Edenton, NC, Chowan County
A Division of Energy, Mineral, and Land Resources file review has determined that Stormwater Permit
SV 7971119 expired on June 15, 2012 and the Division has not received an application for renewal. A
search of the Chowan County tax records revealed that your company now owns this property. The
stormwater rules (15 A NCAC 2H .1000) require that applications for permit renewals be submitted 180 days
prior to the expiration of a permit. Operation of a stormwater treatment facility without a valid permit is a
violation of NC General Statute 143-215.1 and may result in an appropriate enforcement action including
assessment of civil penalties.
Please submit a completed name change application and a renewal application along with a processing fee
of $505.00 within 30 calendar days. The required application forms can be found on our website at

ARTICLES OF INCORPORATION
OF
COLONIAL VILLAGE OWNERS ASSOCIATION OF EDENTON, INC.
Pursuant to §55A-2-02 of the General Statutes of North Carolina, the undersigned does hereby
submit these Articles of Incorporation for the purpose of forming a nonprofit corporation.
The name of the corporation is Colonial Village Owners Association of Edenton, Inc.
2. The purposes of the corporation are to serve as an owners' association, as described and
contemplated in the North Carolina Planned Community Act, Chapter 47F of the General
Statutes of North Carolina, and to perform all of the purposes and duties indicated for the
corporation in the Declaration of Protective Covenants, Conditions and Restrictions for Colonial
Village Subdivision (hereinafter, the "Declaration") recorded in Book 348, Page 56, in the office
of the Register of Deeds of Chowan County, as such Declaration may be amended.
3. In addition to any powers granted to the corporation under the laws of the State of North
Carolina, the corporation shall have all the powers granted to the corporation in the Declaration
and shall have the full power and authority to do everything necessary and suitable or proper for
the accomplishment of any of the purposes set forth above or the furtherance of any other power
hereinbefore set forth, either alone or in connection with other entities, and as principal or agent,
and to do every other act or thing, individually or appurtenant to, growing out of or connected
with the aforesaid purposes and powers, or any of them.

9. Upon dissolution of the corporation, after all liabilities and obligations of the corporation
have been paid, or adequate provision made therefor, the corporation shall distribute its
remaining assets to its members with an equal share allocated to each lot in the subdivision.
10. No director of the corporation shall be personally liable for monetary damages for breach
of any duty as a director except (i) acts or omissions occurring. prior to the date of the
effectiveness of these Articles of Incorporation, (ii) acts or omissions that the director at the time
of the breach knew or believed were clearly in conflict with the best interests of the corporation,
(iii) any liability under §55A-8-32 or §55A-8-33 of the North'Carolina General Statutes or any
successor provisions, or (iv) any transaction from which the director derived an improper
personal financial benefit. As used herein, the term "improper personal financial benefit" does
not include a director's reasonable compensation or other reasonable incidental benefit for or on
account of his or her service as a director, trustee, officer, employee, independent contractor,
attorney or consultant of the corporation.
The corporation shall indemnify to the full extent permitted under Chapter 55A of the
North Carolina General Statutes all directors and officers of the corporation against liability and
expenses in any proceeding arising out of their status as a director and/or officer of the
corporation or their activities in the capacity of a director and/or officer of the corporation.
However, the foregoing indemnification shall not apply to (i) acts or omissions that, at the time
taken, the director or officer knew or believed to be clearly in conflict with the best interests of
the corporation; or (ii) any activity from which the director or officer received an improper
personal benefit. The corporation shall reimburse any director or officer for all reasonable costs,
expenses and attorney's fees incurred in connection with the enforcement of such director's or
officer's right to indemnification.
Notwithstanding the foregoing, if any provision of the North Carolina General Statutes is
amended or enacted to permit further. limitation, elimination or indemnification of the personal
liability of a director or officer of the corporation, the personal liability of the directors and
officers of the corporation shall be limited, eliminated or indemnified to the fullest extent
permitted by the applicable law.
This Section shall not affect a provision permitted under the North Carolina General
Statutes, these articles and the corporation's bylaws or contract or resolution of the corporation
indemnifying or agreeing to indemnify a director against personal liability.

Any repeal or modification of this Section 10 shall not adversely affect any limitation
hereunder on the personal liability or indemnification of a director or officer with respect to acts
or omissions occurring prior to such repeal or modification.

until the first annual meeting of the members of the corporation, or until their successors are

This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1
.1003 for failing to comply with terms, conditions and limitations of a Stormwater Management Permit
No. SW7971 1 19. Please Note, clue to Session Law 2009-406, this permit has been extewded until June
15, 2011 and is still considered an active and valid permit.
On December 8, 2009, Amy Adams of the Washington Regional Office performed an inspection to
determine the status of compliance with Stormwater Permit SW7971119. Permit Number SW7971 l 19
was issued to you on June 15, 1998 for the Colonial Village, located at Coke Avenue, Edenton, Chowan
County, North Carolina.
As a result of the site inspection and DWQ file review, the following observations and violations are
noted:
1. Permit Condition 41-III. General Conditions
DWQ observed that according to the Chowan County Register of Deeds Office, this project is now owned
by Coke Edenton Partners, LLC. However, no ownership change form has been submitted to this Office
for approval. This is a violation of Permit Number SW7971 1 19 Condition # 1 which states "This permit
is not transferrable. In the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of Water Quality..."
111. _Failure to Provide Operation and Maintenance
Condition 3 of Stormwater Permit SW7971 1 19 requires that the pertnittce shall provide the operation and
maintenance necessary to operate the storm water controls at optimum efficiency "Specific operation

IV. Failure to Submit a Designer's Certification
Title 15A NCAC 2H .1008 0) requires that upon completion of construction, the designer for the type of
stormwater system installed must certify that the system was inspected during construction, was
constructed in substantial conformity with plans and specifications approved by DWQ, and complies with
the requirements of this Section. As of the date of this letter, DWQ has not received this certification.
Required Response
This Office requires that you respond to this letter in writing to the address listed at the
bottom of the letterhead within 30 calendar days of receipt of this Notice. Please provide a
written "Plan of Action" which outlines the actions you will take to correct the following
violation(s) and a time frame for completion of those actions.
1. Submit the enclosed Name/Ownership Change Request form
L Submit the required Engineer's Certification
3. Submit the enclosed O&M Norm and provide O&M on -site to address issues noted in
inspection report.
Thank you for your immediate attention to this matter. Please be advised, these violations and any
continuing or future violations are subject to a civil penalty assessment of up to $25,000.00 per day
for each violation pursuant to North Carolina General Statute 143-215.6A,This office requires that

1. According to County records, the site is now owned by Coke Edenton Partners, LLC. However, no ownership change form has
been submitted to DWQ for approval. Please submit this paperwork to this Office.
2. No Engineer's Certification has been provided for this project. Please submit this documentation to this Office
3. Due to lack of O&M on site, there are some areas of bare soil along the side slopes of the pond. Please re-establish grass in these
areas and keep mowed to appropriate height. Please refer to new O&M agreement for issues and solutions to problems.
4. The outlet structure does not appear to match the approved plan sheets. Please have an Engineer verify that the outlet structure
is constructed and operating as per the approved plans.
5. The forebay berm could not be located on the date of inspection. Please verify the location and condition of the forebay berm.

(NCAC) 21-1 .1003 in accordance with North Carolina General Statute (G.S) 143-214.7 for failure to
apply for and secure a renewal of Stormwater Management Permit SW7971119, which expired on June
15, 2008.
On April 25th, 2009 Amy Adams of the Washington Regional Office performed an inspection to
determine the status of compliance with Stormwater Management Permit SW7971119. Permit Number
SW7971119 was issued to Colonial Village Group, 111c., on June 15, 1998 for the residential subdivision
known as Coloniai Village, located in Edenton, Chowan County, North Carolina. On June 15, 2008 this
permit expired and it is required that it be renewed. During the file inspection, DWQ observed:
The stormwater control measures have been installed and as noted above, DWQ has not received
an application for renewal.
The property is under new ownership and DWQ has not received a change of name/ownership
form required to transfer the permit.
As a result of the site inspection and DWQ file review, the following violations are noted:
1. Failure to Renew State Stormwater Permit
Title 15A NCAC 2H .1003 (h) (2) requires that applications for permit renewals to be submitted 190 days
prior to the expiration of the permit. On December 21, 2007 (180 days prior to expiration of -permit), ttn
application for a permit renewal was required to be submitted to DWQ. As of the date of' this letter.

11. Failure to Apply For and Secure a Stormwater Management Permit
Title 15A NCAC 2H .1003, in accordance with G.S. 143-214.7, requires a State Stormwater Management
Permit for development activities within the 20 coastal counties that required a Coastal Area Management
Act (CAMA) Major Permit and/ or an Erosion and Sedimentation Control Plan. The DWQ file review
confirms that a valid, active State Stormwater Management Permit was not obtained prior to the
expiration of Stormwater Permit SW79711 19.
Required Response
This Office requires that you respond to this letter in writing within 30 calendar days of receipt of this
Notice. Your response should be sent to this office at the letterhead address. Your response should
address the following items:
Submit the enclosed renewal and ownership change applications with new signed O&M
agreement and Designer's Certification along with the processing fee, currently set at $505
Thank you for your immediate attention to this matter. Please be advised, these violations and any
continuing or future violations are subject to a civil penalty assessment of up to $25,000.00 per day
for each violation pursuant to North Carolina General Statute 143-215.6A.

which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000-per day.

This letter transmits notice of a civil penalty assessed against Coke Edenton Partners, LLC in the amount
of $2339.34, which includes $339.34 in investigative costs. Attached is a copy of the assessment
document explaining this penalty.
This action was taken under the authority vested in me by delegation provided by the Secretary of the
Department of Environment and Natural Resources and the Director of the Division of Water Quality.
Any continuing violation(s) may be the subject of a new enforcement action, including an additional
penalty.
Within thirty (30) calendar days of receipt of this notice, you must do one of the following three
options:
Submit payment of the penalty, OR
File a request for remission of civil penalties, OR
File a written petition with the Office of Administrative Hearings.
Failure to exercise one of the above three options within thirty (30) calendar days of your receipt of

Option 2 — File a request for remission of civilpenalties:
A request for remission or mitigation is limited to consideration of the reasonableness of the
amount of the penalty and is not the proper procedure for contesting the accuracy of any of the
statements contained in the assessment letter.
Because a remission request forecloses the option of an administrative hearing, such a
request will not be processed without a waiver of your right to an administrative hearing
and a stipulation that there are no factual or legal issues in dispute.
You must execute and return to this office the attached "Waiver of Right. to an Administrative
Hearing and Stipulation of Facts" and the attached "Justification for Remission Request" which
should describe why you believe:
(a) one or more of the civil penalty assessment factors in G.S. 143 B-282. I (b) were
wrongfully applied to the detriment of the petitioner,
(b) the violator promptly abated continuing environmental damage resulting from the
violation;
(c) the violation was inadvertent or a result of an accident;
(d) the violator had been assessed civil penalties for any previous violations;
(e) payment of the civil penalty will prevent payment for the remaining necessary remedial
actions.

Acting pursuant to North Carolina General Statues (hereby known as G.S.) 143-215.6A,1, Al
Hodge, of the Division of Water Quality (hereby known as DWQ), make the following:
1. FINDING OF FACT
A. Coke Edenton Partners, LLC is a company organized and existing under the laws of
the State of North Carolina.
B. Coke Edenton Partners, LLC are responsible for developing a site, known as
Colonial Village, located on Coke Avenue in Chowan County, North Carolina.
C. Coke Edenton Partners, LLC are the owners of record with Chowan County
Register of Deeds for the development of Colonial Village (Parcel ID
781517012210). .
D. On December 8, 2009, DWQ staff from the Washington Regional Office
inspected the site and observed that impervious surfaces were installed on the
subject site.
E. Title 15A North Carolina Administrative Code (hereby known as NCAC) 2H
.1003 requires a State Stormwater Management Permit for development activities
within the 20 coastal counties that require a Coastal -Area Management Act
(hereby known as CAMA) Major Permit or an Erosion and Sedimentation Control
Plan.
F. A review of DWQ files confirmed that no Stormwater Management Permit,
Individual Permit, or Certificate of Coverage to operate under a General Permit
has been issued to Coke Edenton Partners, LLC.
G. A review of DWQ files confirmed that the subject site required Erosion and
Sedimentation Control Plan.
H. In January 1998, Colonial Village Group was issued an approval for an Erosion
and Sedimentation Control Plan for Colonial Village development.

Chowan County is a Coastal County as defined by Title I SA NCAC 2H .1002(4).
Stormwater from the subject site drains to Albemarle Sound, Class SC waters
within the Pasquotank Basin.
K. The cost to the State of the enforcement procedures in this matter totaled $339.34.
Based upon the above Finding of Fact, I make the following:
II. CONCLUSION OF LAW
A. Coke Edenton Partners, LLC is a "person" within the meaning of G.S. 143-
215.6A pursuant to G.S. 143-212 (4).
B. Albemarle Sound constitutes waters of the State within the meaning of G.S. I43-
212 (6).
C. Coke Edenton Partners, LLC violated Title 15A NCAC .1003 by failing to secure
a State Stormwater Management Permit for the project known as Colonial
Village.
D. Coke Edenton Partners, LLC may be assessed civil penalties in this matter
pursuant to G.S. 143-215.6A (a)(2), which provides that a civil penalty of not
more than twenty-five thousand dollars ($25,000) per violation per day may be
assessed against a person who is required but fails to apply for or to secure a
permit required by G.S. 143-215.1, or who violates or fails to act in accordance
with the terms, conditions, or requirements of such permit or any other permit or
certification issued pursuant to authority conferred by this Part.
E. Coke Edenton Partners, LLC may be assessed civil penalties pursuant to G.S.
143-215.6A (a)(6) which provides that a civil penalty of not more than twenty-
five thousand dollars ($25,000.00) per violation may be assessed against a person
who violates a rule of the Commission implementing this Part, Part 2A of this
Article, or G.S. 143-355(k).,
F. The State°s enforcement cost in this matter may be assessed against Coke Edenton
Partners, LLC pursuant to G.S. 143-215.3 (a)(9) and G.S. 143B-282.1(b)(8).
G. Al Hodge of the DWQ, pursuant to delegation provided by the Secretary of the
Department of Environment and Natural Resources and the Director of the
Division of Water Quality, has the authority to assess civil penalties in this matter.

Accordingly, Coke Edenton Partners, LLC is hereby assessed a civil penalty of:

This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1
.1003 for failing to obtain a state stormwater permit. in accordance with General Statue G.S. 143-214.7
On December 8, 2009, Amy Adams of the Washington Regional Office performed an inspection to
determine the status of compliance with Stormwater Permit SW7971119. Permit Number SW79711 19
was issued to Colonial Village Group on lone 15, 1998 for the Colonial Village, located at Coke Avenue,
Edenton, Chowan County, North Carolina. In 2005, Coke Edenton Partners, LLC acquired this property
through purchase as recorded with the Chowan County Register of Deeds book 339/Page 68.
On December 3 1 " you received the Notice of Violation which required a response by February I" 2010.
On April 5, 2010 you received a Deadline to Avoid Further Action letter which required a response by
April 15rh, 2010. To date, no response has been received and this Office is recommending you for
enforcement actions.
As a result of the site inspection and DWQ file review, the following observations and violations are
noted:
I. Failure to Obtain a State Stormwater Permit
DWQ observed that according to the Secretary of State, Colonial Village Group is dissolved and no
longer owns the common areas. In addition, DWQ observed that according to the Chowan County
Register of Deeds Office, this project is now owned by Coke Edenton Partners, LLC and Coke Edenton
Partners, LLC are operating a stormwater treatment system without a storrttwater permit.. However, no
ownership transfer requst has been submilled to this Office for approval of the original permit.
SW7971 l 19. A review of DWQ files confirmed that no State Stormwater Management Permit has been
issued Coke Edenton Partners, LLC.

This Office requires that you respond to this letter in writing to the address listed at the
bottom of the letterhead within 15 calendar days of receipt of this Notice. Please provide a
written "Plan of Action" which outlines the actions you will take to correct the following
violation(s) and a time frame for completion of those actions.
• Submit the enclosed Name/Ownership Change Request form and associated
documentation.
By copy of this letter to the Chowan County Building Inspector, this Office is requesting that the Building
Inspector consider withholding building permits and Certificates of Occupancy for this project until this
matter is satisfactorily resolved.
"Thank you for your immediate attention to this matter. This Office is considering an enforcement action
including the assessment of civil penalties regarding these violations and any continuing violations that
may be encountered. Your above -mentioned response to this correspondence will be considered in this
process. Please be advised, these violations and any continuing or future violations are subject to a
civil penalty assessment of up to $25,000.00 per day for each violation pursuant to North Carolina
General Statute 143-2.15.6A.This office requires that the violations, as detailed above, he abated and

Enclosed is an enforcement recommendation package for Coke Edenton Partners, LLC.
(Colonial Village Subdivision) in Chowan County, NC. Amy Adams of this Office conducted a
site inspection on December 8, 2009. A Notice of Violation was issued on December 16, 2009
and Deadline to Avoid Further Action letter was issued on April 1, 2010. A Notice of Violation
with Recommendation for Enforcement was issued on September 29, 2010. To date, no
response to any DWQ NOV has been received in this office.
The current status of the site is unchanged from original documented violations.
The impacts have resulted in the following violations:

ASSESSMENT FACTORS
1) The degree and extent of harm to the natural resources of the State, to the public health, or
to private property resulting from the violation;
Stormwater treatment facilities are designed to store and treat stormwater prior to discharge. By
failing to obtain a stormwater permit with the required certifications of the system, Coke Edenton
Partners have potentially allowed stormwater pollutants to enter into Edenton Bay of Albemarle
Sound. Weir elevations do not allow for adequate retention time which may result in failure to
meet TSS reduction requirements.
2) The duration and gravity of the violation;
The project was originally permitted more than 10 years ago. For some unknown portion of that
time, the treatment system has not been treating stormwater as required and designed.
3) The effect on ground or surface water quantity or quality or on air quality;
Surface water has been exposed to untreated stormwater creating the potential for adverse impacts
from pollutants for more than 10 years.
4) The cost of rectifying the damage;
Costs would be associated with retaining engineering consultants, application fees for permit, and
any repair work needed to bring the system into compliance.
5) The amount of money saved by noncompliance;
Amount of money saved is unclear. Associated permit fees and any contract work would be
potential money saved.
6) Whether the violation was committed willfully or intentionally;
There is no indication or proof that violation was willful or intentional

Edenton, NC, Chowan County
A Division of Energy, Mineral, and Land Resources file review has determined that Stormwater Permit SW7971119
expired on June 15, 2012 and the Division has not received an application for renewal. A search of the Chowan County
tax records revealed that your company now owns this property. The stormwater rules (15 A NCAC 2H .1000) require that
applications for permit renewals be submitted 180 days prior to the expiration of a permit. Operation of a stormwater
treatment facility without a valid.permit is a violation of NC General Statute 143-215.1 and may result in an appropriate
enforcement action including assessment of civil penalties.
Please submit a completed name change application and a renewal application along with a processing fee of $505.00
within 30 calendar days. The required application forms can be found on our website at

The above referenced permit was issued June 15, 1998 for a 134-lot high -density
residential subdivision. The enclosed copy of Colonial Village has been revised to show
only 120 lots. The changes include additional open space and some reduction in roadway
due to the elimination of one cul-de-sac and several connector streets became cut -de -sacs.
These changes were made to obtain approval from the Town of Edenton.
The roadway elevations from the original plan were maintained and the detention
pond design has not changed.

Pursuant to §55A-2-02 of the General Statutes of North Carolina, the undersigned does hereby
submit these Articles of Incorporation for the purpose of forming a nonprofit corporation.
l . The name of the corporation is Colonial Village Owners Association of Edenton, Inc,
2. The purposes of the corporation are to serve as an owners' association, as described and
contemplated in the North Carolina Planned Community Act, Chapter 47F of the General
Statutes of North Carolina, and to perform all of the purposes and duties indicated for the
corporation in the Declaration of Protective Covenants, Conditions and Restrictions for Colonial
Village Subdivision (hereinafter, the "Declaration") recorded in Book 348, Page 56, in the office
of the Register of Deeds of Chowan County, as such Declaration may be amended.
3. In addition to any powers granted to the corporation under the laws of the State of North
Carolina, the corporation shall have all the powers granted to the corporation in the Declaration
and shall have the full power and authority to do everything necessary and suitable or proper for
the accomplishment of any of the purposes set forth above or the furtherance of any other power
hereinbefore set forth, either alone or in connection with other entities, and as principal or agent,
and to do every other act or thing, individually or appurtenant to, growing out of or connected
with the aforesaid purposes and powers, or any of them.

4. Upon dissolution of the corporation, after all liabilities and obligations of the corporation
have been paid, or adequate provision made therefor, the corporation shall distribute its
remaining assets to its members with an equal share allocated to each lot in the subdivision.
10. No director of the corporation shall be personally liable for monetary damages for breach
of any duty as a director except (i) acts or omissions occurring. prior to the date of the
effectiveness of these Articles of Incorporation, (ii) acts or omissions that the director at the time
of the breach knew or believed were clearly in conflict with the best interests of the corporation,
(iii) any liability under §55A-8-32 or §55A-8-33 of the North'Carolina General Statutes or any
successor provisions, or (iv) any transaction from which the director derived an improper
personal financial benefit. As used herein, the term "improper personal financial benefit" does
not include a director's reasonable compensation or other reasonable incidental benefit for or on
account of his or her service as a director, trustee, officer, employee, independent contractor,
attorney or consultant of the corporation.
The corporation shall indemnify to the full extent permitted under Chapter 55A of the
North Carolina General Statutes all directors and officers of the corporation against liability and
expenses in any proceeding arising out of their status as a director and/or officer of the
corporation or their activities in the capacity of a director and/or officer of the corporation.
However, the foregoing indemnification shall not apply to (i) acts or omissions that, at the time
taken, the director or officer knew or believed to be clearly in conflict with the best interests of
the corporation; or (ii) any activity from which the director or officer received an improper
personal benefit. The corporation shall reimburse any director or officer for all reasonable costs,
expenses and attorney's fees incurred in connection with the enforcement of such director's or
officer's right to indemnification.
Notwithstanding the foregoing, if any provision of the North Carolina General Statutes is
amended or enacted to permit further. limitation, elimination or indemnification of the personal
liability of a director or officer of the corporation, the personal liability of the directors and
officers of the corporation shall be limited, eliminated or indemnified to the fullest extent
permitted by the applicable law.
This Section shall not affect a provision permitted under the North Carolina General
Statutes, these articles and the corporation's bylaws or contract or resolution of the corporation
indemnifying or agreeing to indemnify a director against personal liability.

Any repeal or modification of this Section 10 shall not adversely affect any limitation
hereunder on the personal liability or indemnification of a director or officer with respect to acts
or omissions occurring prior to such repeal or modification.

(3) Monitoring requirements are included to verify the performance of the control measures; and
(4) Alternatives are available if the control measures fail and shall be required when the Director
determines that the system has failed.
(c) General Engineering Design Criteria For All Projects.
(1) The size of the system must take into account the runoff at the ultimate built -out potential from all
surfaces draining to the system, including any off -site drainage. The storage volume of the system
shall be calculated to provide for the most conservative protection using runoff calculation methods
described on pages A.1 and A.2 in "Controlling Urban Runoff: A Practical Manual For Planning..
And Designing Urban BMPs" which is hereby incorporated by reference not including
amendments. This document is available through the Metropolitan Washington (D.C.) Council of
Governments at a cost of forty dollars ($40.00). This method is also described in the Division's
document "An Overview of Wet Detention Basin Design." Other engineering methods may be
approved if these methods are shown to provide for equivalent protection;
(2) All side slopes being stabilized with vegetative cover shall be no steeper than 3:1 (horizontal Ito
vertical);
(3) All stormwater management structures shall be located in recorded drainage easements for the
purposes of operation and maintenance and shall have recorded access easements to the nearest
public right-of-way. These easements shall be granted in favor of the parry responsible for
operating and maintaining the stormwater management structures;
�oG�+re (4) Vegetative filters designed in accordance with Paragraph (f) of this Rule are required from the
�j overflow of all infiltrations stems and discharge of all stormwater wet detention ponds. These
filters shall be at least 30 feet in length except where a minimum length of 50 feet is required in
accordance with Rule .1005(2)(b)(iii) of this Section;
(5) Stormwater controls shall be designed in accordance with the provisions of this Section. Other
designs may be acceptable if these designs are shown by the applicant, to the satisfaction of the
Director, to provide equivalent protection;
(6) In accordance with the Antidegradation Policy as defined in 15A NCAC 2B .0201, additional
control measures may be required on a case -by -case basis to maintain and protect. for existing and
/ n anticipated uses, waters with quality higher than the standards; and
(7) Stormwater control measures used for sedimentation and erosion control during the construction
0 /V phase must be cleaned out and returned to their designed state.
(d) Infiltration System Requirements. Infiltration systems may be designed to provide infiltration of the
entire design rainfall volume required for a site or a series of successive systems may be utilized. Infiltration
may also be used to pretreat runoff prior to disposal in a wet detention ponds. The following are general
requirements:
(1) Infiltration systems shall be a minimum of 30 feet from surface waters and 50 feet from Class SA
waters;
(2) Infiltration systems shall be a minimum distance of 100 feet from water supply wells;
(3) The bottom of infiltration systems shall be a minimum of two feet above the seasonal high water
table;

(7) Infiltration systems must not be sited on or in fill material, unless approved on a case -by -case basis
under Paragraph (h) of this Rule;
(8) Infiltration systems may be required on a case -by -case basis to have an observation well to provide
ready inspection of the system;
(9) If runoff is directed to infiltration systems during construction of the project, the system must be
P44 restored to design specifications after the project is complete and the entire drainage area is;

.1007 STORMWATER REQUIREMENTS: OUTSTANDING RESOURCE WATERS
All development activities which require a stormwater management permit under Rule .1003 of this Section
and which drain to waters classified as Outstanding Resource Waters (ORW) shall manage stormwater runoff
in accordance with the provisions of this Rule. Water quality conditions shall clearly maintain and protect
the outstanding resource values of waters classified as Outstanding Resource Waters (ORW). Stormwater
management strategies to protect resource values of waters classified as ORW shall be developed on a site
specific basis during the proceedings to classify these waters as ORW. The requirements of this Rule serve
as the minimum conditions that must be met by development activities. More stringent stormwater
management measures may be required on a case -by -case basis where it is determined that additional measures
are required to protect water quality and maintain existing and anticipated uses of these waters.
(1) Freshwater ORWs: Development activities which require a stormwater management permit under
Rule .1003 of this Section and which drain to freshwaters classified as ORW shall manage
stormwater runoff as follows:
(a) Low Density Option: Development shall be permitted pursuant to Rule .1003(d)(1) of this Section
if the development has:
(i) built -upon area of 12 percent or less or proposes single family residential development on lots
of one acre or greater;
(ii) stormwater runoff transported primarily by vegetated conveyances; conveyance system shall not
include a discrete stormwater collection system as defined in Rule .1002 of this Section; and
(iii) a 30 foot wide vegetative buffer.
(b) High Density Option: Higher density developments shall be permitted pursuant to Rule .1003(d)(2)
of this Section if stormwater control systems meet the following criteria:
(i) control systems must be wet detention ponds or alternative stormwater management systems
designed in accordance with Rule .1008 of this Section; and
(ii) control systems must be designed to control runoff from all surfaces generated by one inch of
rainfall.
(2) Saltwater ORWs: Development activities which require a stormwater management permit under -Rule
.1003 of this Section and which drain to saltwaters classified as ORW shall manage stormwater
runoff as follows:
(a) Within 575 feet of the mean high water line of designated ORW areas, development activities shall
comply with the low density option as specified in Rule .1005(2)(a) of this Section.
(b) Projects draining to saltwaters classified as ORW that impact the Areas of Environmental Concern
(AEC), determined pursuant to G.S. 113A-I I3, shall delineate the ORW AEC on the project plans
and conform to low density requirements as specified in Rule .1005(2)(a) of this Section within the
ORW AEC.
(c) After the Commission has received a request to classify Class SA waters as ORW and given
permission to the Director to schedule a public hearing to consider reclassification and until such
time as specific stormwater design criteria become effective, only development which meets the
requirements of Rule .1003(d)(3)(A), (B) and (C) and Rule .1005(2)(a) of this Section shall be
approved within 575 feet of the mean high water line of these waters.

.1008 DESIGN OF STORMWATER MANAGEMENT tifEASURES
(a) Structural Stormwater Control Options. Stormwater control measures which may be approved pursuant
to this Rule and which shall not be considered innovative include:
(1) Stormwater infiltration systems including infiltration basins/ponds, swales, and vegetative filters;
(2) Wet detention ponds; and
(3) Devices approved in accordance with Paragraph (h) of this Rule.
All stormwater management structures are subject to the requirements of Paragraph (c) of this Rule.
(b) Innovative Systems. Innovative measures for controlling stormwater which are not well established
through actual experience may be approved on a demonstration basis under the following conditions:
(1) There is a reasonable expectation that the control measures will be successful;
(2) The projects are not located near High Quality Waters (HQW);

(e) Wet Detention Pond Requirements. These practices may be used as a primary treatment device or as
a secondary device following an infiltration system. Wet detention ponds shall be designed for a specific
pollutant removal. Specific requirements for these systems are as follows;
(1) The design storage volume shall be above the permanent pool;
(2) The discharge rate from these systems following the one inch rainfall design storm shall be such
that the draw downn to the permanent pool level occurs within five days, but not in less than two
• days;
(3) The design permanent pool level mean depth shall be' a minimum of three feet and shall be
designed with a surface area sufficient to remove 85 percent of total suspended solids. The design
for 85 percent total suspended solids removal shall be based on "Methodology for Analysis of
Detention Basins for Control of Urban Runoff Quality" which is hereby incorporated by reference
not including subsequent amendments. This document is available from the U.S. Environmental
Protection Agency (Document number EPA440/5-87-001) at no cost;
(4) The inlet structure must be designed to minimize turbulence using baffles or other appropriate
design features and shall be located in a manner that avoids short circuiting in the pond;
(5) Pretreatment of the runoff by the use of vegetative filters may be used to minimize sedimentation
and eutrophication of the detention pond;
(6) Wet detention ponds shall be designed with a forebay to enhance sedimentation at the inlet to the
pond;
(7) The basin side slopes for the storage volume above the permanent pool shall be stabilized with
vegetation down to the permanent pool level and shall be designed in accordance with
Subparagraph (c)(2) of this Rule;
(8) The pond shall be designed with side slopes no steeper than 3: l (horizontal to vertical);
(9) The pond shall be designed to provide for a vegetative shelf around the perimeter of the basin.
This shelf shall be gently sloped (6:1 or flatter) and shall consist of native vegetation;
(10) The pond shall be designed to account for sufficient sediment storage to allow for the proper
operation of the facility between scheduled cleanout periods. '
(f) Vegetative Filter Requirements. Vegetative filters shall be used as a non-structural method for providing
additional infiltration, filtering of pollutants and minimizing stormwater impacts. Requirements for these
filters are as follows:
(1) A distribution device such as a swale shall be used to provide even distribution of runoff across
the width of the vegetative filter;
(2) The slope and length of the vegetative filter shall be designed, constructed and maintained so as
"5 to provide a non -erosive velocity of flow through the filter for the 10 year storm and shall have
c� ��a slope of five percent or less, where practicable: and
(3) Vegetation in the filter may be natural vegetation, grasses or artificially planted wetland vegetation
qcc l' appropriate for the site characteristics.
(g) Curb Outlet Systems. Projects that meet the low density provisions of Rules .1005 through .1007W
this Section may use curb and gutter with outlets to convey the stormwater to grassed swales or vegetated
areas prior to the runoff discharging to vegetative filters or wetlands. Requirements for these curb outlet
systems are as follows:
(1) The curb outlets shall be located such that the swale or vegetated area can carry the peak flow from
the 10 year storm and the velocity of the flow shall be non -erosive;
(2) The longitudinal slope of the swale or vegetated area shall not exceed five percent, where
practicable;
(3) The side slopes of the swale or vegetated area shall be no steeper than 5:1 (horizontal to vertical).
Where this is not practical due to physical constraints, devices to slow the rate of runoff and
encourage infiltration to reduce pollutant delivery shall be provided;
(4) The minimum length of the swale or vegetated area shall be 100 feet; and
(5) In sensitive areas, practices such as check dams, rock or wooden, may be required to increase
detention time within the swale or vegetated area.
(h) Alternative Design Criteria. In addition to the control measures outlined in Paragraphs (b), (d), (e),
(f) and (g) of this Rule, stormwater management systems consisting of other control options or series of
control options may be approved by the Director on a case -by -case basis. This approval shall only be given
in cases where the applicant can demonstrate that the Alternative Design Criteria shall provide equal or better

stormwater control, equal or better protection of waters of the state, and result in no increased potential for
nuisance conditions. The criteria for approval shall be that the stormwater management system shall provide
for 85 percent average annual removal of Total Suspended Solids and that the discharge rate from the system
meets one of the following:
(1) the discharge rate following the one -inch design storm shall be such that the runoff -volume draws
down to the pre -storm design stage within five days, but not less than two days; or
(2) the post development discharge rate shall be no larger than predevelopment discharge rate for the ' +
one year 24 hour storm.
(i) Operation and maintenance plans. Prior to approval of the development by the Division an operation
and maintenance plan or manual shall be provided by the developer for stormwater systems, indicating the a
operation and maintenance actions that shall be taken, specific quantitative criteria used for determining when
those actions shall be taken, and who is responsible for those actions. The plan must clearly indicate the steps
that shall be taken and who shall be responsible for restoring a stormwater system to design specifications if
a failure occurs and must include an acknowledgment by the responsible party. Development must be
maintained consistent with the requirements in these plans and the original plans and any modifications to these
plans must be approved by the Division.
0) System Design. Stormwater systems must be designed by an individual who meets any North Carolina
occupational licensing requirements for the type of system proposed. Upon completion of construction, the
designer for the type of stormwater system installed must certify that the system was inspected during
construction, was constructed in substantial conformity with plans and specifications approved by the Division
and complies with the requirements of this Section prior to issuance of the certificate of occupancy.

.1009 STAFF REVIEW AND PERMIT PREPARATIOI
(a) The staff of the permitting agency shall conduct a review of plans, specifications and other project data
accompanying the application and shall determine if the application and required information are complete.
The staff shall acknowledge receipt of a complete application.
(b) If the application is not complete with all required information, the application may be returned to the
applicant. The staff shall advise the applicant by mail:
(1) how the application or accompanying supporting information may be modified to make them
acceptable or complete; and
(2) that the 90 day processing period required in G.S. 143-215.1 begins upon receipt of corrected or
complete application with required supporting information.
(c) If an application is accepted and later found to be incomplete, the applicant shall be advised how the
application or accompanying supporting information may be modified to make them acceptable or complete,
and that if all required information is not submitted within 30 days that the project shall be returned as
incomplete.

.1010 FINAL ACTION ON PERMIT APPLICATIONS TO THE DIVISION
(a) The Director shall take final action on all applications not later than 90 days following receipt of a
complete application and with required information. All permits or renewals of permits and decisions denying
permits or renewals shall be in writing.
(b) The Director is authorized to:
(1) issue a permit containing such conditions as are necessary to effectuate the purposes of G.S. 143,
Article 21;
(2) issue permit containing time schedules for achieving compliance with applicable water quality
standards and other legally applicable requirements:
(3) deny a permit application where necessary to effectuate:
(A) the purposes of G.S. 143, Article 21;
(8) the purposes of G.S. 143-215.67(a);

In response to your letter I would like to attempt to address your concerns.
- I am forwarding the back portion of the Stormwater Application with Phillip
Harrington's (owner) signature.
- As for the engineer's seal, I am unsure why you are not accepting a
surveyor's seal as stormwater management/design is a requirement for
registration and is allowed to be designed by a surveyor for subdivisions or
site plans being designed by that surveyor. I would appreciate it if you
would let me know if we are falling under other guidelines that would prohibi
me from designing this system.
- I have made arrangements with John Gagnon a soil scientist with Soil & Wate
to meet with me on site and review soil borings with me to confirm the soil
types on site in the area of the retention pond. I wanted to check with you
to see if this will be acceptable to you and if it will address what I am
assuming to be your concern of the ability for this pond to allow for
infiltration.
Please advise either by e-mail or phone if these are acceptable to you so tha
we may finalize the permitting process.

This site is a 23.3 acre parcel located on Coke Avenue in Edenton, Chowan
County, North Carolina. Site topography ranges from 16'.at the.Northwest corner
to 10'at an existing slough at the south east corner. Site soils are considered
classified as Tomotley and Agusta find sandy loams, both types having high it
infiltration rates. The property is well drained. The north east portion of the tract
drains through a drainage ditch leading to Queen Anne Creek. T e remain`�er of
the track drains through a natural slough at t e south east tract corner with the
slough draining to Queen Anne Creek. Site vegetation is sparse with the majority
of the tract under cultivation.

This project involves the construction of roadways and utility infrastructure to
serve 136 single family residential lots. Roadways will be constructed using two
typical sections. The first roadway section to be constructed on Barefoot Lane,
Pendleton Trail, Middlesborough Lane and Belvedere Lane will consist of 16' of
asphalt paving with a 2' -concrete valley gutter(roll down curb) on each edge of
pavement. The second roadway section to be constructed on the remainder of the
roads will consist of 23' asphalt paving with a2' concrete valley gutter.on each
edge of pavement. Both sections will be applied over 6" of compacted aggregate
base course.
All lots will be filled above the level of the roadway. Property fine. swales will be
constructed along all side and rear property lines (in easements provided).
Water will be provided from the.regional water system. Wastewater disposal will
be provided through a gravity sewer system leading to an off site, municipal
wastewater treatment facility.
4. Stormwater Narrative
The stormwater runoff generated by. impervious surfaces within this project will
initially collect in side and rear property line swales. The high infiltrationrates of
the site soils will allow rapid infiltration of minor storm events.
Once the property line swales fill up, the runoff will overflow into the roadway
where it will -be collected by the valley -gutters. The roadway and valley gutters
will then convey the stormwater to an infiltration basin at the south east tract
corner. The infiltration basin will collect and infiltrate this runoff. During a major
storm event, the infiltration pond will overflow through a rip -rap lined channel to a
natural slough leading off site to Queen Anne Creek.

rainfall will generate approximately 39,000 ft3 of runoff (using a 1" storm x impervious
surface x c(0.95). Based on these quantities the infiltration basin will handle the first 1.8"
