Some wetlands and a shallow swale are located in the eastern part of the tract. Another swale runs along the southeastern property line. Adjacent land use is commercial to the north, a church to the east, undeveloped and mowed land to the south, and Highway 17 to the west. 4b. Explain the purpose of the proposed project:* The purpose of the project is to construct a veterinary clinic to serve the needs of the community. Wetland impacts are needed to construct part of the parking lot and access way to an adjacent tract. 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: The project includes the construction of a 66.5' x 67.5' veterinary clinic, a 24-ft wide driveway, and 21 parking spaces behind the building. Note that parking cannot be located in front of the building because of an eAsting billboard in this area. Additionally, the project will treat stormwater via infiltration in the front of the site and in uplands in the southeast, which frees up space for a larger larking lot behind the building that vehicles can circle through. This has a smaller footprint than the previously permitted cul-de-sac configuration. They are also proposing a 20-ft wide access road to the tract south of the site (Baptist Church), which was strongly encouraged by Fender County to provide interconnectivity between tracts. The building, parking, and access area will be cleared of vegetation and fill material will be brought into the site to level the area of disturbance. The structure, road, and parking area will then be constructed. Track hoe, loader, dump truck, bob cat, and other standard construction equipment will be used. 4j. Please upload project drawings for the proposed project. VET CLINIC SITE PLAN 04-01-2020.pdf 1 AMB 5. Jurisdictional Determinations 5a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The previous site plan that was authorized by the USACE and DWR proposed impacts to 0.2 acre of wetlands for an emergency turn -around area. Since that time, the project engineer was able to revise the plan to treat stormwater via infiltration in the front of the site and in uplands in the southeast, which frees up space for a larger parking lot behind the building that vehicles can circle through. This has a smaller footprint than the previously permitted configuration and has reduced impacts to less than 0.1 acre. The 20-ft wide road that provides access to the tract south of the site (Baptist Church) is strongly encouraged by Fender County to provide interconnectivity between tracts. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: A stormwater plan and erosion control plan will be implemented to minimize secondary impacts from run off and erosion. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State? r Yes r No 2b. If this project DOES NOT require Compensatory Mitigation, explain why: Impacts have been reduced to less than 0.1 acre F. Stormwater Management and Diffuse Flow Plan (required by DWR) 1. Cumulative Impacts (DWR Requirement) 3a. Will this project result in additional development, which could impact nearby downstream water quality?* r Yes r No 3b. If you answered "no," provide a short narrative description. Project will not provide access or utilities to adjacent properties. No additional wetland impacts are anticipated on the site. 4. Sewage Disposal (DWR Requirement) 4a. Is sewage disposal required by DWR for this project?* r Yes r Nor NA 4b. Describe, in detail, the treatment methods and dispositions (non -discharge or discharge) of wastewater generated from the proposed project. If the wastewater will be treated at a treatment plant, list the capacity available at that plant. Project will tie into municipal wastewater treatment system. 5. Endangered Species and Designated Critical Habitat (Corps Requirement) 5a. Will this project occur in or near an area with federally protected species or habitat?* r Yes r No 5b. Have you checked with the USFWS concerning Endangered Species Act impacts?* r Yes r No 5d. Is another Federal agency involved?* r Yes r No r Unknown 5e. Is this a DOT project located within Division's 1-8? r Yes r No 5f. Will you cut any trees in order to conduct the work in waters of the U.S.? r Yes r No 5g. Does this project involve (1) blasting, and/or (2) other percussive activities that will be conducted by machines, such as jackhammers, mechanized pile drivers, etc.? r Yes r No 5j. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? The NC Natural Heritage Program website was reviewed to determine the known presence of federally listed species. No federally protected species are known to occur on or within a one -mile radius of this site. Since the lot is mostly cleared, it would not provide suitable habitat for the red -cockaded woodpecker. A few trees exist on the perimeter of the site, which may support appropriate roosting habitat for the northern long-eared bat. Since no hibernacula or roosting trees are known to occur in close proximity to the site, any effect to the species from tree clearing would be exempt per the 4(d) rule.
