Dear Mr. Vick:
You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of
replacing Bridge No. 202 over SR 1325, as you described in your application dated 26 January 1996.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

SUBJECT: Pender County, Replacement of Bridge No. 202 over Sills Creek on
SR 1325, NCDOT bridge maintenance project.
The N.C. Department of Transportation (NCDOT) is proposing to replace Bridge
No. 202 in Pender County, which is on SR 1325 over Sills Creek near Penderlea. This
work is being done as part of the NCDOT's bridge replacement program. The existing
bridge will be replaced with a longer new bridge. It is expected that the road will be
closed during construction, thereby eliminating the need for an on-site detour. It is
anticipated that this project will not require the placement of fill in wetlands or waters of
the United States.
It is anticipated that this project can be authorized under Nationwide Permit No.
for maintenance activities. Attached you will find a completed pre-discharge notification
form and drawings which depict the proposed bridge. Please review this project for
authorization under the Clean Water Act. By copy of this information, the NCDOT
requests that the N.C. Division of Environmental Management review the proposed
project for Water Quality Certification. If you need any additional information, please
