This project (CD94-19) was found to be consistent with the North Carolina Coastal Management Program (North Carolina Division of Coastal Management [NCDCM] letter:: dated July 20, 1994, and March 31, 1995) and received 401 Water Quality Certification No. 2667 issued by the North Carolina Division of Water Quality (NCDWQ) on October 30, 1996, for the Corps of Engineers Nationwide Permit No. 15 (U.S. Coast Guard Approved Bridges). The construction contractor has identified the need for additional temporary construction access (described below) that was not considered during the permit process. This temporary access will be constructed within the existing bridge right-of-way. We consider this work to be minor in scope and incidental to the bridge construction. We have determined that the project modification, as described below, is required to facilitate the bridge construction and would not cause significant environmental impact or additional obstruction to navigation. We would like your agency to amend your consistency determination, as needed, to address this action. Our construction contractor has determined that to allow for transportation of construction cranes across the waterway and to deliver required supplies by barge, two temporary sheet pile bulkheads (one on each shore) are required to serve as a barge landing. The contractor's plan (enclosed) includes construction of two 70-foot-long sheet pile structures. This action will require the placement of about 110 cubic yards of fill material behind each bulkhead. All of this fill material will be placed below normal high water and about 0.03 acre of shallow water bottom will be temporarily filled. Any wetlands that would be impacted are located within the existing cleared construction right-of-way. After construction is complete, the sheet piles would be removed and pre- project contours would be restored to the degree practical. -2- The contractor has considered the use of a pier-supported structure and determined it to be impractical for this application, since it would lack the durability needed to safely support operation of both a 110-ton crane and 250-ton crane with repeated barge landings over a 36-month construction period. Large quantities of concrete girders up to 90 feet in length and 75-foot by 24-inch concrete piles would be loaded from these structures. Since the need for this temporary bulkheading was not known during the permit process, the bridge permit (Section 9 of the River and Harbor Act of 1899) from the U.S. Coast Guard and the Corps of Engineers Nationwide Permit No. 15 did not consider this action. We are concurrently requesting that the U.S. Coast Guard amend their existing bridge permit to include the proposed action and that the NCDWQ amend its 401 Water Quality Certificate. The proposed activity is within the North Carolina coastal area. We have determined that impacts from this action are temporary and minor, and that the proposed action is compatible with the Land Use Plan for Hyde County and consistent with the approved Coastal Management Program of the State. We are aware that a consistency determination pursuant to 15 CFR 930 must be provided to the NCDCM at least 90 days before the onset of the proposed activity. The bridge construction is underway. We request that the 90-day notification period be waived. Please provide your agency's response by April 13, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant is proposing to replace an existing bridge with a corrugated, anodized aluminum box culvert and remove an existing boat house adjacent bridge in the same canal. NC Department of Transportation Modified Bridge #28 Replacement Project Swan Quarter, Hyde County Project setting The NC Department of Transportation's (NCDOT) proposed bridge replacement site is located on SR 1128 at Bridge No. 28 crossing an unnamed canal at its confluence with Oyster Creek near Swan Quarter in Hyde County, North Carolina. Bridge #28 measures ±32 ft long by 26 ft wide with ±1.2 ft of clearance between the bottom of the bridge and the water's surface. The width of the canal in the project area is ±28 ft. A fish house is situated along Oyster Creek near the bridge to the southwest. The areas immediately adjacent the bridge are primarily vegetated with fescue and Bermuda grass with some Spartina patens interspersed throughout. Oyster Creek is classified as SA ORW waters by the Environmental Management Commission. Oyster Creek is designated as Coastal Waters and a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. Although this area is designated as a PNA, it is closed to shell fishing. Project description NC DOT's proposal is to replace Bridge #28, which is described above. The project as proposed is to muck out or undercut an area approximately 60 ft x 30 ft and then fill the same area to provide a bedding surface for the installation of a 24 ft wide by 60 ft long aluminum box culvert. Prefabricated aluminum head walls are proposed at each end of the culvert to retain the fill and for shoreline stabilization. The area of the proposed excavation and filling below normal water level would affect approximately 1,800 ft' of canal bottom. The area of adjacent high ground proposed to be excavated is approximately 30 ft wide by 60 ft long (1,800 ft') while the applicant will fill an area approximately 32 ft wide by 60 ft long (1,920 ft) for the roadway embankment. The spoil material associated with the mucking out activity will be transported to a high ground disposal site. Anticipated impacts NC DOT's proposed project would result in the excavation and backfill of approximately 1,800 ft2 of canal bottom to create a bed for the proposed box culvert. The culvert would shade a 1,440 ft2 area of canal bottom and reduce the width of the canal by approximately 3 ft. The total area of high ground that would be disturbed is ±1,920. Enclosed are revised MP-1 and MP-5 application forms and a set of drawings depicting the new design, a corrugated, anodized aluminum box culvert (in lieu of a pipe arch). Note that the proposed box culvert will provide for almost the same water column cross- section as the existing bridge. The only difference is that approximately 5.5 feet of shallow water (<1.0 feet deep) habitat, measured at normal water elevation, will be eliminated by replacing the bridge with the box culvert. As can be seen on sheet 3 of 3 of the attached drawings, the floor of the box culvert will be countersunk to provide for a natural stream bed. NC Department of Transportation Bridge #28 Replacement Project Swan Quarter, Hyde County Project setting The NC Department of Transportation's (NCDOT) proposed bridge replacement site is located on SR 1128 at Bridge No. 28 crossing an unnamed canal at its confluence with Oyster Creek near Swan Quarter in Hyde County, North Carolina. Bridge #28 measures +32' long by 26' wide with f2.5' of clearance between the bottom of the bridge and the water's surface. A f 12' wide by f 14' long boat house is situated on the downstream side of the existing bridge and sits approximately 5' from the bridge along the east `side of the canal. A fish house is situated along Oyster Creek near the bridge to the southwest. The areas immediately adjacent the bridge are primarily vegetated with fescue and Bermuda grass with some Spartina patens interspersed throughout. Oyster Creek is classified as SA ORW waters by the Environmental Management Commission. Oyster Creek is designated as Coastal Waters and a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. Although this area is designated as a PNA, it is closed to shell fishing. Project description NC DOT's proposal is to replace Bridge #28, which is described above. The project as proposed is to muck out or undercut an area approximately 70'X 30' and then fill the same area to provide a bedding surface for the installation of three 95" (or 7.9') wide by ±67' long metal culverts. NC Department of Transportation Bridge #28 Replacement Project Swan Quarter, Hyde County Project setting The NC Department of Transportation's (NCDOT) proposed bridge replacement site is located on SR 1128 at Bridge No. 28 crossing an unnamed canal at its confluence with Oyster Creek near Swan Quarter in Hyde County, North Carolina. Bridge #28 measures ±32' long by 26 wide with ±2.5' of clearance between the bottom of the bridge and the water's surface. A ±12' wide by ±14' long boat house is situated on the downstream side of the existing bridge and sits approximately 5' from the bridge along the east side of the canal. A fish house is situated along Oyster Creek near the bridge to the southwest. The areas immediately adjacent the bridge are primarily vegetated with fescue and Bermuda grass with some Spartina patens interspersed throughout. Oyster Creek is classified as SA ORW waters by the Environmental Management Commission. Oyster Creek is designated as Coastal Waters and a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. Although this area is designated as a PNA, it is closed to shell fishing. Project description NC DOT's proposal is to replace Bridge #28, which is described above. The project as proposed is to muck out or undercut an area approximately 70'X 30' and then fill the same area to provide a bedding surface for the installation of three 95" (or 7.9) wide by ±67' long metal culverts. Head walls are proposed to retain the fill and for shoreline stabilization on the adjacent canal banks. The area of the proposed excavation and filling consists of approximately 2,100 ft2 of canal bottom. The spoil material associated with the mucking out activity will be transported to a high ground disposal site. Anticipated impacts NC DOT's proposed project would result in the excavation and backfill of approximately 2,100 ft2 of canal bottom to create a bed for the proposed culverts.
