Box 25201 Raleigh, NC 27611-5201 Dear Mr. Vick: You have our approval to place fill material in 400 square feet of wetlands or waters for the purpose of replacing a bridge at SR 1152, Bridge #59, as you described in your application dated 11 April 1996. After reviewing your application, we have decided that this fill is covered by General Water QualityCertification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. . If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to replace an existing ± 19' wide by ±70' long bridge with a ±24' wide by ±90' long bridge. NC DOT Bridge #59 Hertford County Project setting The N. C. Department of Transportation (NC DOT) proposes to replace bridge #59 located on SR 1152 crossing Cutawhiskie Swamp east of Ahoskie in Hertford County, North Carolina. The existing bridge is ± 19' wide and ±70' long and has a navigable vertical clearance of ±6' measured to the normal water level (NWL). The stream is ±40' wide at the bridge crossing and the existing navigable width is t 15' on either side of the center bent. The bridge is bordered on both sides by wooded wetlands vegetated with gum, tupelo, maple, bays, and woody vines. The wooded wetland on the downstream (north) side has been logged in recent years and is revegetating with the same species mentioned above. The wooded wetland vegetation gives way to upland grasses on the road shoulder. This section of Cutawhiskie Swamp has been channelized and an ± 10' wide spoil bank is present on both sides of the stream. Cutawhiskie Swamp is classified as C-NSW by the Environmental Management Commission and is not open to shell fishing. Project description NC DOT proposes to replace an existing ±19' wide by ±70' long bridge with an approximately 24' wide by ±90' long bridge. The existing bridge which has 5 bents will be removed and replaced with a new bridge which has 4 bents. Approximately 966 ft2 of high ground (existing approach fill) will be removed which will increase the horizontal opening under the bridge from ±70' to ±90'. The removal of the existing center bent will increase the navigable width from ± 15' to ±25' . The existing vertical clearance of ±6' will be reduced by 0.6' to 5.4' measured to the NWL. Moving the end bents landward will result in the placement of ±400 ft2 of fill in 404 designated wetlands in order to maintain access to the existing spoil banks for future maintenance. Anticipated impacts The project as proposed would result in the excavation of ±1,386 ft2 of high ground. The existing bridge has a navigable opening between existing bents of ± 15' wide with a vertical clearance of ±6'. The proposed bridge will have a opening of ±25' wide with a vertical clearance of ±5.4' which will enhance navigability while slightly lowering the existing vertical clearance. The existing bridge width of ± 19' will be increased with the new bridge to ±24' . Approximately 400 ft2 of 404 designated wetlands will be filled to maintain access to the existing spoil banks. (2) thru (6) Some of the excavated material, depending on its suitability, may be targetted for required project fills. However, it is reasonable to predict that some undesirable material will result from excavation. This material will be removed by the contractor to a suitable off-site upland. More than likely the site will be privately-owned and the owner has granted the contractor permission to deposit the excess spoil. The North Carolina Department of Transportation requires the contractor to submit candidate spoil disposal areas to the project inspector for approval by the Department. The Department prohibits its contractors from using any wetland or surface water for the deposition of spoil.
