the North Caro-
Tina Division of Environmental Management.

You have our approval to place fill material in 0.2 acres of wetlands or waters for the purpose of
replacing a bridge utilizing a temporary causeway at I-95 and Roanoke River, as you described in
your application dated 26 April 1996. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 2727. This certification allows you to use
Nationwide Permit Number 33 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.

GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE
FOR CORPS OF ENGINEERS NATIONWIDE PERMIT NUMBER 33 (TEMPO-
RARY CONSTRUCTION, ACCESS AND DEWATERING)
This General Certification is issued in conformity with the
.requirements of Section'401, Public Laws_92-500.and 95-217 of the
United States and subject to the North Carolina Division of Envi-
ronmental Management Regulations. in 15A•-NCAC 2H, Section-.0500
-and 15A NCAC 2B .0109 and .0201 for the discharge of fill mate-
rial to waters and wetland areas as' described in 33 CFR 330
Appendix A (B) (33) of the Corps of Engineers regulations (i.e.,
Nationwide Permit No. 33).The category of activities shall
include any fill activity for temporary*const-ruction, access and
dewatering.
The State of North Carolina certifies that the specified
category of activity will not violate Sections 301, .302, 303, 306
and 307 of the Public.Laws. 92-500 and 95-217 if conducted in
accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. Proposed fill or substantial modification of waters or
wetlands for this General Certification requires written.
concurrence from the Division of Environmental Manage-
ment.
2. 'That established sediment and erosion control practices
are utilized to prevent violations of the appropriate'
turbidity water quality standard (50 NTUs in streams and
rivers not designated as trout waters by DEM; 25 NTUs in
all saltwater classes, and all lakes and reservoirs; and
10 NTUs in trout waters);
3. That additional site-specific conditions may be added to
projects proposed under this Certification in order to
ensure compliance with all applicable water quality and
effluent standards;
4. Concurrence from DEM that this Certification applies to
an individual project shall expire three years from the
date of the cover letter from DEM.
Non-compliance with or violation of the conditions herein set
forth by a specific fill project shall result in revocation of
this Certification for the project.
The Director of the North Carolina Division of Environmental
Management may require submission of a formal application for
individual certification for any project in this category of
activity, if it is determined that the project is likely to have
a significant adverse effect upon water quality or degrade the
waters so that existing uses of the wetland or downstream waters
are precluded.
Public hearings may be held for speci-ic applications or
group of applications prior to a Certification decision if deemed
in 'Che public' s best interest by tile Director of the North Carc-
lina Division of Environmental Management.

On May ,3 , 1995 e North Carolina Department of Transportation distributed a
Categorical Excl sion cument for the above referenced project pro proceed
under a Nationwi a ermit in accordance with 33 CFR Appendix (B-23). October
1995, the Corps of Engineers said project impacts we tha ini , and that the
temporary impacts associated with the emplacem t of a temp rary causeway in the
Roanoke River would require a Nationwide =?it No. 33. other impacts associated
with the construction of the project would q23.
'Th new brid cannot be constructed without the placement of the temporary
causeway to pr construction access to the Roanoke River. Construction of the
proposed causeway is depicted in the attached drawings (Sheets 1 to 17).
The causeway construction will require 0.2 acres of permanent fill in
jurisdictional wetlands and 2.76 acres of temporary fill in Waters of the United States.
Prior to construction, reference elevations will be taken before the causeway is built.
Following construction, all causeway material will be removed. The causeway will be in
place for approximately 3.5 years. The temporary fill area will subsequently be restored
to it -nal- r and rough surface texture. The temporary impact area is expected
t recover natur ' ince the topsoil and seed source will not be removed. The
N owes not propose any additional planting in this area.
It is anticipated that the above mentioned activities will be authorized under
Section 404 Nationwide Permit 33 (Temporary Construction Access and Dewatering).
We are, therefore, requesting the issuance of a nationwide permit authorizing

construction of the causeway. By copy of this letter, it is also requested that the
appropriate General Water Quality Certification be issued by the North Carolina Division
of Environmental Management.
By copy of this letter. we are also requesting comments from the U.S. Fish and
Wildlife Service and the National Marine Fisheries Service regarding the presence of any
federally listed or proposed threatened or endangered species or critical habitat.
Comments were received from the North Carolina Division of Marine Fisheries on May
1, 1995. In compliance with the State Striped Bass Management Plan, the North
Carolina Department of Transportation will implement a construction moratorium
associated with the bridge replacements from March 1 through June 30. In addition, the
NCDOT's Best Management Practices for the Protection of Surface Waters and
Sediment Control will be strictly enforced during construction of the project.
