The Division of Water Quality (DWQ) 401 Oversight and Express Review Permitting Unit has
received the Year 1 Monitoring report for the above-referenced mitigation site. Based on the
data presented in the report, the site appears to have met the success criteria for both stream and
wetland mitigation. DWQ recommends close monitoring of the area around vegetation plot VP-
4, as it appears this area may be too wet to support woody vegetation.
However, DWQ requests clarification of the total amount of restored, created, enhanced and
preserved wetland areas on this site. According to the Conceptual Stream and Wetland
Restoration for Newell Farm Project (S&EC Project No. 102LD1), dated February 2006,
Technical Specifications for Newell Farm Stream and Wetland Restoration (S&EC Project No.
1021.D3), and Construction Drawings for Newell Farm Stream and Wetland Restoration (S&EC
Project No. 1021.D3) dated August 2006, the proposed mitigation site was to result in 5.1 acres
of wetland restoration, 4.7 acres of wetland creation, 3.6 acres of wetland enhancement, and 6.2
acres of wetland preservation, totalling 19.6 acres of wetland mitigation.
According to Condition 6 of the 401 Water Quality Certification dated October 3, 2006,
compensatory mitigation required for the Wake Stone Quarry Expansion was "19.6 (acres)
combined restoration, creation, enhancement and preservation".
According to the Year 1 Monitoring Report, total wetland mitigation provided at the Newell
Farm site is listed as 18.55 acres.

Please provide documentation that the total wetland acreage required for mitigation, as
stated in Condition 6 of the 401 Water Quality Certification, had been reduced by the
regulatory agencies (U.S. Army Corps of Engineers and/or DWQ).
