We are in urgent need to utilize some of the sand off the outer slope of that dike, as was described in the original breach application, and hope that we can get the official approval letter from DEMLR as soon as possible. If there are any issues, please let me know. Furness 1530 NC Hwy 306 South Aurora, North Carolina 27806 RE: PCS Phosphate R-3 Dike Approval of Breach Construction Beaufort County State Dam ID: BEAUF-016 Dear Mr. Furness: This concerns the subject dam recently breached pursuant to the Approval to Breach dated July 25, 2014, as required by the Dam Safety Law of 1967. Record Drawings and the engineer's certification were received on February 12, 2016. The completed work was certified by Mr. Robert M. Chiles, PE. Also, Check No. 10411251 in the amount of $14,320.64 serving as the additional application processing fee was received on February 17, 2016. An inspection of the completed work was made by Land Quality Section staff of the Washington Regional Office on March 17, 2016. The work was found to be in general conformance with the approved plans and specifications. This letter constitutes final approval of the work to breach the subject dam. The Land Quality Section staff will make periodic inspections of the remains of this dam to verify that the remains are not capable of impounding water and are therefore exempt from the Dam Safety Law of 1967. Please continue to monitor the breach channel to ensure that it does not become blocked with debris and cause the impoundment of water. Please note that this letter does not relieve the dam owner from its obligation to comply with other applicable regulations. You should contact the US Army Corps of Engineers, the NCDEQ Division of Water Resources, the NCDEQ DEMLR Mining Program, and other regulatory agencies as appropriate to determine other permit requirements.
