On June 14, 2007, the Division of Water Quality (DWQ) received your Individual State
Stormwater Permit as part of your site development. As this project is not subject to the
Individual State Stormwater Permit requirements, we believe that this was submitted to
meet the 401 Water Quality Certification requirement that a stormwater plan be
reviewed by, and approved by the 401 Central Office staff in Raleigh prior to beginning
any work under a 401 Water Quality Certification. As such, this office will forward your
plan to the Central Office staff for review and processing.
As you have no authorization under Section 401 of the Clean Water Act for this activity,
and work within waters of the state would be a violation of North Carolina General
