Atlas conducted a pedestrian survey for potential Waters of the United States on October 3, 2019 and assessed the presence of five non -wetland features. No wetland or open water were observed to exist within the review area. One stream impact is required for a perpendicular road crossing over channel CH 100. Grading and side slopes will also impact CH 300. Total impacts for the development of the property are 148 linear feet. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Only one road crossing is being required for the development of the property due to channel CH 100 bisecting the property. All other aquatic resources (CH 2O0, CH 400, and CH 500) will not be impacted. Due to the shape of the property, the property setbacks, and stream buffers the crossing of CH 100 at CH 300 is required. All Impacts (S1, S2, and S3) are proposed at locations where the channel is highly entrenched and degraded. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Impacts are being avoided by construction techniques by the addition of headwalls to the upper and lower ends of the culvert crossing of CH 100. The use of these headwalls is lowering the amount of required impact to the channel from side -slope fill. Over 85% of the streams on site will be avoided. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the proposed project would consist of a residential development on approximately 39 acres in Terrell, North Carolina. Onsite habitats consist of successional forest, forested riparian areas, and transitional edge habitats adjacent to developed open spaces. Site development plans have not been provided at this time. However, your correspondence indicates that unnamed tributaries to Beaverdam Creek occur onsite and that the proposed work may require authorization from the U.S. Army Corps of Engineers. Federallv Listed Endangered and Threatened Species Suitable summer roosting habitat may be present in the project area for the federally threatened northern long-eared bat (Myotis septentrionalis). However, the final 4(d) rule (effective as of February 16, 2016), exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31). Based on the information provided, the project (which may or may not require tree clearing) would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule. Although not required, we encourage you to avoid any associated tree clearing activities during this animal's maternity roosting season from May 15 — August 15. Your correspondence indicated that surveys were conducted during the optimal survey window for the federally endangered Schweinitz's sunflower (Helianthus schweinitzii), but this species Page 22 of 25 was not detected onsite at that time. Although survey efforts detected Hexastylis arifolia onsite,' evidence of its congeners (including the federally threatened dwarf -flowered heartleaf (Hexastylis naniflora) were not detected. Based on these negative survey results we do not have any concerns for project -mediated impacts to these or any other federally protected species and we require no further action at this time. Please be aware that obligations under section 7 of the Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. We offer the following general recommendations on behalf of natural resources: Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground -disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native grass and tree species as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly, preferably by the end of the workday. Natural fiber matting (coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose. Low Impact Development The Service is concerned about the potential stormwater-mediated impacts to streams and wetlands onsite. Where detention ponds are used, storm -water outlets should drain through a vegetated area prior to reaching any natural stream or wetland area. Detention structures should be designed to allow for the slow discharge of storm water, attenuating the potential adverse effects of storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges. Since the purpose of storm -water -control is to protect streams and wetlands, no storm -water -control measures or best management practices should be installed within any stream (perennial or intermittent) or wetland. We recommend that retention ponds be located at least 750 feet from small wetlands to minimize hydrologic disturbance and ecological function. We also recommend that consideration be given to the use of pervious materials (i.e., pervious concrete, interlocking/open paving blocks, etc.) for the construction of roads, driveways, sidewalks, etc. Pervious surfaces minimize changes to the hydrology of the watershed and can be used to facilitate groundwater recharge. Pervious materials are also less likely to absorb and store heat and allow the cooler soil below to cool the pavement. Additionally, pervious concrete requires less maintenance and is less susceptible to freeze/thaw cracking due to large voids within the concrete. 1 Photographs provided in the Applicant's biological evaluation demonstrate diagnostic leaf characteristics of the species Hexastylis arifolia. Page 23 of 25 Riparian and Wetland Buffers Natural, forested riparian buffers are critical to the health of aquatic ecosystems. They accomplish the following: 1. catch and filter runoff, thereby helping to prevent nonpoint-source pollutants from reaching streams; 2. enhance the in -stream processing of both point- and nonpoint-source pollutants; 3. act as "sponges" by absorbing runoff (which reduces the severity of floods) and by allowing runoff to infiltrate and recharge groundwater levels (which maintains stream flows during dry periods); 4. catch and help prevent excess woody debris from entering the stream and creating logjams; 5. stabilize stream banks and maintain natural channel morphology; 6. provide coarse woody debris for habitat structure and most of the dissolved organic carbon and other nutrients necessary for the aquatic food web; and 7. maintain air and water temperatures around the stream. Please bear in mind that impervious surfaces, ditches, pipes, roads, utility lines (sewer, water, gas, transmission, etc.), and other infrastructures that require maintained, cleared rights -of -way and/or compromise the functions and values of the forested buffers should not occur within these riparian areas. Pollinator Habitat Pollinators, such as most bees, some birds and bats, or other insects, including moths and butterflies, play a crucial role in the reproduction of flowering plants and in the production of most fruits and vegetables. Over 75 percent of flowering plants and about 75 percent of crops are pollinated by these animals. Although not required, we encourage the Applicant to consider our recommendations below to benefit pollinators. Moreover, the creation and maintenance of pollinator habitats at this site may increase the value of the project for the community and help reduce the spread of invasive exotic plants. Please consider the following: 1. Sow native seed mixes in disturbed areas or in designated pollinator areas with plants that bloom throughout the entire growing season. 2. Taller growing pollinator plant species should be planted around the periphery of the site and anywhere on the site where mowing can be restricted during the summer months. Taller plants, left un-mowed during the summer, would provide benefits to pollinators, habitat to ground nesting/feeding birds, and cover for small mammals. 3. Low growing/groundcover native species should be planted in areas that need to be maintained. This would provide benefits to pollinators while also minimizing the amount of maintenance such as mowing and herbicide treatment. Milk weed species are an important host plant for monarch butterflies. 4. Avoid mowing of flowering plants. Designated pollinator areas show be mow only 50% of the plant height, but no lower than 8 inches. Page 24 of 25 5. Avoid mowing outside the active season for rusty -patched bumble bee and other pollinators (April 15 — October 15). 6. Leave slash piles, mulch piles, or loose dirt piles along woodland edges. These areas provide nesting habitats and/or nest materials for some pollinators. 7. Avoid the use of pesticides and specifically neonicotinoids. 8. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable.
